Chairman’s Message<br />

At its January 20<strong>09</strong> meeting, the DCA Board appointed the members<br />

<strong>of</strong> the Performance Events Committee. <strong>The</strong>y are listed at the bottom<br />

<strong>of</strong> this page along with their contact information.<br />

<strong>The</strong> field events for DCA 20<strong>09</strong> are scheduled for October 11 – 17. A<br />

proposed schedule and judges panels are listed later in this issue.<br />

Region II, which is hosting DCA 2010, has decided on splitting the<br />

field events and the “town” events such as was done in 2008. At this<br />

point, the field events are scheduled for the week <strong>of</strong> January 10,<br />

2010 while their town events are slated for September. Unfortunately<br />

the 20<strong>09</strong> events being held late in the year will mean that there will<br />

be a short interval between the two, unavoidable given the climate <strong>of</strong><br />

southern California. Consequently, plans will have to be made for<br />

2010 before 20<strong>09</strong> is done … not a bad habit to get in for sure. <strong>The</strong><br />

judges’ nomination form for the 2010 field events is included in this<br />

issue <strong>of</strong> <strong>The</strong> Voice. Please note that nominations must be received by<br />

April 15. On a positive note, the tracking and field events will be held<br />

at adjacent areas in the same regional park in Chino, and the<br />

earthdog tests are planned only 30 miles away in Anaheim. <strong>The</strong>se<br />

are the same field and earthdog locations used in 2000 and 2004,<br />

and both are near several major airports (Orange County) for those<br />

<strong>of</strong> you interested in making the trip.<br />

Semantics and terminology overlap can catch and confuse any <strong>of</strong> us<br />

at any time. In this issue, I’ve submitted an article to (hopefully)<br />

help performance folks wade through the various disciplinary “planes”<br />

that deal with dogs and handlers within the AKC events rules, all <strong>of</strong><br />

which are referred to as “disqualifications.” It is truly unfortunate<br />

that the exact same word has been used to designate such diverse<br />

scenarios and radically different consequences. Recent years have<br />

seen several new rules added to both the field trial and earthdog regulations, and just last week a<br />

new report form was added to the mix.<br />

It is especially important for all who judge and serve on committees (especially those who have not<br />

been to an AKC seminar since 2004) to read through and come to understand what is required in<br />

each instance. <strong>The</strong> more we know, the more consistently and easily we will be able to properly<br />

follow through should a difficult situation arise. <strong>The</strong> more familiar and confident we become in our<br />

ability to handle any crisis, the sooner we can then go back to enjoying our dogs, our friends and<br />

our sport.<br />

A note from your editor –<br />

You might notice a few differences in this issue.<br />

Some shuffling around, some new formats … but the biggest change is that we will<br />

no longer include a list <strong>of</strong> upcoming field trials and earthdog tests in <strong>The</strong> Voice. That<br />

information is readily available through the Event Search feature at the AKC website.<br />

Eliminating those listings will allow us to <strong>of</strong>fer more “original content” and pictures without<br />

fear <strong>of</strong> maxing out the attachment limitations <strong>of</strong> the average email server. For example, our<br />

Spring issue will feature an article discussing four <strong>of</strong> the great field trial events held for<br />

<strong>Dachshund</strong>s each year: the Annual, the National, the Host Trial, and the Buckeye DC<br />

Invitational. We will explore their history and traditions, their differences and their<br />

similarities.<br />

Suggestions regarding article topics, tips and information for “News You Can Use”, fun<br />

photos, seminar dates, etc. are welcome as always. If you would like to submit an article,<br />

please contact Jean Dieden or me. All submissions will be reviewed by members <strong>of</strong> the PEC<br />

before publication.<br />

On a final note, many thanks to the field trial secretaries and other “reporters” who provided<br />

me with results throughout the year. Your timely assistance was vital and very much<br />

appreciated. Please keep it up!<br />

DCA 20<strong>09</strong><br />

<strong>The</strong> <strong>of</strong>ficial DCA 20<strong>09</strong> website is now up and running at www.dca20<strong>09</strong>.com . Check in there<br />

periodically. New information will be added as the events approach.<br />

A schedule <strong>of</strong> the DCA 20<strong>09</strong> field events – complete with contact information, locations and judges<br />

