codicil A supplement or addition to a will modifying,<br />
explaining, or otherwise qualifying the will in some way.<br />
corpus delicti The body of the crime. The fact of a<br />
transgression.<br />
demurrer A pleading stating that although the facts<br />
alleged in a complaint may be true, they are insufficient<br />
for the plaintiff to state a claim for relief and for the<br />
defendant to frame an answer.<br />
dictum 1. A statement of opinion or belief considered<br />
authoritative due to the dignity of the person making it.<br />
2. A familiar rule; a maxim.<br />
due process clause The constitutional provision that<br />
prohibits the government from unfairly or arbitrarily<br />
depriving a person of life, liberty, or property. (There are<br />
two Due Process Clauses in the U.S. Constitution, in the<br />
5th and 14th amendments.)<br />
duty A legal obligation.<br />
easement An interest in land owned by another person,<br />
consisting in the right to use or control the land, or an<br />
area above or below it, for a specific limited purpose.<br />
en banc On the bench. Descriptive of a court session in<br />
which all judges of the court are present and participating.<br />
ex parte From the part. On or from one party only,<br />
usually without notice to or argument from the adverse<br />
party.<br />
habeas corpus That you have the body. A writ employed<br />
to bring a person before a court, most frequently to ensure<br />
that the party’s imprisonment or detention is not illegal.
