flooded during the flood event 2002. In addition, there is an atlas on flood hazards in Saxony that also<br />
includes maps on damage potentials.<br />
2.5 France<br />
2.5.1 The legal framework for flood <strong>management</strong> <strong>and</strong> emergencies<br />
French legislation concerning natural hazards mitigation <strong>and</strong> <strong>management</strong> has developed over the last<br />
20 years. The key legislation is detailed in the sections below.<br />
Law on the compensation of natural hazards victims, 1982 4<br />
The 82-600 law on the compensation of the victims of natural hazards introduced a hybrid system of<br />
compensation based on private insurance. It aimed to formalise the principle of national solidarity<br />
concerning natural hazards written down in the French Constitution. Each citizen has an obligation to<br />
be insured against natural hazards. This insurance is incorporated within their household insurance.<br />
The same proportion of the total household insurance amount is allocated to the natural hazard<br />
insurance system (15% at the moment), independently of the level of exposure of the house to natural<br />
hazards. The system is only activated if the state administrations declare an event as “an exceptional<br />
natural hazard”, typically the return period of the considered event must exceed 1 in 10 years. The<br />
damage caused by lower return period events are not insured.<br />
A new l<strong>and</strong> use regulation tool was introduced by the 1982 law to complement this insurance system,<br />
to limit new urban extensions in exposed areas: the plan d’exposition aux risques PER (risks<br />
exposition plan). According to the estimated hazards <strong>and</strong> their magnitude, these plans delimit red<br />
areas where no new constructions are permitted <strong>and</strong> blue areas where constraints concerning the<br />
constructions can be imposed. This limit on development in exposed areas is the major tool of the<br />
French natural hazard mitigation policy.<br />
Law on the organisation of rescue services 5 , 1987<br />
This law set up the strategic organisation of the rescue operations described below, <strong>and</strong> introduced a<br />
new <strong>management</strong> reference document: the ORSEC plan (organisation des secours, Rescue<br />
organisation). This document defines the rescue procedures <strong>and</strong> lists the available public <strong>and</strong> private<br />
means <strong>and</strong> the conditions for their use. This law also affirmed the need of the raising public<br />
awareness <strong>and</strong> the creation of a risk analysis <strong>and</strong> preventive information cell in each department<br />
prefecture (Cellule d’analyse du risque et d’information preventive; CARIP).<br />
Law on the prevention of technological <strong>and</strong> natural catastrophes, 2003 6<br />
This law led to changes in the French flood forecasting system. It also reaffirmed the necessity to<br />
raise the population risk awareness. It placed an obligation on mayors to regularly inform the<br />
population about the existing risks, the prevention measures <strong>and</strong> the risk <strong>management</strong> procedures, <strong>and</strong><br />
the obligation to make an inventory of existing flood level indications of previous major floods <strong>and</strong><br />
mark these levels on a permanent support.<br />