– can be found on Page 8 <strong>of</strong> <strong>The</strong> Voice. We have also included a sponsorship form for the<br />

tracking, field and earthdog events. Please note this form does not include the plaques and<br />

medallions which are awarded at the DCA National events (just the host club trial). A sponsorship<br />

form for those items will be available on the DCA website at a later date.<br />

New Board Policy on DCA National Field Trial Judges<br />

During its November meeting, the DCA Board adopted a new standing rule that will prohibit a DCA<br />

National Field Trial judge from “exhibiting” at the trial. In this context, “exhibiting” means dogs<br />

owned or co-owned may not be entered at the National Field Trial. Nor may any National judge<br />

handle a dog at the trial either. DCA National Earthdog judges will not face the same restriction.<br />

This policy change mimics an existing standing rule (adopted in 1999) which states that the “DCA<br />

President and the show chair <strong>of</strong> the National shall not exhibit at the National.” It will go into<br />

effective in 2010 and is noted on the Judge Nomination form included on Page 11 <strong>of</strong> <strong>The</strong> Voice.<br />

Please make sure that potential judges are appraised <strong>of</strong> this policy and willing to <strong>of</strong>ficiate before<br />

nominating them.<br />

DCA 2010 & DCA 2011<br />

<strong>The</strong> field events for DCA 2010 are slated for the week <strong>of</strong> January 10th. As occurred in 1998 and<br />

2008, conformation and most <strong>of</strong> the companion events will be held during a different part <strong>of</strong> the<br />

year. <strong>The</strong>se “town” events are scheduled for September 27 – October 3, 2010 in Riverside, CA.<br />

<strong>The</strong> host club, DC <strong>of</strong> Santa Ana Valley, has already put up a website ( www.dca2010.com ) and<br />

will be adding lots <strong>of</strong> information to it in the coming months.<br />

In related news, DCA is seeking a host for the 2011 national specialty events. Interested clubs<br />

should contact DCA Secretary Marlies Noll. She can be reached via email at mdachs@aol.com or<br />

by calling (763) 389-4622. <strong>The</strong> deadline for bids is May 10, 20<strong>09</strong>.<br />

New DCA List at Yahoogroups<br />

<strong>The</strong> <strong>Dachshund</strong> <strong>Club</strong> <strong>of</strong> <strong>America</strong> has launched its own Yahoogroup, DCA_BULLETINBOARD.<br />

This will not be a discussion forum but rather a read-only list where information regarding<br />

club activities, events, and resources can be posted. It is anticipated that meeting minutes,<br />

reports, legislative updates and DCA National Specialty premiums will be featured on the new<br />

group. <strong>The</strong> DCA Board may also use Yahoogroups’ polling function to solicit member input on<br />

various issues.<br />

All DCA members are encouraged to join this new group. You can do so by sending a request to<br />

DCA_BULLETINBOARD-subscribe@yahooogroups.com . Be sure to include your name<br />

somewhere in the email so that DCA membership can be verified.<br />

Sunrise / Sunset Information<br />

It is quite helpful to have sunrise and sunset times at your fingertips when planning tracking test<br />

draws, field trial roll calls, and earthdog test start times. This information is equally critical at the<br />

end <strong>of</strong> your field trial day given Procedure 1-I (“… no <strong>Dachshund</strong> shall be put down after 30<br />

minutes following <strong>of</strong>ficial sunset”).<br />

Daily information can <strong>of</strong>ten be found in a local newspaper, but what about long range planning? Or<br />

last minute searches?! Where exactly can you find <strong>of</strong>ficial sunset times for specific days and / or<br />

locations?<br />

Consult <strong>The</strong> Old Farmer’s Almanac website, www.almanac.com . If you have a BlackBerry or<br />

some other type <strong>of</strong> smartphone, you might even be able to access the Almanac’s interactive<br />

sunrise / sunset calculator from the field. [Your BlackBerry also makes a decent flashlight, too …<br />

but if you need it to read the call names <strong>of</strong> the next brace, don’t bother with the Almanac. It is<br />

way past <strong>of</strong>ficial sunset!]<br />

<strong>The</strong> direct link for this feature is www.almanac.com/rise/index.php . Just input a location and<br />

a date. You can select the locale by typing in a zip code, selecting from a pull-down list <strong>of</strong> cities<br />

and towns (a surprisingly large number are available), or even by clicking on a US map. <strong>The</strong> latter<br />

does not work very well on a smartphone, <strong>of</strong> course.<br />

If you are into gadgets, there are even some freeware programs out there for BlackBerry and<br />

other PDAs that calculate sunrise and sunset times (plus many other astronomical data). Try<br />

www.crackberry.com or the forums at blackberry.net if you are interested in those. One key<br />

disadvantage <strong>of</strong> this type <strong>of</strong> s<strong>of</strong>tware, however, is that latitude and longitude information is usually<br />

