Roof hooks<br />
1<br />
Slate-/shingle roof hooks have been developed especially for use<br />
on slate or shingle roofs and are screwed through the formwork to the<br />
rafter. Depending on the type of roof cladding, ALTEC Solartechnik AG<br />
offers two variants:<br />
Short shingle roof hooks<br />
Two 8 x 100 mm flat-head woodscrews are required to attach the hook.<br />
Due to their flat head they are easier to glue. You can glue EPDM strip<br />
between the roofing and the bracket or sealing in the roof hooks with<br />
bitumen.<br />
Long slate roof hooks<br />
These are used to secure larger slate tiles. 7 mm diameter holes are<br />
provided and designed for the use of three 6 x 80 counter sunk woodscrews<br />
. Slate roofs require an additional cover plate or flashing. This<br />
replaces the slate at the location of the roof hook.<br />

This plate replaces the slate at the location of the roof hook and is<br />
fixed with two 4 x 25 mm screws (item No: 4ASIV0204025). The slate<br />
roof hooks are then secured with three woodscrews through the formwork<br />
into the. The overlying slate is held at the required height by the<br />
upward-curving edge of the cover plate. It is recommended to apply an<br />
expansion strip (see page 16) between the plate and the slate.<br />
Plain tile roof hooks are designed especially for use on roofs with<br />
plain tile roof tiles and are attached directly to the battens with two<br />
M8 x 100 mm flat head screws or two M8 x 100 mm hex head wood<br />
screws. Rafter spacing should be between 16.5 and 36 cm. Since the<br />
lengthwise protruding bracket of the plain tile roof hooks rests on the<br />
tiles beneath, we recommend replacing the clay tile with a metal tile.<br />
Please contact us with regard to crown tiles so that we can match the<br />
material to the roofing.<br />

To enable correct mounting of the roof hooks we advise the use of<br />
a metal tile. This prevents the lower tile being crushed by the load.<br />
Because the clay tile does not neet to be cut out, installation is<br />
greatly simplified. The metal tile is cut to standard size and is fixed<br />
to the rafter with two screws (Item no: 4ASIV0204025). Alternatively,<br />
with crown tiles, it is hung to the tile beneath. The resulting space is<br />
sealed with an expansion strip.<br />

Pantile roof hooks<br />
Pantile roof hooks have been specially designed for use on pantile roofs<br />
and are screwed directly onto the rafters with two or three flat head<br />
screws M8 (depending on load). The following roof hooks are used as<br />
standard for our mounting systems:<br />
• Base plate 180 x 80 x 4 made from stainless steel 1.4016<br />
• Bracket made from stainless steel 1.4301 (30 x 5, 35 x 6, 40 x 6)<br />
• with an overall height of 130 mm and a 9 mm slot<br />
Pantile roof hooks with a height of 40 mm are used with a batten height<br />
of 24 mm and roof hooks with a height of 45 mm are used with a batten<br />
height of 30 mm. For a batten height of 40 mm we suggest rafter shim<br />
of 10 mm.<br />

These are used to fix to I-beams so that their load bearing capacity is not<br />
weakened by extra drilling. The assembly is only possible when the roof<br />
elements are not fully in contact with the beam. These clamps are manufactured<br />
to requirements for each individual beam type whose measurements<br />
are captured on the check list. Available in sizes up to M16.<br />
Trapezoidal shoe<br />
Only the upper part of the trapezoidal metal shoe is different to account<br />
for the system fastenings whilst the base remains the same. These<br />
shoes are made from folded stainless steel and are fixed to the<br />
mounting components with hammer head bolts and/or locking nuts.<br />
Depending on the shoe, they can carry profile rails or elevation angles.<br />
They are fixed into the corrugated metal with four 25 mm stainless<br />
steel drilling screws. You must check on site that the load can be carried<br />
or, if they are sandwich panels, the anchoring of the layers. The<br />
number of trapezoidal shoes required is calculated during the design<br />
of the complete system. The distance between the individual shoes<br />
should be between 600 to 900 mm, but depends on the distance of the<br />
corrugations. The required minimum sheet thickness (steel 0.65 mm,<br />
Aluminium 0.8 mm) of the roofing for the screws has to be complied<br />
with. We recommend 2 mm EPDM tape as sealant. To fit the shoes<br />
optimally to the corrugated metal sheet, measurements are required<br />
(you can complete the check list on page 97). We will then manufacture<br />
a sample which will be sent to you for approval. After receipt of the<br />
approval, we will manufacture and deliver the trapezoidal shoes.<br />

