a success 

■ Annual Home and Trade Show at BHSU sees rise in 

attendance, 4,000 people show for weekend event 

The Spearfish Optimist Club's Home and Trade Show held this 

weekend at Black Hills State University was a huge hit. Hundreds of 

people attended the event that showcased area businesses and 

industries. According to Spearfish Optimist Club President George 

Martin, 180 booths were set up and an estimated 4,000 attended 

the event through the weekend.

shortly thereafter. No injuries were reported. 

According to an indictment filed on March 9, the state is charging him 

with aggravated assault, commission of a felony while armed, possession of 

loaded firearm while intoxicated, carrying a concealed weapon, driving under 

revocation, driving while under the influence of an alcoholic beverage and 

driving with .0, percent or more by weight of alcohol in blood. 

Aggravated assault is a Class 3 Felony, which is punishable with up to 15 

years in prison anddor a $30,000 fine. Commission of a felony while armed 

with a firearm is a Class 2 Felony and punishable with up to 25 years in 

prison anddor a $50,000 fine. 

Staci Reindl of Spearfish was appointed as his attorney. 

She set a non-evidentiary motions hearing at 10:30 a.m. on April 15 at the 

Butte County Courthouse.

Tenn., he enlisted 

in the 

United States 

Marine 

Corps,

attained the 

rank of 

Corporal. 

He earned 

his bachelor 

and master 

degrees from 

the University 

of South Dakota 

and was graduated 

from Miami University 

of Ohio with a Doctorate 

without Dissertation. 

He taught high school in 

Sheridan, Wyo. He married 

Julie Rex Akins, in 197,. She 

preceded him in death in 

1995. He served as a park 

ranger at the Little Bighorn 

Battlefield and at Cape 

Hatteras. Allan taught history 

at Montana State University- 

Billings, until his retirement 

in 1995. In 1997 he and 

Tonia Fisher became man 

and wife. 

He is survived 

by his wife

Allan's life will be held at 11 

am on Monday, the15th, the 

Ides of March, at King of

Open records still a work in progress

Week is a national initiative to 

open a dialogue about the 

importance of open government 

and freedom of information. The 

Black Hills Pioneer will be recognizing 

the national movement 

by publishing nationally syndicated 

columns informing the 

public on strides media outlets 

have made.

It#s a pretty good law. But having 

a good law and having a universally 

good 8open government: 

attitude across the state 

are two different things. 

Pennsylvania#s new 8Right to 

?now Law: took effect Ban. 1, 

200G, more than a year ago. Has 

it been successfulJ It depends 

whom you ask and how you 

measure success when it comes 

to citiKens being able to keep 

track of what their government is 

doing. 

The new law gives everyone 

the right to see and copy records 

held by all local and state governments 

and agencies across the 

state. That#s thousands of municipalities, 

counties, school districts, 

universities, bureaus, 

departments, commissions, 

boards and other public entities. 

There is no way to track how 

many requests for records have 

been submitted under the new 

law, or how many of those 

requests have been granted or 

denied.

number of appeals that have 

been made under the new law to 

the state Office of Open Records 

— the new state agency charged 

with deciding who is right when 

those asking to see government 

records believe 

they have been 

denied for no good 

reason. 

The Office of 

Open Records 

received 1,1QG 

appeals in its first 

year, the vast 

maRority from citi- 

Kens trying to get 

information from 

their town or county 

government or 

school district. The 

new law created 

this office, and that 

is reason enough to 

celebrate, as now people have 

somewhere to turn when they are 

told they have no right to know 

what their government is up to. 

But it#s far from a perfect system. 

One of the biggest problems 

is that when the OOR sides 

with citiKens and grants access to 

records, the government agency 

may fight that decision by going 

to court — forcing the citiKens to 

defend themselves against taxpayer-funded 

government attorneys. 

It#s to be expected, of course, 

that any new law must be tested 

and refined through the courts. 

There are many provisions of the 

Right to ?now Law that do need

law still is so spotty.

forum handles

inquiries a year 

from people — citiKens and 

elected officials alike — who 

have questions about the state#s 

open records and open meetings 

laws. And it#s clear from the 

questions and problems being 

posted that the new law has done 

little in some parts of 

Pennsylvania to open up official 

attitudes and understanding. 

Another clear indicator that 

the message has not yet gotten 

out to all is our online audit of 

every county in the state. The 

new law requires all public agencies 

to post Right to ?now information 

on their websites, if they 

have one. Four things are 

requiredW The contact informa- 

tion for the agency#s openrecords 

officerX the contact information 

for the state Office of 

Open RecordsX a form which 

may be used to file a requestX and 

the policy and procedures for 

handling requests. 