AKC’s New “Dog Disqualification by Judge” Report Form<br />

AKC has developed a separate "Dog Disqualification by Judge" report for use at all performance<br />

events, including <strong>Dachshund</strong> field trials and earthdog tests.<br />

This form is "effective immediately" even if a copy was not included with your secretary's packet.<br />

You can find the form online in the Downloadable Forms section <strong>of</strong> the AKC website. [Once on<br />

that page, scroll down to the Performance Judges category.]<br />

In the past, dog disqualification reports were written on the back <strong>of</strong> the secretary's trial / test<br />

report. <strong>The</strong> new form can only be used to document situations that occur while dogs are under<br />

judgment and must be completed by the judge(s). It is still turned into AKC with the secretary’s<br />

event report, however. For a discussion <strong>of</strong> this and other DQ procedures, please turn to this<br />

issue’s Voice Forum on Page 14. (Submitted by Jean Dieden)<br />

AKC Earthdog Seminar & Training Weekend in Illinois<br />

On May 23 rd and 24 th , Badger DC will sponsor a two-day earthdog seminar at the Northern Illinois<br />

Beagle <strong>Club</strong> in Roscoe. <strong>The</strong> first day will be devoted to the AKC seminar and judges test. That<br />

presentation will be handled by AKC Field Representative Barbara Teigen. <strong>The</strong> second day will be<br />

devoted to hands-on training sessions led by AKC earthdog judge M.A. Klein. Actual ME runs will<br />

be conducted, to be followed by discussions on den design & construction, the ME walkup,<br />

honoring, and control.<br />

<strong>The</strong> seminar fee is $50. That price includes dinner on both days. <strong>The</strong> program will begin at 1:30<br />

pm Saturday and Sunday. Presentations are scheduled until 8 pm both days. Contact MA Klein at<br />

Special Logo Celebrating AKC’s 125 th Anniversary<br />

AKC has created a special commemorative logo that clubs may use any place<br />

an AKC logo would normally be inserted. This graphic is for 20<strong>09</strong> events only.<br />

A high resolution copy <strong>of</strong> the logo can be requested by contacting AKC Communications at (212)<br />

696-8308 or by emailing communications@akc.org . Be sure to include “AKC 125 th Logo” on<br />

the subject line when making the request via email.<br />

Event Planning & Corresponding Dates<br />

Sooner or later, most clubs will have to move an event date. DCA Host clubs may need to do so in<br />

order to accommodate the national specialty, while non-host clubs may elect to move or cancel a<br />

date in a given year due to conflicts with DCA or local, non-dog events.<br />

One way to preserve your club’s rights to a particular date in succeeding years is to file your<br />

application for those events now. Although the AKC Online Plans system will not generate a<br />

corresponding event until the prior year’s event has been processed, there is no such restriction on<br />

paper or faxed submissions. You will have to pay the event application fee when you send in the<br />

application but do not have to supply a judging panel in order to lock-up the date in AKC’s system.<br />

[A number <strong>of</strong> clubs have been doing this for years, but it does not hurt to point it out to everyone.<br />

This kind <strong>of</strong> thing comes in handy when juggling national events.]<br />

Farmerville trials but found the phone number to be disconnected. It appears that they have shut<br />

down the business and moved away.<br />

In related news, Larry Shaw <strong>of</strong> Fountain Head Supply in Warwick, RI also is retiring from the<br />

dog supply business. Larry told me that another New England beagler is interested in taking over<br />

the business, however, so fans <strong>of</strong> his day-glo collars should not despair … or throw away Larry’s<br />

contact information just yet!<br />

Planning Judging Panels Before Events Are Approved<br />

Another tip from Jean Dieden::<br />

“In order to make our fiscal calendar year easier to track, I've tried to hold <strong>of</strong>f submitting event<br />

application fees until after January 1 st … even if the events are completely planned earlier. As a<br />

result, I ran into a little problem this winter as I tried submitting a judges' panel while the event<br />

was still listed as "pended," not approved due to the fee having not yet been received.<br />