Module mounting parts for framed modules<br />
Module clamping angles and/or end clamps made from aluminium or<br />
stainless steel are fitted at the end of each module row. Sizes vary to fit<br />
the thickness of the module frame. We can also offer powder-coated or<br />
anodised clamps in your preferred system colour. The end/mid-clamp<br />
with shear off long nut also serves as effective theft prevention<br />
because the upper part of the nut is removed after the final tightening<br />
and the screw cannot be removed with conventional methods.<br />
Module clamping plates and/or mid clamps are fitted between two<br />
adjacent modules. The threaded plate, optional in size M6 or M8, is<br />
similar in shape to the head of a hammer-head bolt and is fixed to the<br />
screw. To guarantee the optimum hold of the threaded plate, it must<br />
be screwed at 90° to the profile. The distance between the modules is<br />
determined by the size of the clamp.<br />

Anti-slip safety clamping angles and/or end clamps are used for the<br />
assembly of horizontal modules to prevent the end clamps slipping<br />
along the profile rail. The clamp is provided with a screw 10 mm longer<br />
screw. This pierces the rail when the nut is tightened and prevents the<br />
clamp slipping.<br />
In addition we offer a black anodised standard range which visually<br />
matches the module frame. Likewise we are able to match the colour of<br />
clamps to your system and/or roofing by anodising or powder coating them.<br />

project. We simply need to know the roof pitch and the angle of elevation<br />
you require to hold the module. It is also important to determine the<br />
location of the drilled holes for the profile. In order to position these<br />
precisely, please use the prepared check list in the <strong>catalog</strong>ue (see<br />
page 92). The parts are delivered individually and are fixed together on<br />
site. Pre-assembled elevation angles are available at additional cost.<br />
The dimensions and design of the elevation angle must be calculated<br />
with the local conditions and static load in mind.<br />

In addition to the ususal mounting systems and single components,<br />
we also offer all requisite DIN- and standard parts for fastening. These<br />
high-quality products are made of stainless steel from well known<br />
manufacturers. Therefore all these elements are corrosion and acid<br />
resistant. Over time a range of alloys has been developed, each with<br />
ideal characteristics for specific applications. These alloys have one<br />
common feature: due to the chrome contained in the alloy they all<br />
require no additional surface protection. The mounting system parts<br />
under this section comply with a DIN norm for the purposes of standardisation.<br />
The standard in this case defines a least one of the following<br />

Pitched roof systems ALSD<br />
On roof systems<br />
We offer you a photovoltaic mounting system for pitched roof. The photovoltaic modules are mounted on an aluminium<br />
frame above the existing roof which is practically un-touched by the mounting operation and will remain<br />
fully watertight. Rear ventilation of the modules is also ensured by on-roof mounting, which has a positive influence<br />
on the energy yield. The frame can also be used for mounting on pitched roofs with different roof claddings. The<br />
complete system comprises roof mounting elements (i.e. roof hooks, roofing felt clamps, hanger bolts, trapezoidal<br />
shoes etc.), the aluminium-profile rails, stainless steel connecting elements and clamps to fix the modules to the<br />
profile rails. The choice of mounting depends on the type of roofing, the quality of the substructure of the roof which<br />
will carry the load, the load-bearing capacity of the roof and the roof pitch.<br />
Roof parallel mouting systems<br />
Vertically mounted modules<br />
The picture shows a simple substructure on horizontal profile rails.<br />
Hammer-head screws connect the aluminium-profile rails to the roof hooks<br />
used. Threaded plate, clamping plate and washer are pre-assembled on<br />
the profile rail. Two modules are attached to each aluminium profile using<br />
two aluminium clamping plates and each module row is secured at the<br />
end with a clamping angle. The process is repeated for each additional<br />
row. Plastic slip protection is used to secure the modules.<br />
Horizontally mounted modules<br />
Substructures for horizontally mounted modules are often preferred for<br />
engineering purposes. Assembly is onto vertically mounted profile rails.<br />
Modules are fixed between the individual module rows with clamping<br />
plates. To secure the modules against slipping, anti-slip clamping angles<br />
are fixed to the profiles.<br />

Cross-connection system<br />
A cross-connection system with vertical and horizontal profiles can be<br />
used to create a cruciform structure which has two advantages. It provides<br />
an extra rigid base for the mounting system that is therefore resistant to<br />
higher loads. It also enables the landscape installation of modules on<br />
rafter supported roofs that means the optimum use of the roof space can<br />
be achieved.<br />
Elevated mounting systems<br />
Elevated angle mounting system<br />
Elevated angle frames are mounted to flat roofs to ensure the modules are<br />
at the correct angle. The elevation angles are made from aluminium and<br />
are fixed to the roof fasteners. The profile rails are fixed to the elevation<br />
angles with hammerhead screws. For horizontal mounting of modules we<br />
offer a separate clamp.<br />