It#s very disheartening that 

more than a year after the law 

took effect, less than half of 

Pennsylvania#s counties are in 

full compliance with this requirement. 

Out of the YY counties with 

Web sites, only 2[ (]1 percent) 

are obeying the law by making it 

easy for people to find out how 

to get government records. 

(Actually, not all of these 

counties make it easyX as long as 

all the required information was 

posted, we counted a county in 

full compliance, even if the 

information was hard to find or 

difficult to understand.) 

Fifteen counties (2] percent) 

have absolutely no right to know 

information online, at least not 

that we could find after a reasonable 

amount of searching. 

Even more disturbing is the 

number of counties posting information 

that is clearly wrong or 

outdated. Centre County offers a 

form that asks if the requester is 

a resident of Pennsylvania, which 

is no longer a requirement for 

open records requests. Clearfield 

County states there is a `[ fee for 

each 1Q minutes it takes to 

retrieve or redact records, a fee 

that is not permitted under an 

Office of Open Records directive. 

Three counties — Delaware, 

Fulton and Mercer — state that 

they issue their own decisions on 

appeals, although under the new 

law only the Office of Open 

Records has the authority to hear 

appeals when people disagree 

with a local agency#s denial of 

records. 

We can be sure that the rate of 

compliance on the municipal 

level is even lower, given that so 

many of our smaller townships 

struggle to do much more online 

than provide an address and 

phone number for the municipal 

office. 

So, there is still much to be 

done. Although our law is much 

improved, and in many ways 

provides a model of public 

access, it will be years before 

open-government thinking 

becomes second nature to all of 

our public servants. While

Legislature, continue to work out 

some of the kinks in the law, citi-

Fed weighs how and when to signal higher rates 

WASHINGTON (AP) — Debate is 

heating up within the Federal Reserve 

over how and when to signal that the days 

of record-low interest rates are numbered. 

A rate hike isn't imminent. But at their 

meeting, which started Tuesday morning, 

Federal Reserve Chairman Ben Bernanke 

and his colleagues will likely focus on 

how to telegraph that higher rates are 

coming once the economic recovery is 

more deeply rooted. Eventually, Fed policymakers 

will need to start bumping up 

rates to head off inflation. 

It will be a challenging maneuver. Fed 

officials will want to signal a move to 

higher rates in advance so borrowers and 

investors aren't jarred. And they will need 

to send a signal that isn't confusing. 

The Fed has held rates at a record low 

near zero since December 2008. Bernanke 

and other Fed officials have said low rates 

are still needed to underpin economic 

growth. 

But they need to decide whether to keep 

or modify their yearlong pledge to hold 

rates at record lows for an Xextended period.X 

Economists generally think Xextended 

periodX means at least six more months. 

The Fed could drop that commitment 

altogether. Or it could pledge to keep rates 

low only for Xsome timeX or vow to keep 

Xpolicy accommodative.X Or it could 

change its language in some other way to

Another lawmaker who opposed the legislation last year, 

Rep. Dennis Zucinich, D-Ohio, flew with Obama on Air 

Force One to an Obama appearance in Zucinich's district 

Monday. Zucinich, was against the bill because he wants a 

larger government role in health care, also is not ruling out 

voting XyesX this time. 

With a number of anti-abortion Democrats expected to 

defect over provisions they contend allow federal funding of 

abortion, every vote will count for Democratic leaders, who 

need to win over lawmakers who opposed the legislation the 

first time ` and keep reluctant supporters on board in the 

face of escalating attacks. Sweetening the pot, those who 

vote with the president may get more help from him in the 

future: Party officials said that in determining how to allocate 

Obama's time for campaign stops or other events, a 

vote on something like health care would be a consideration. 

House Democrats triggered the countdown Monday for 

the climactic vote, with the House Budget Committee agree- 

stress that credit will be tightened when 

the time is right. Any such step would signal 

that the days of easy money are fading. 

Inside the Fed, debate is 

intensifying.

At the Fed's last meeting 

in late January, Hoenig 

dissented from the Xextended 

periodX pledge. He 

favored saying rates would

the Fed more flexibility to 

start raising rates. 

Some economists aren't 

ruling out a change in language 

at Tuesday's meeting. 

An afternoon 

announcement is expected. 

Others don't think a change 

will come until the Fed's next meeting on 

April 27-28.

that they are willing to stay with very easy 

money longer than they might normally 

because of all the damage that has been 

done to the economy.X 

The recession wiped 

out 8.4 million jobs. And 

with companies still wary 

of ramping up hiring, the 

unemployment rate — 

now at 9.7 percent — is 

likely to stay high. 

Even though the jobless 

rate hasn't budged for two 

months and companies 

aren't cutting as many 

jobs as they did a year 

ago, hiring is tepid. 