Apparently this is an AKC "no-no." Oops...<br />

Here's a suggestion from Sue Richards at Event Operations on how judges panels may be planned<br />

on the online system before an event is fully approved:<br />

“You can use the JPP (not the Quick Submit) system to plan your panel without submitting<br />

the judge’s to AKC. You can get to the system two ways. When you first enter the Online<br />

System, you would use choice 2b <strong>of</strong> the Judges Planning Tool. When you are at the<br />

application site, under Judges Information and Management click on Manage Judges using<br />

the OLP Application tool.<br />

When you use this tool, under judges' Contract Status you would “Pend” the contract status.<br />

Once you do that, our system will not recognize that you have entered the judge. Some<br />

systems do have a problem with JAVA and must use a tool to troubleshoot the problem. If<br />

you click on the link below, it will assist you in trouble shooting this problem:<br />

AKC Earthdog Judges Directory Information<br />

In case you're wondering … the online AKC judges directory only lists a maximum <strong>of</strong> eight<br />

earthdog class assignments and then stops counting. It seems this is an arbitrarily selected<br />

number as there is no "10 trial" rule for earthdog judges. (submitted by Jean Dieden)<br />

Also worth noting … Introduction to Quarry assignments are only counted in the judges directory if<br />

the records were submitted to AKC (which is not required but would be a helpful practice). Back a<br />

number <strong>of</strong> years ago, even if the IQ judging sheets were sent in to Event Operations the<br />

assignment was not always recorded in the judges directory. (ed.)<br />

<strong>The</strong> Year in Review:<br />

2008 <strong>Dachshund</strong> Field Trial Statistics<br />

<strong>The</strong>re were 75 <strong>Dachshund</strong> field trials held by DCA and 26 regional clubs in 2008. <strong>The</strong> largest event<br />

<strong>of</strong> the year was DFWDC’s “host” trial with 119 entries including 65 field champions. <strong>The</strong> National<br />

Field Trial was the second largest with 108 entries. Those numbers were quite amazing given that<br />

the two events occurred in Texas during a very ICY week in January!<br />

Three day trial weekends and the rule change that allowed licensed clubs to hold two additional<br />

trials per year have already begun to make their impact on the annual statistics as witnessed by<br />

the table below. In Region III, DFWDC had two “extra” trials in 2008 while Houston DC<br />

supplemented its December weekend with a Friday open stake-only trial. [Several other clubs plan<br />

to <strong>of</strong>fer Friday open-only trials in 20<strong>09</strong>. Metro Atlanta and GPDC have already scheduled three trial<br />

weekends for the spring.] In Region IV, the Saint Louis club added a fall field trial weekend while<br />

Buckeye DC moved its invitational to Friday in order to accommodate a second licensed trial during<br />

its weekend. In Region VI, DFABC and Met Washington DC combined to sponsor a fall field trial<br />

weekend at Swatara Beagle grounds that will be utilized for DCA 20<strong>09</strong>.<br />

Over the course <strong>of</strong> the year, 150 field champions earned stake placements at member or licensed<br />

<strong>Dachshund</strong> field trials. 96 <strong>of</strong> those dogs placed at least twice thereby making themselves eligible<br />

for the DCA Field Trial Merit standings. <strong>The</strong> top 20 dogs for 2008 are shown on the next page. For<br />

those interested, a complete listing <strong>of</strong> the merit point rankings can be found in the Files section <strong>of</strong><br />

the DCA Performance Events group on Yahoo. Prior year data is also available there.<br />

Congratulations to all … particularly Mike Pitisci and DC Town Farms Water Wings aka Brooke.<br />

Brooke earned 12 placements and four absolutes in 2008. She is only the fifth <strong>Dachshund</strong> to earn<br />

more than 300 merit points in a calendar year. <strong>The</strong> first two dogs to do so were Huti (FC Qua-<br />

Linea Achates Tehuti JE) and Czar (FC Czar v Moosbach-Zuzelek) in 2001. Huti accumulated 325<br />

DCA FIELD TRIAL MERIT AWARDS: DCA Membership requirements for Awards will be in accordance with current policy as<br />

determined by the DCA Board for DCA Merit Award Programs. Only those points earned for placements in the Field Champion stakes at AKC<br />

licensed or member trials will count toward the DCA Field Trial Merit Awards. Points are tabulated using the Delaney System +1 for first through<br />

fourth place, based on the number <strong>of</strong> starters. In the case <strong>of</strong> ties, dogs will receive the same place award, with the next place(s) being skipped.<br />

