A popular question I get
asked several times a week is
what is land cash renting for, or
what is land in Marshall
County worth? Both are not
easy answers because primarily
the rental rates and land values
vary with the type, productivity
of the land(s) discussed, production
practices, and how
much someone wants the land.
When discussing cash rental
rates and land values, everything
is subject to negotiation.
Each landlord and tenant, or
land purchasing situation may
have different values.
Good communication
between landlord and tenant is
the key to having a successful
lease arrangement. Both par-
ties need to evaluate their contributions
in a share lease
arrangement, especially when
considering no-till and review
cash rental rates. Lately, I have
worked with landlords and tenants
who have not renegotiated
their leases for years. In one
case, when I was working with
a landlord and I asked what the
cash rental rate was for cropland
involved in the discussion
and the landlord’s cash rental
rate quoted was the average
cash rental rate in 1998. The
rent has not been adjusted for
13 years! Tenants and landlords
should at least be discussing
their leases every three
to five years.
Reviewing leases is not just
for cash leases. Crop-share
leases should at least be
reviewed every three to five
years, as well. Land values,
crop market prices, and input
costs have a huge impact on the
share percentages in a cropshare
lease. Don’t just assume
50/50, 60/40, or 1/3 / 2/3
arrangements will work for
your situation. Your situation
may be different now and fine
tuning may be needed.
I strongly recommend putting
leases in writing.
Also, landlords need to
remember that if you intend to
remove a tenant from an oral
lease, you need to do this in
writing at least 30 days before
March 1. Remember that 2012
is a leap year, so 30 days prior
to March 1 will be February 1,
2012. I highly recommend not
waiting until the last minute to
issue an oral lease termination
notice.
