1. I have served as Assistant Attorney General for the State <strong>of</strong> West Virg<strong>in</strong>ia s<strong>in</strong>ce<br />

1996. I make this declaration based on my personal knowledge and <strong>in</strong> support <strong>of</strong> the Pla<strong>in</strong>tiff<br />

the above-entitled case. If called as a witness I could, and would, testify to the follow<strong>in</strong>g facts.<br />

2. I have been admitted to practice law <strong>in</strong> the State <strong>of</strong> Ohio s<strong>in</strong>ce 1989, the State <strong>of</strong><br />

West Virg<strong>in</strong>ia s<strong>in</strong>ce 1990 and the State <strong>of</strong> Kentucky s<strong>in</strong>ce 1995. I also have been admitted to<br />

practice before the follow<strong>in</strong>g United States courts: S.D.W.Va. 1990; N.D.W.Va. 1993; E.D.KY<br />

1995; S.D.OH 1995; N.D.OH 2002; 4th Cir.Ct.Appeals 1990.<br />

3. West Virg<strong>in</strong>ia became <strong>in</strong>volved <strong>in</strong> this case <strong>in</strong> February, 2009. No other attorneys<br />

employed by the Office <strong>of</strong> the Attorney General <strong>of</strong> the State <strong>of</strong> West Virg<strong>in</strong>ia who devoted time<br />

to this case seek fees <strong>in</strong> the Jo<strong>in</strong>t Application. Similarly, no paralegals or assistants employed by<br />

the Office <strong>of</strong> the Attorney General <strong>of</strong> the State <strong>of</strong> West Virg<strong>in</strong>ia who devoted time to this case<br />

seek fees.<br />

4. Pursuant to the Court=s Order, the State <strong>of</strong> West Virg<strong>in</strong>ia has prepared<br />

contemporaneous time and expense records, and has periodically submitted those records to the<br />

Missouri Attorney General=s Office. A summary <strong>of</strong> the State <strong>of</strong> West Virg<strong>in</strong>ia=s time and expense<br />

records for both pre- and post-compla<strong>in</strong>t period are attached as part <strong>of</strong> composite <strong>Exhibit</strong>s 1-C<br />

and 1-D.<br />

5. Together with other States jo<strong>in</strong><strong>in</strong>g the Jo<strong>in</strong>t Application, West Virg<strong>in</strong>ia participated<br />

<strong>in</strong> the pre-compla<strong>in</strong>t <strong>in</strong>vestigation <strong>of</strong> the defendants= alleged price-fix<strong>in</strong>g <strong>of</strong> TFT-<strong>LCD</strong> panels and<br />

products. West Virg<strong>in</strong>ia=s participation commenced <strong>in</strong> February, 2009. West Virg<strong>in</strong>ia=s pre-<br />

compla<strong>in</strong>t <strong>in</strong>vestigation <strong>in</strong>cluded the follow<strong>in</strong>g activities:<br />

a) Review <strong>of</strong> documents relat<strong>in</strong>g to alleged conduct <strong>of</strong> defendants;<br />

the multistate group;<br />

status <strong>of</strong> the <strong>in</strong>vestigation.<br />

b) Review and execution <strong>of</strong> common <strong>in</strong>terest and cost share agreements with<br />

c) Investigation <strong>of</strong> state purchases and potential damages; and<br />

d) Draft<strong>in</strong>g <strong>of</strong> memoranda and conferences with management regard<strong>in</strong>g the<br />

6. After the commencement <strong>of</strong> the litigation with other States <strong>in</strong> the Northern District<br />

<strong>of</strong> California, West Virg<strong>in</strong>ia has cont<strong>in</strong>ued to participate <strong>in</strong> the litigation <strong>of</strong> the matter and has<br />

been particularly active <strong>in</strong> matters surround<strong>in</strong>g discovery issues, both <strong>of</strong>fensive and defensive<br />

<strong>in</strong>clud<strong>in</strong>g the follow<strong>in</strong>g:<br />

a) Obta<strong>in</strong><strong>in</strong>g and collection state agency data and documents. More than 16<br />

boxes <strong>of</strong> documents were collected by my <strong>of</strong>fice, numbered and produced to the defendants.<br />

West Virg<strong>in</strong>ia agencies did not keep their records electronically. Thus, this was a manual<br />

process;<br />

b) Respond<strong>in</strong>g to written defensive discovery requests;<br />

c) Negotiat<strong>in</strong>g with defense counsel regard<strong>in</strong>g discovery requests <strong>in</strong>clud<strong>in</strong>g the<br />

scope and subject areas for deposition <strong>in</strong>quiry;<br />

d) Prepar<strong>in</strong>g for and defend<strong>in</strong>g an agency deposition; and<br />

e) Review<strong>in</strong>g thousands <strong>of</strong> documents.<br />

7. West Virg<strong>in</strong>ia participated <strong>in</strong> the settlement processes for both pre-litigation and<br />

post-litigation settlements, <strong>in</strong>clud<strong>in</strong>g review<strong>in</strong>g and comment<strong>in</strong>g on drafts <strong>of</strong> settlement<br />

documents.<br />

8. The total number <strong>of</strong> hours expended to date by West Virg<strong>in</strong>ia on this <strong>in</strong>vestigation<br />

and litigation is 370.05 attorney hours. Us<strong>in</strong>g the Laffey Matrix as <strong>in</strong>creased by the 9 percent<br />

San Francisco adjustment results <strong>in</strong> $191,593.39 <strong>in</strong> attorney fees. Included with this Motion as<br />

<strong>Exhibit</strong> 1-C attached to the Jo<strong>in</strong>t <strong>Declaration</strong> <strong>of</strong> Lizabeth A. Brady and Anne E. Schneider is a<br />

more detailed breakdown <strong>of</strong> West Virg<strong>in</strong>ia's time and bill<strong>in</strong>g rates.<br />

9. All <strong>of</strong> the forego<strong>in</strong>g time spent by employees <strong>of</strong> the West Virg<strong>in</strong>ia Attorney<br />

General=s <strong>of</strong>fice <strong>in</strong> connection with this litigation was reasonable and necessary and appropriate<br />

for the successful litigation and resolution <strong>of</strong> this action.<br />

10. The hourly rates billed by West Virg<strong>in</strong>ia for attorney time vary based upon the<br />

level <strong>of</strong> experience and expertise <strong>of</strong> the declarant, reflect<strong>in</strong>g the prevail<strong>in</strong>g rates charged by<br />

attorneys <strong>in</strong> San Francisco, California.<br />