A minimum <strong>of</strong> two placements in Field Champion stakes during the award year are required to earn an award, and / or be included in preliminary<br />

listings.<br />

points that year, while Czar won 303 points. <strong>The</strong> redoubtable Oscar (FC Longtime’s Oscar von<br />

Zimmer JE) earned more than 300 merit points in three different years. He amassed 433 points in<br />

2003, 419 points in 2004, and 426 points in 2006. Ana Maria (FC Hurricane Ana Maria v Czar SW<br />

JE) garnered 392 in 2007. Brooke is in good company indeed! [Many thanks to Cheri Faust and<br />

Lois Ballard for confirming these numbers and dates. Please note that all point totals in this<br />

paragraph were tabulated under the Delaney +1 system that DCA adopted from 2002 forward.<br />

Under the 1995-2001 merit point system, dogs were awarded a 10 point bonus for absolute wins.<br />

Prior to 1995, an absolute winner was awarded points equal to the total number <strong>of</strong> entries in the<br />

In yet another sign <strong>of</strong> the times … for the second year running, it took more than 100 merit points<br />

to crack the top 20. 23 dogs actually passed that benchmark in 2008. In contrast, only 13 dogs<br />

earned 100 or more points in 2006.<br />

<strong>The</strong>re were strong finishes in the last quarter particularly from Oslo, Danika and Ochre. We saw<br />

lots <strong>of</strong> movement within the standings through mid-December. At year’s end, just six points lay<br />

between #6 Shag and #9 Danika while the late FC Zindox Seb. Buzz Holzfalr MW SE finished just<br />

out <strong>of</strong> the top 20 with 111 points. 2008 was a bittersweet year for Buzz’s owner, John Merriman.<br />

In addition to Buzz’s successes, his Carmen had an excellent year finishing at #4 in the DCA Field<br />

Trial Merit Award standings.<br />

<strong>The</strong> Forum features editorials and commentary on topics <strong>of</strong> interest to the<br />

performance events community. Before being considered for publication, all<br />

articles must be submitted to the Performance Events Committee and will be<br />

reviewed for content by the committee.<br />

WHEN IS A “DISQUALIFICATION” NOT A<br />

“DISQUALIFICATION?”<br />

From time to time, both dog aggression and human misconduct have been addressed in <strong>The</strong> Voice. <strong>The</strong> most recent<br />

<strong>of</strong>fering on those topics was a December 2005 article by Larry Gohlke. Larry’s piece did a good job <strong>of</strong> summarizing the<br />

AKC’s policies for dealing with aggression and misconduct. Given some recent changes instituted by AKC, however, the<br />

PEC felt that it would be appropriate to take a fresh look at these issues. [<strong>The</strong> December 2005 edition <strong>of</strong> <strong>The</strong> Voice – and<br />

many other back issues – are available in the Files section <strong>of</strong> the DCA Performance Events list on Yahoogroups. Those who<br />

are unable to participate in the Yahoogroup can obtain an electronic version <strong>of</strong> back issues by contacting the editor.]<br />

<strong>The</strong>re is confusion regarding the term “disqualification” when applied to AKC performance events<br />

such as field trials and earthdog tests. My understanding is that rules across all venues are being<br />

reworked by AKC to become consistent.<br />

<strong>The</strong>re is different documentation for each type <strong>of</strong> incident that should be familiar to all judges and<br />

committee members and merits careful review. <strong>The</strong> rules ensure that incidents can be recorded<br />

timely and accurately to help protect all involved parties and to guard against incomplete<br />

accounts should future action result. As a judge, committee member and board member <strong>of</strong> a club<br />

that hold such events (and therefore subject to lawsuit), as a land owner who conducts AKC<br />

events on my property and as an exhibitor, this can be disconcerting when missed details affect<br />

final incident decisions.<br />

To help be better prepared to deal with potentially bad event situations, here is an effort to clarify<br />

the most important points.<br />

QUALIFYING and NON-QUALIFYING<br />

<strong>The</strong>se terms are the appropriate terms to apply to passing performances or scores at events<br />

where judging is based on an expected standard <strong>of</strong> accomplishment, such as earthdog tests.<br />

Judges should be mindful to refer to a dog as having been “NQ’d” or “failed” for inadequate work<br />

rather than “disqualified” for any reason other than what is listed below.<br />

DISQUALIFICATION DUE TO ELIGIBILITY ISSUES<br />

<strong>Dachshund</strong> field trials and earthdog tests most <strong>of</strong>ten do not “disqualify” dogs based on eligibility.<br />

