particular view taken of any <strong>in</strong>dividual human be<strong>in</strong>g is that the conduct<br />

which is adat for him is that which is proper accord<strong>in</strong>g to his position<br />

<strong>in</strong> life. This view of a m<strong>in</strong>imal capacity <strong>in</strong> the adat legal universe is<br />

markedly at variance with that <strong>in</strong> <strong>Islam</strong>ic law.<br />

(b) <strong>Islam</strong>ic law:<br />

The <strong>Islam</strong>ic legal system ascribes a m<strong>in</strong>imal capacity <strong>and</strong> recognition<br />

only to those persons who are Muslims. 24 It is upon the fact of adherence<br />

to religion that <strong>Islam</strong>ic law claims <strong>and</strong> exercises an exclusive<br />

jurisdiction. This is quite dissimilar to both the adat <strong>and</strong> English law<br />

position; the former does not dem<strong>and</strong> any similar condition nor is the<br />

person def<strong>in</strong>ed otherwise than as a natural person. English law is similar<br />

to adat <strong>in</strong> that the po<strong>in</strong>t of normative reference taken is the natural<br />

human be<strong>in</strong>g; however, English law, like <strong>Islam</strong>ic law, does claim an<br />

exclusive jurisdiction <strong>in</strong> the def<strong>in</strong>ition of the legal person.<br />

The dist<strong>in</strong>ction between adat <strong>and</strong> <strong>Islam</strong> can best be illustrated by<br />

a description of the treatment of the <strong>Islam</strong>ic claim to jurisdiction over<br />

the def<strong>in</strong>ition of legal personality as this has appeared <strong>in</strong> judicial<br />

proceed<strong>in</strong>gs. The choice of this framework for discussion has been dictated<br />

by the fact that the substance of <strong>Islam</strong>ic law <strong>in</strong> <strong>Malaya</strong> 25 is that<br />

which is determ<strong>in</strong>ed by an English law-based judicial <strong>and</strong> legislative<br />

system. The outst<strong>and</strong><strong>in</strong>g example is the decision given by the S<strong>in</strong>gapore<br />

Court of Appeal <strong>in</strong> Re Maria Huberd<strong>in</strong>a Hertogh : Mansor Adabi v.<br />

A.P. Hertogh & Anor? 6 The background to this decision is as follows:<br />

Maria Hertogh had been left <strong>in</strong> <strong>In</strong>donesia as a child dur<strong>in</strong>g the Japanese<br />

advance <strong>in</strong> 1941. She was cared for <strong>and</strong> brought up as a Muslim girl<br />

by a servant of the respondent. The respondent had managed to trace<br />

her whereabouts after the war <strong>and</strong> attempted to rega<strong>in</strong> custody of his<br />

daughter. This was resisted by the girl's foster parent <strong>and</strong> resulted <strong>in</strong><br />

an action <strong>in</strong> the S<strong>in</strong>gapore High Court where the respondent was<br />

successful. At the time this decision was given, however, the girl entered<br />

<strong>in</strong>to a contract of marriage to the appellant <strong>in</strong> the present case. Her<br />

age at this time was fifteen years. The Court was asked to decide upon<br />

the validity of this marriage (which was valid at Muslim law): the<br />

Court found as a fact that the girl was an adherent of the Muslim<br />

religion.<br />
