• After the opening of <strong>Tender</strong>s:<br />

o If clarification is requested or if obvious clerical errors in the <strong>Tender</strong> need to be<br />

corrected, the Agency may contact the <strong>Tender</strong>er provided the terms of the <strong>Tender</strong><br />

are not modified as a result.<br />

1.7 Terms of payment - implementation of the Contract<br />

Payments shall be made in accordance with Articles I.3, I.5 & II.15 and II.16 of the model<br />

framework contract 15 . The schedule and the procedure for the approval of payments and the<br />

documents to be submitted will be defined separately for each order or specific contract (Article 4)<br />

depending on the nature of the tasks and duration of the contract.<br />

As a rule, payments for recurring services and Time & Means contracts will be carried out on a<br />

monthly basis. For contracts creating an obligation for the Contractor to provide deliverables the<br />

payment schedule, based on prior acceptance of deliverables by the Agency, will be defined in the<br />

specific contract. Requests for payment shall be admissible only where they are based on an<br />

invoice made in good and due form. Each invoice must include a detailed list of services covered<br />

by the invoice.<br />

<strong>ECHA</strong> reserves the right to pay less than the amount foreseen in the specific contracts according to<br />

tasks actually performed.<br />

Where foreseen by the relevant specific contract, expenditure incurred at the request of the Agency<br />

for travel outside the normal place of performance, will be reimbursed in accordance with Article<br />

II.18 of the draft framework contract.<br />

Services shall be provided on the basis of three different kinds of orders:<br />

1. Fixed Price orders, which correspond to the order of a defined work.<br />

2. Time & Means orders, which correspond to the order of a number of days performed.<br />

3. Quoted Time & Means orders which correspond to the order of a number of days for<br />

defined subtasks.<br />

The Agency specifies in the service request the work packages, deliverables, quality<br />

and security standards, delivery schedule and the place of execution.<br />

The work will normally be performed off-site, typically on Contractor’s premises. If<br />

required by the Agency, meetings and the presentation of the deliverables, and their<br />

acceptance process, may take place at the Agency’s premises.<br />

The contractor must present an offer meeting the requirements as specified in the<br />

service request and associated annexes, like the technical specifications. The offer<br />

must include the technical proposal and the list of staff members, and their CVs,<br />

proposed for the execution of the order. Contractor’s staff must match the profile<br />

descriptions as laid down in the Technical <strong>Specifications</strong> (Annex II) of the Framework<br />

Contract.<br />