This is the term used in the breed ring in reference to dogs with “disqualifying faults” listed in the<br />

breed standards or for certain corrective surgical procedures. <strong>The</strong> earthdog rules do specify that<br />

dogs without useful vision or hearing are “ineligible” to compete.<br />

DISQUALIFICATION DUE TO ABSENCE<br />

<strong>The</strong> Voice<br />

This phrasing applies in field trials to the 15 minute rule in Procedure 5-E from Field Trial Rules<br />

and Standard Procedure for <strong>Dachshund</strong>s:<br />

“Any <strong>Dachshund</strong>, except the bracemate for the odd <strong>Dachshund</strong> in first series, that does not<br />

appear within 15 minutes after the judges have called for its brace shall be marked absent<br />

in any series and shall not be permitted to run. …<strong>The</strong> judges shall establish a reasonable<br />

time limit before disqualifying for absence a <strong>Dachshund</strong> that they have selected as the<br />

bracemate for the odd <strong>Dachshund</strong> in first series.”<br />

Note that such DQ due to absence “shall be reported by the judges to the Field Trial Committee,<br />

which shall investigate the absence and submit a complete report to <strong>The</strong> <strong>America</strong>n Kennel <strong>Club</strong>”.<br />

DISQUALIFICATION BY JUDGE<br />

This is an intermediate level <strong>of</strong> penalty that applies in performance events ONLY to cases <strong>of</strong><br />

“attack” WHILE UNDER JUDGMENT. Specifically, here are the sections <strong>of</strong> the rules that apply:<br />

Field Trial Rules and Standard Procedure for <strong>Dachshund</strong>s, Chapter 5, Section 4:<br />

“DQ by Judge A dog is not eligible to be entered or to compete in any licensed or member<br />

trial if the dog has on two occasions been made the subject <strong>of</strong> the following report: If a<br />

dog, while under judgement, attacks another dog, and if the Judges are<br />

unanimously <strong>of</strong> the opinion that such an attack was without reasonable cause, the<br />

Judges shall identify the <strong>of</strong>fending dog on the judging sheet, and the name <strong>of</strong> the<br />

<strong>of</strong>fending dog shall be listed in the report <strong>of</strong> the trial sent to the <strong>America</strong>n Kennel <strong>Club</strong>.”<br />

Regulations for Earthdog Tests for Small Terriers and <strong>Dachshund</strong>s, Chapter 4, Section 15,<br />

Paragraph 3:<br />

“During the test, the dogs are expected to work together without interference or<br />

aggression. <strong>The</strong> judge may pick up and excuse from the test any dog which willfully<br />

interferes with its bracemate, either playfully or with malice, or any dog which in the<br />

opinion <strong>of</strong> the judge is running out <strong>of</strong> control. <strong>The</strong> judge must disqualify any dog<br />

which attacks its bracemate. <strong>The</strong> judge must report any incident <strong>of</strong> interference or<br />

attack to the test secretary, who shall report such incident to the AKC. Any dogs that<br />

have been disqualified twice shall be barred from participation in AKC Earthdog<br />

events until reinstated by the AKC. <strong>The</strong> remaining dog shall be picked up and shall<br />

run as or with the bye-dog.”<br />

<strong>The</strong> key points to keep in mind regarding DQ by Judge are:<br />

• It is only allowed when one dog ATTACKS another WHILE THE DOGS ARE UNDER<br />

JUDGEMENT.<br />

• No actual injury has to occur. (Note that even “incidents <strong>of</strong> interference” must be reported<br />

to the test secretary, who then shall report to the AKC.) In a memo from the agility<br />

department several years ago, an “attack” consists <strong>of</strong> “any instance where the dog actually<br />

tried to grab someone or did grab them. Skin contact is not required.” Most venues<br />

recognize a difference between “attack” and the lesser “aggressive behavior” which<br />

includes “growling or threatening barking.”<br />

• In <strong>Dachshund</strong> field trials, both judges must unanimously agree that SUCH AN ATTACK WAS<br />

WITHOUT REASONABLE CAUSE. A dog defending itself from being mounted, for instance,<br />

may not be subject to a report.<br />

• A DQ by Judge report is filed by the judge(s) with the event secretary who then includes it<br />

with the rest <strong>of</strong> the paperwork sent in to AKC. Notes are written by the judges on the back<br />

