Dear Mr. Storm:<br />

This firm represents Best BUY Enterprise Services, Inc. (“Best Buy”) with respect to certain<br />

intellectual property matters. Best Buy is the owner by assignment of certain copyrights,<br />

including copyrights in and to the protectable material associated with Best Buy’s sales, the<br />

items for sale, and the sales prices.<br />

Today, Best Buy has learned that despite its advance notice to Fatwallet, you have allowed the<br />

posting of confidential and proprietary material regarding Best Buy’s sales for November 28,<br />

2003. Best Buy has a good faith belief that the material posted on your site is protected by<br />

copyright law, as well as a number of other laws. I have attached here a listing of messages that<br />

include Best Buy’s material protected by copyright and other laws. This letter is to advise<br />

Fatwallet that Best Buy objects to the posting of these materials, as doing so violates Best Buy’s<br />

copyrights, and potentially other rights.<br />

More specifically and pursuant to 17 U.S.C. tj 512(c), Fatwallet is notified that postings<br />

regarding Best Buy’s sales on November 28, 2003 include content that is alleged to infringe<br />

upon Best BUY’S copyrights. Best BLIY has a good faith belief that the posting, publication, and<br />

dissemination of the material on or in these posts infringes upon Best Buy’s copyrights, and is<br />

not authorized by Best Buy. Further, the information in this notice is accurate, and under penalty<br />

(1) A party or an attorney responsible for the issuance and service of a<br />

expense on a person subject to that subpoena. The court on behalf of which the<br />

subpoena was issued shall enforce this duty and impose upon the party or<br />

attorney in breach of this duty an appropriate sanction, which may include, but<br />

(2)(A) A person commanded to produce and permit inspection and<br />

copying of designated books, papers, documents or tangible things, or inspection<br />

of premises need not appear in person at the place of production or inspection<br />

unless commanded to appear for deposition, hearing or trial.<br />

(6) Subject to paragraph (d)(2) of this rule, a person commanded<br />

to produce and permit inspection and copying may, within 14 days after service<br />

of Ihe subpoena or before the time specified for compliance if such time is less<br />

than 14 days after service. serve upon the party or attorney designated in the<br />

subpoena written objection to inspection or copying of any or all of the<br />

designaled materials or of the premises If objection is made, the party serving<br />

the subpoena shall not be entitled to inspect and copy the materials or inspect<br />

the premises except pursuant to an order of the court by which the subpoena<br />

was issued. If objection has been made, the party serving the subpoena may,<br />

upon notice lo the person commanded to produce, move at any time for an order<br />

be otherwise met without undue hardship and assures that the person lo<br />

whom the subpoena is addressed will be reasonably compensated, the<br />

court may order appearance or production only upon specified conditions<br />

DUTIES IN RESPONDING TO SUBPOENA.<br />

(1) A person responding to a subpoena to produce documenls shall<br />

produce them as they are kepl in the usual course of business or shall organize<br />

and label them to correspond with the categories in the demand<br />

(2) When information subject to a subpoena is withheld on a claim that<br />

it is privileged or subject to protection as trial preparation materials. the claim<br />

shall be made expressly and shall be supported by a description of the naiure of<br />

the documenls. communications, or things not produced that is sufficient to<br />

enable the demanding party to contest the claim


EXHIBIT A TO SUBPOENA<br />

1. Produce pursuant to the subpoena documents sufficient to identify any persons<br />

who posted messages identifying or discussing the items to be offered for sale, or<br />

the prices of the items to be offered for sale, by Best Buy on November 28, 2003.<br />

Such postings are identified in the listing attached to a letter dated November 14,<br />

2003 and sent to your attention.<br />

2. The documents requested in this subpoena may be produced in paper or electronic<br />
