A popular question I get<br />

asked several times a week is<br />

what is land cash renting for, or<br />

what is land in Marshall<br />

County worth? Both are not<br />

easy answers because primarily<br />

the rental rates and land values<br />

vary with the type, productivity<br />

of the land(s) discussed, production<br />

practices, and how<br />

much someone wants the land.<br />

When discussing cash rental<br />

rates and land values, everything<br />

is subject to negotiation.<br />

Each landlord and tenant, or<br />

land purchasing situation may<br />

have different values.<br />

Good communication<br />

between landlord and tenant is<br />

the key to having a successful<br />

worked with landlords and tenants<br />

who have not renegotiated<br />

their leases for years. In one<br />

case, when I was working with<br />

a landlord and I asked what the<br />

cash rental rate was for cropland<br />

involved in the discussion<br />

and the landlord’s cash rental<br />

rate quoted was the average<br />

cash rental rate in 1998. The<br />

rent has not been adjusted for<br />

13 years! Tenants and landlords<br />

should at least be discussing<br />

their leases every three<br />

to five years.<br />

Reviewing leases is not just<br />

for cash leases. Crop-share<br />

leases should at least be<br />

reviewed every three to five<br />

Cash Rental Rates and Land Values<br />

crop market prices, and input<br />

costs have a huge impact on the<br />

share percentages in a cropshare<br />

lease. Don’t just assume<br />

50/50, 60/40, or 1/3 / 2/3<br />

arrangements will work for<br />

your situation. Your situation<br />

may be different now and fine<br />

tuning may be needed.<br />

I strongly recommend putting<br />

leases in writing.<br />

Also, landlords need to<br />

remember that if you intend to<br />

remove a tenant from an oral<br />

lease, you need to do this in<br />

writing at least 30 days before<br />

March 1. Remember that 2012<br />

is a leap year, so 30 days prior<br />

to March 1 will be February 1,<br />

2012. I highly recommend not<br />

waiting until the last minute to<br />

issue an oral lease termination<br />

notice.<br />