<strong>of</strong> judges sheets and / or included in the secretary’s report. In February 20<strong>09</strong>, AKC<br />

published a separate “Disqualification by Judge” form that is available online and should be<br />

seen in future secretary packets. It was considered “effective immediately.”<br />

• DQ by Judge incidents are considered “two strike” <strong>of</strong>fenses. In other words, after a first<br />

incident, a dog subject to such a report will be able to enter and compete again. After two<br />

such reports, however, the dog will be INELIGIBLE TO BE ENTERED IN THE<br />

CORRESPONDING EVENT.<br />

• <strong>The</strong>re is NO CROSSOVER between event venues. Dogs disqualified at earthdog may run in<br />

field trials, and vice versa. Dogs with two strikes in field trials will only be “ineligible to<br />

enter or compete at licensed or member field trials,” dogs with two strikes at earthdog<br />

tests will be only “barred from participation” at earthdog tests (all classes).<br />

• Dogs under this type <strong>of</strong> disqualification have no restrictions against their appearance on<br />

the grounds <strong>of</strong> any AKC event. Owners may apply to have their dogs reinstated by the<br />

AKC.<br />

DISQUALIFICATION BY COMMITTEE<br />

<strong>The</strong> DQ by Committee rule was added to all AKC events in 2004 after a dog was attacked outside<br />

a show ring and later died <strong>of</strong> its injuries. Previously, there was no specific rule that applied to<br />

dogs outside the arenas <strong>of</strong> competition or that would deal a more severe response to dog on dog<br />

aggression when an injury (or actual death) was involved.<br />

Field Trial Rules and Standard Procedure for <strong>Dachshund</strong>s, Chapter 7, Section 14<br />

OR Regulations for Earthdog Tests for Small Terriers and <strong>Dachshund</strong>s, Chapter 1, Section 19:<br />

“Any dog, that in the opinion <strong>of</strong> the Event Committee or <strong>The</strong> <strong>America</strong>n Kennel <strong>Club</strong>,<br />

attacks a person or a dog at an AKC event, resulting in injury, and is believed by<br />

that Event Committee or <strong>The</strong> <strong>America</strong>n Kennel <strong>Club</strong> to present a hazard to persons or<br />

other dogs shall be disqualified. When the dog is disqualified by the Event Committee<br />

pursuant to this section, a report shall be filed immediately with the Executive<br />

Secretary <strong>of</strong> <strong>The</strong> <strong>America</strong>n Kennel <strong>Club</strong>. <strong>The</strong> disqualified dog may not again<br />

compete at any AKC event nor be on the grounds <strong>of</strong> an AKC event unless and until,<br />

following application for reinstatement by the owner to <strong>The</strong> <strong>America</strong>n Kennel <strong>Club</strong>, the<br />

owner receives <strong>of</strong>ficial notification in writing from the AKC that the dog’s eligibility has<br />

been reinstated.”<br />

This action is, in reality, the end result <strong>of</strong> an INCIDENT REPORT filed by the event committee<br />

whenever an injury occurs (either to another dog or a person.) NO MEMBER OF THE EVENT<br />

COMMITTEE NEED WITNESS THE ATTACK. If the event committee becomes aware <strong>of</strong> an injury, it<br />

must consider disqualification, and in all cases, MUST COMPLETE the “Disqualification by<br />

Committee” form.<br />

Completing an investigation does not automatically result in a DQ. In fact, it may exonerate a<br />

dog. One such case occurred at a recent agility trial when two dogs became entangled in their<br />

leashes outside a ring. One dog panicked and injured the other. As a result, the committee was<br />

obliged to investigate and submit a report.<br />

For an actual DQ by Event Committee to be applied, three conditions must be meet:<br />

1) <strong>The</strong>re must be an attack;<br />

2) there must be an injury; and<br />

3) the Event Committee must believe the dog is a hazard to people or other dogs.<br />

<strong>The</strong> “Disqualification by Committee” form is included in every event secretary packet. It is not<br />

posted online because it is a four-part form from which copies may be distributed. DQ by<br />

Committee reports should be filed any time a dog related injury occurs, NOT JUST WHEN A DOG<br />

IS DISQUALIFIED. Consider it like a report for a work related injury.<br />

<strong>The</strong> report contains a series <strong>of</strong> questions for the committee to address regarding the incident,<br />

including whether the committee feels that the dog represents a hazard and whether or not the<br />

dog was disqualified and the owner notified. [See the included scanned copy <strong>of</strong> the actual report<br />

form to help understand its application.] <strong>The</strong> goal is to obtain fresh witness statements, to<br />

document the injury, and to investigate and to report the circumstances so that the AKC will have<br />

some insight into the committee’s decision. With clubs, committees and landowners frequently<br />

subject to litigation, it is important to record as accurately as possible everything we can. With a<br />