Pitched roof systems ALSD<br />
Roof integrated systems<br />
The innovative ALINTEGRAT from ALTEC Solartechnik AG is a mounting system which is integrated into the roof itself.<br />
It is perfect for new builds as well as roof renovations. The modules are embedded into the roof cladding and are<br />
almost perfectly integrated into the overall appearance of the roof. A further advantage is that roof integration is<br />
very cost-effective because the roofing is replaced by the modules. Another advantage of the system is that it has<br />
far less area exposed to wind and weather.<br />

The modules can be attached vertically or horizontally. The<br />
system combines tried and tested components of the ALTEC<br />
system with roof-sealing and integrating elements as well as<br />
connecting elements made of stainless steel. The primary<br />
components of the mounting system are aluminium sheets<br />
which are screwed to the roofing battens. These form support<br />
tray to hold the rest of the components. All fixing materials are<br />
included in the pre-assembled mounting system (see Figures 1<br />
and 2). We also provide you with materials for final sealing of<br />
the system along with assembly instructions. Since the sheet<br />
metal is divided into vertical sections, each part creates a<br />
ventilation which cools the module and therefore has a positive<br />
effect on the system yield.<br />

Flat roof systems ALFLACH<br />
ALFLACH is a mounting system that allows elevated mounting of PV systems onto flat roofs with the aid of ballast.<br />
The elevation is ballasted with weight and so offers extreme stability. It enables simple and quick assembly of photovoltaic<br />
systems on flat roofs with a maximum roof pitch of 5°. The load-bearing capacity of the roof must be checked<br />
by the customer beforehand because the weight of the system adds stress to the roof construction. The delivery<br />

hold the ballast. The ballasting material is not included in the delivery. The required ballast weight for your individual<br />
system is calculated taking into account all relevant static data. To optimise efficiency throughout the year, a module<br />
tilt of approximately 30° is recommended. This can be achieved using universal triangular structures made of<br />
aluminium L profiles which are screwed together or can be provided pre-welded. The modules can then be mounted<br />
vertically or horizontally according to manufacturer's instructions.<br />
Ballast free mounting systems<br />
Non-weighted gluing system<br />
This elevation can be fixed to almost all foil and bitumen roofs without<br />
ballasting. The rails are fixed directly to the roof with special laminate<br />
pointing (Widocryl-Point). The roof covering has to be sufficiently fixed<br />
to the load carrying frame. The installers must be certified before<br />
commencement.<br />
Ballasted mounting systems<br />
Concrete block ballasting<br />
The elevation angles are fixed to concrete blocks with anchors or dowel<br />
screws. You have the option to set the base angle to sit directly down to<br />
the concrete or to be locked with a nut to the anchor bolt.<br />
Edging stone ballasting<br />
If edging stones are used to weigh down the system, these are put<br />
directly onto the arms of the aluminium T-profile. The minimum distance<br />
between the angles must be 1025 mm. You should put building protection<br />
mats under the elevation angles to protect the roofing and prevent<br />
indentations.<br />

Gravel ballast<br />
To ballast a system with gravel, fix the elevation angles to corrugated<br />
plastic trays with hex head screws. The backfill with gravel can then<br />
occur with new or existing roof gravel.<br />
Bulk material ballast<br />
If the gravel ballasting is limited to the photovoltaic area, then aluminium<br />
trays with welded elevation angles are used. These trays are connected<br />
with profile rails. The required ballast depends on the tray distance.<br />

Ground level systems ALFREI<br />
The ALFREI mounting system has been designed specifically as a ground mounted PV system for open areas. It<br />
holds most commercial modules in one or more rows, horizontally or vertically. The use of high quality materials<br />
allows for maximum stability and longevity of the frame. The angle of the modules can be adjusted to optimise the<br />
use of the sun’s energy and the local conditions.<br />
The system is available in various options to fit the local ground conditions. The mounting frame consists of<br />
aluminium profile rails in all options and comes with fasteners such as cross connectors, rail connectors and module<br />
clamps which can be fixed quickly. The supporting system technology depends on the local conditions. However,<br />
whether it is a steel tubing system or aluminium frame, every option is manufactured to the highest demands.<br />