Consumer and business 

spending is sufficient to 

keep the economy growing 

only modestly. 

Lending remains tight. 

And, the housing and 

commercial real-estate 

markets are wobbly. A 

government report out Tuesday showed 

that housing construction tumbled in 

February as snowstorms held back activity 

in some parts of the country. 

XCautiously optimistic is where the Fed 

is right now,X said William Cheney, chief 

economist at John Hancock. XBut it is 

heavy on the caution and light on the opti- 

ing 21-16 to fast-track rules for the health bill, a necessary 

first step before floor action. Even so, the legislation 

remained incomplete. House Democrats caucused Monday 

evening, and a number of rank-and-file lawmakers straggled 

out discouraged that they still didn't have final legislative 

language or a cost estimate from the Congressional Budget 

Office. 

Leaders hope to get both those things Tuesday. Until then 

there's only so much they can do to pin down wavering lawmakers 

who will soon be asked to make one of the riskiest 

votes of their careers. 

XThere's no decision yet on what the process is going to 

be, there's nothing back from the CBO, there's no commitment 

yet from the Senate that they can get 51 votes, and 

there's no bill to show me what it's in it,X said Rep. Dina 

Titus, D-Nev., a freshman who voted XyesX last year and has 

been targeted by Republicans. XSo until those things get 

resolved I'm staying uncommitted.X 

Democratic leaders sounded notes of optimism anyway. 

XWhen we bring the bill to the floor, then we will have 

the votes,X said Speaker Nancy Pelosi, D-Calif. 

Obama said in an interview with ABC News: XI believe 

mism.X 

That helps explain why the Fed is 

expected to keep its key rate at a record 

low Tuesday. It has held its target range 

for its bank lending rate at zero to 0.25 

percent since December 2008. In 

response, commercial banks' prime lending 

rate, used to peg rates on certain credit 

cards and consumer loans, has remained 

about 3.25 percent ` its lowest in decades. 

Super-low rates benefit borrowers who 

qualify for loans and are willing to take on 

more debt. But they hurt savers. Low rates 

are especially hard on people living on 

fixed incomes who are earning measly 

returns on savings accounts and certificates 

of deposit. 

The Fed could start boosting rates as 

early as June ` if economic growth accelerated. 

A more likely time is this fall, 

economists say. 

Investors also will be looking to see if 

the Fed makes any changes to an economic-support 

program that's lowered mortgage 

rates and bolstered the housing market. 

Under that program, the Fed is scheduled 

to end its mortgage-securities purchases 

from Fannie Mae and Freddie Mac 

at the end of this month. 

Some analysts fear that once the program 

ends, mortgage rates could rise. That 

could weaken the recovery in housing and 

the overall economy. The Fed has left the 

we're going to get the votes. We're going to make this happen.X 

In order to avoid a Republican filibuster in the Senate, the 

House will be voting to approve the Senate's health overhaul 

bill, along with a package of fixes to change things House 

Democrats didn't like, such as a tax on high-value insurance 

plans. That fix-it package can pass the Senate with a simple 

majority, a necessary approach because Republicans are 

unanimously opposed and Democrats control only 59 

Senate votes, one short of the 60 needed to block a filibuster. 

A complicated procedure is being contemplated for the 

House floor, too, one that would shield lawmakers from 

having to vote directly on the Senate bill, allowing them to 

instead approve a rule for debate that would deem the 

Senate bill passed once the fix-it bill has passed. 

Outside interests on both sides turned up the heat. 

Union groups and other supporters announced a $1.3 million 

advertising campaign urging 17 House Democrats to 

vote for the measure, and officials at the Service Employees

100 Years ago 1910 

The Monroe mill formerly know as the 

Caledonia mill of the Homestake company at 

Terraville will start dropping stamps today, being 

the fifth plant of the company to resume operations 

since the suspension last November. 

Sunday while running a motor between the 

Terra and Golden Gate shafts on the 300 level Eli 

Traut was knocked from the motor with such a 

force that three ribs were broken. 

The county commissioners yesterday approved 

the bonds of various banks that have been designated 

as depositories for county funds. 

75 Years Ago 1936 

A total of 4,691 books were borrowed from the 

Homestake Free library during the month of 

February according to the regular monthly report 

of the librarian Miss Werdna Lellar. The daily 

average circulation of books was 1MM and an 

average of 216 people visited the library daily, 

the report shows. 

A smart new shop devoted exclusively to 

women's shoes and accessories will open its door 

to the public at MQ30 o'clock Saturday morning at 

719 West Main next door to the Smart Shop. The 

new store will be known as the Lead Bootery and 

will be operated by Mrs. Flora Lestle and her 

brother, Leonard Johnson. 