72-hour filing deadline, expediency is essential.<br />

<strong>The</strong> key points to keep in mind regarding DQ by Committee are:<br />

• It applies to ALL incidents that occur at an AKC event, including any time dogs are on the<br />

grounds, in the parking area, in the gallery, etc.<br />

• It applies to ALL incidents where an INJURY occurs. What exactly constitutes an “injury?”<br />

According to an AKC memo, “Any damage to a body, including but not limited to soreness,<br />

bruising, internal injuries” … even coat damage. Skin puncture or laceration is not<br />

required.<br />

• All incidents MUST be investigated by THE COMMITTEE. NO COMPLAINT NEEDS TO BE<br />

FILED from the owner <strong>of</strong> the injured dog for this action to be<br />

• taken. This is NOT A HEARING. Judges, exhibitors, workers, spectators and owners<br />

should be asked to write statements about the incident to be included in the report. <strong>The</strong>re<br />

is no “swearing in” <strong>of</strong> witnesses. It is recommended that injuries be documented by a<br />

licensed veterinarian, at the club’s expense if necessary. Record keeping is essential.<br />

• DQ by Committee reports MUST BE FAXED TO AKC EVENT OPERATIONS WITHIN 72<br />

HOURS <strong>of</strong> the event. <strong>The</strong> fax number is printed on the form. A separate comment may<br />

be made on the event secretary’s report, noting that the investigation occurred. <strong>The</strong> form<br />

does NOT get sent in with the normal secretary reports.<br />

• A DQ by Committee incident is considered a “ONE STRIKE” <strong>of</strong>fense. In other words, after<br />

a first incident, dogs named in such a report are disqualified as soon as notice <strong>of</strong> the<br />

committee decision is given to their owners. A copy <strong>of</strong> the report must be given to the<br />

owner. If he / she has let the premises before the report is complete, it may be sent<br />

certified mail.<br />

• After such a DQ by Committee report has been filed against it, dogs MAY NOT AGAIN<br />

COMPETE AT ANY AKC EVENT NOR BE ON THE GROUNDS OF AN AKC EVENT. This<br />

action crosses over to ALL AKC venues, not just the type event where the injury occurred.<br />

• Owners may apply to have their dogs ”REINSTATED” by the AKC.<br />

MISCONDUCT PROCEEDINGS<br />

<strong>The</strong> rules for dealing with misconduct do NOT apply specifically to the disqualification reports sent<br />

in to AKC by either the judge, event secretary or the committee. Misconduct pertains to the<br />

actions <strong>of</strong> PERSONS in association with an event, while disqualifications are actions taken against<br />

a DOG.<br />

If a committee or exhibitor feels that the handler / owner <strong>of</strong> a dog either through their action or<br />

inaction was largely responsible for an incident then Misconduct<br />

Procedures may be indicated instead <strong>of</strong> a Disqualification report. In some cases, there may be<br />

cause for both.<br />

Charges listed in AKC’s Dealing with Misconduct pamphlet include “failure to control an unruly<br />

dog” [Under Misconduct Against a Judge] and “failure to properly control a dog at an event”<br />

[Under Disorderly Conduct].<br />

<strong>The</strong> key points to keep in mind regarding Misconduct Proceedings are:<br />

• Charges are brought against a PERSON.<br />

• Event Committee HEARINGS are held to investigate the charges.<br />

• If sustained, penalties associated with failing to control a dog charges range from a<br />

REPRIMAND to a 6-month event SUSPENSION with a $1000 fine.<br />

• Dogs involved with any incident ARE NOT PENALIZED SPECIFICALLY. If they are NOT<br />

OWNED by the suspended person, they may continue to be exhibited throughout the<br />

suspension.<br />

• All dogs OWNED OR CO-OWNED by anyone suspended from the AKC are not allowed to be<br />

exhibited during the penalty period. However they can resume their competition once the<br />

period has passed with no further paperwork involved.<br />

• When charges are sustained, the PERSON is SANCTIONED and, if appropriate, SUSPENDED<br />

<strong>of</strong> AKC privileges. People are not, in these cases, “disqualified.”<br />
