A. This big ball on top <strong>of</strong> <strong>the</strong> tower, you could not tell what it was made out <strong>of</strong>. whe<strong>the</strong>r it was brass or<br />

steel, as <strong>the</strong> ends <strong>of</strong> <strong>the</strong> wires where it had been grounded had rusted out and blown away, and <strong>the</strong>re was a<br />

thousand and one little wires sticking out in every direction, so you could not see what it was made up <strong>of</strong>.<br />

The Referee: You could not get up?<br />

The Witness: You could not get up. You could get up so you could see <strong>the</strong> fibres <strong>of</strong> everything up <strong>the</strong>re,<br />

you could see it plain enough, but <strong>the</strong> tower was rotted in no end <strong>of</strong> places, it had never been taken care<br />

<strong>of</strong>, nothing had ever been done to it.<br />

Mr. Hawkins: I ask that that be stricken out<br />

The Referee: Yes. granted as to <strong>the</strong> last part.<br />

A. Insecure. There was none <strong>of</strong> <strong>the</strong> woodwork that have ever been painted, all that held it toge<strong>the</strong>r was<br />

<strong>the</strong> big steel plates on <strong>the</strong> sides <strong>of</strong> it.<br />

Q. As I understood, you say <strong>the</strong> woodwork was badly rotted out?<br />

A. Rotted away, yes, sir.<br />

Q. So that <strong>the</strong> tower in that condition was a menace to anybody passing near it, in view <strong>of</strong> its insecurity?<br />

Mr. Hawkins: That is objected to as calling for a conclusion and a speculation. The Referee: I think so.<br />

Mr. Fordham : Not a speculation. The man is an expert in his own line.<br />

The Referee: Objection sustained.<br />

Mr. Hawkins: I ask that it be stricken out.<br />

The Referee: Stricken out.<br />

Q. Tell <strong>the</strong> Court from your own knowledge <strong>of</strong> structural materials, as an engineer, whe<strong>the</strong>r <strong>the</strong> tower was<br />

safe or unsafe, as you found it at that time?<br />

Mr. Hawkins: That is objected to.<br />

A. Absolutely unsafe.<br />

The Referee: Have you sufficiently qualified<br />

Q. (Interrupting.) Yes or no.<br />

Mr. Fordham: Just a moment If <strong>the</strong> Court please, I object to this on <strong>the</strong> ground that no foundation has<br />

been laid to qualify this "witness.<br />

The Referee: I will let him answer that question. Overruled.<br />

Mr. Fordham: Exception.<br />

A. Yes.<br />

Q. At that time, to what use could <strong>the</strong> property be put?<br />

Mr. Fordham: That is objected to, if <strong>the</strong> Court please, on <strong>the</strong> ground that it calls for <strong>the</strong> conclusion <strong>of</strong> an<br />

expert witness, and that <strong>the</strong>re has no foundation been laid to qualify Mr. Tesla as an expert on real<br />

property value