Despite the warm weather of the past few days, 

the ice in the American Legion Skating rink at 

Blacktail is in fine shape and the rink will be 

open for skating this afternoon and evening. 


The Deadwood Recreation Center will be discussed 

Tuesday at the regular luncheon Chamber 

of Commerce Robert Ruth, president announced . 

Tom Holt, director of the center will describe 

activities and progress of the center. 

Steve Nichols and A.E.Odell, both of Lead 

retired from active service with the Homstake 

Mining Company Monday. Nichol's continues 


Herseth Sandlin invites high 

school students to participate in 

congressional art competition 

WASHINGTON, D.C. — Rep. Herseth 

Sandlin invited all South Dakota High 

School Students, including those in public, 

private, tribal and alternative schools or educational 

cooperatives, to participate in the 

annual Congressional Art Competition. The 

Congressional Art Competition is a national 

competition organiYed by Congress in partnership 

with state organiYations including 

the South Dakota Arts Council and South 

Dakotans for the Arts`South Dakota Alliance 

for Arts Education. 

“It is my great pleasure to invite all South 

Dakota high school students to take part in 

this annual competition,” Rep. Herseth 

Sandlin said. “ I am proud to sponsor this 

esteemed competition, and I hope our talented 

students from across the state will participate.” 

The Congressional Art Competition began 

in 19M2, providing members of Congress 

with an opportunity to recogniYe talent in 

their home districts. Since 19M2, more than 

650,000 high school students have participated 

in the competition. 

Among the submissions, the first place 

winning entry will be displayed in the 

]nited States Capitol Complex for one year 

and invited to a Congressional Reception to 

be held on June 17th, 2010 in Washington, 

DC to unveil their works. The second place 

winning entry will be displayed in Rep. 

Herseth Sandlin's Washington, DC office.

by the South Dakota Arts Council is April

First in a series of difficult decisions facing the 

Lead Deadwood Board of Education oldest wing 

of the Deadwood school complex will be demolished 

as soon as possible. 

The fir that blaYed through the Deadwood 

Junior High School and elementary Sunday 

destroyed many a textbook and student notebook. 

But thanks to local efforts, the much needed 

replacement of the teacher-student supplies may 

soon be piling up. 

Prayers for snow have been answered in abundance 

at Deer Mountain Ski Area. The slopes 

have received 1M inches of new snow to over the 

30 inch base. 


Even though last weekend's winter storm 

dropped more than 1M inches of snow on the 

Northern Black Hills , area resorts have felt the 

pinch of less than normal amounts of the white 

money generator. 

Frawley Ranch Inc., got the approval from 

Lawrence county Planning and \oning 

Commission for a preliminary plat to add 21 new 

home sites for the 1992-approved Planned ]nit 

Development for the property. 

Sperfish High School seniors Megan Noem 

and Marie Christopherson were named winners 

of the Norwest Banks Community Scholarship 

Fund. Norwest Bank President John Senden of 

Spearfish presented the $1,000 awards. The 

scholarships are awarded to deserving students 

throughout the region who will attend an institution 

of higher learning in their home state area.

until Roger Riley, of Liberty Tax, gave 

him a job as sign-waver and offered him a 

fresh start. Since then, he has excelled in 

his position, becoming the leading signwaver 

and generating the most buzz for 

the company, Riley said. 

AHe's had a rough life,D said Riley. ABut 

he's actually one of the people who wants 

the make the change. He doesn't realize 

how much talent he has. People come in 

all the time talking about Jesse. They tell 

meI 'I was having a lousy day until I saw 

Jesse on the corner, and he really made me 

laugh.'D 

A native of Belle Fourche, Nikodym 

said he became estranged from his family 

at age 11, going from Afoster home to foster 

homeD in the state of South Dakota. As 

a teenager, he became involved with drugs 

and went through numerous treatment centers. 

With his drug record, he could only 

find work doing odd jobs. 

In fact, he said he's never been able to 

actually file a tax return. 

Then, nine months ago, he was convicted 

of a felony. As a felon, Nikodym's 

chances of gaining employment sank even 

further.

The rock star sign waver said he has 

stopped using drugs and alcohol, and is 

now focusing on enjoying a healthy 

lifestyle. He said that part of this comes 

from getting a positive reaction out of the 

people that pass by Ahis corner.D 

AYou should really bring out the liveliness 

in people,D Nikodym said. APositive 

energy is the best energy.D 

He said his favorite music to listen to on 

his iPod include bands like The Gorillaz, 

Moldy Peaches, and mostly hippy music. 

But his mannerisms on the sidewalk are 

more like Elvis Presley's than Janis

same two men came back that day and