One pillar system<br />
Pile foundation system ALFREI_RAMM<br />
Pile foundations are used for this one pillar system.<br />
This optimises longevity, material use and assembly<br />
effort. The frame is connected with a prop head suitable<br />
for the occurring forces. To enable fastening to existing<br />
concrete surfaces, such as airports or barracks, we<br />
can offer a new solution, the pile foundation system<br />
for concrete (ALFREI_RAMM_BF). This can also be used<br />
on ground where pile foundations are not suitable. We<br />
also offer a system with two piles (ALFREI_RAMM_2P)<br />
which allows for maximum yield in small places.<br />

Two pillar systems<br />
Steel tubing system ALFREI_ST<br />
This system is suitable for high loads due to its steel tubing<br />
construction. Cross beams and diagonal struts make<br />
the structure rigid against side forces, especially from<br />
wind. In addition the system is height adjustable which<br />
allows for assembly on uneven ground. The steel tubing<br />
system with screw foundation (ALFREI_ST_DF) is the<br />
best solution for sandy and gravelly soil. The mounting<br />
occurs therefore on established screw foundations. The<br />
steel tubing for concrete (ALFREI_ST_BF) is ideal through<br />
optimum material use. The foundation is either concrete<br />
strips or existing concrete slab fulfil the static requirements.<br />
Aluminium profile rail system ALFREI_AL<br />
This system combines the various advantages of ALFREI<br />
with a reduced assembly effort and a minimum number<br />
of required system parts. The piles and struts are<br />
aluminium profiles as are the carriage and assembly profile<br />
rails. A pre-assembled prop head angle allows for an<br />
efficient fixing of the alu-profile rail system with screw<br />
foundation (ALFREI_AL_DF). Robust stainless steel base<br />
plates are used to fix the frame to the screw foundation.<br />
The aluminium profile system (ALFREI_AL_BF) can als be<br />
attached to concrete strip foundations or exisiting<br />
concrete flooring.<br />

Aluminium angle system ALFREI_WK<br />
This system uses an assembly type similar to the flat roof<br />
system ALFLACH. It consists of aluminium angles and<br />
generally is distinguished by not having a continuous<br />
elementary angle. The foundation is either concrete<br />
strips or existing concrete flooring. Other foundation<br />
options are also available.<br />

Mast systems ALMAST<br />
ALMAST is a mounting system where any commercially available photovoltaic modules are attached to a mast.<br />
They are designed individually to your requirements and on-site conditions, so you can orientate the top of the<br />
mast in the desired direction on assembly. A variable mast-head also permits an angle of adjustment of approx.<br />
30° (Fig. 3). A simpler, and therefore more cost effective option, is the fixed masthead in which the angle of<br />
adjustment is fixed at the point of manufacture (Fig. 1). Additional options for mounting modules onto the mast<br />
such as cantilever (Fig. 2.1) or suspension (Fig. 2.2) are available.<br />

Mast<br />
All our masts are supplied in hot dip galvanised steel. Customers may then choose between an economical mast<br />
with socket foundation (Fig. 5) or a mast in an individual foundation using heavy duty anchor bolts (Fig. 6).<br />
There are three mast options (Fig. 7):<br />

Awning systems ALMARK<br />
ALMARK is a frame that can carry all commercially available photovoltaic modules as an awning. The standard system<br />
comprises of tubular frames whose lengths can be adjusted according to the module dimensions. On customer<br />
request we can vary the module angle, the colour and design detail. This mounting system can also be combined<br />
with all ALTEC Solartchnik AG mounting systems. We require precise wall and structural engineering information in<br />
order to determine the most suitable wall attachment method.<br />
Tubular frame elements and profile rails<br />
This version simplifies fitting modules of<br />
different sizes because two aluminium<br />
profile rails are screwed to the tubular<br />
frame elements. Direct attachment is<br />
carried out using clamping brackets and<br />
clamping plates in the module frame.<br />
With L-brackets<br />
This underconstruction comprises of<br />
aluminium L-profiles. In this case the<br />
individual elements are welded or bolted.<br />
The modules are attached as described<br />
above. Diagonal reinforcement is attached<br />
at either end of the row. It is attached to<br />
the profile and guarantees the stability of<br />

It is designed to accept 15 photovoltaic modules. The corrugated<br />
sheet substructure means the system is robust and fully<br />
integrated. To optimise the yield of the photovoltaic system,<br />
the pitch of the roof can be varied between 10°, 14° and 18°.<br />
An angle of 12° or more initiates a self-cleaning effect of the<br />
modules.<br />
A range of modules can be used with the DESIGN SolarCarport<br />
which can be attached using ALTEC Solartechnik mounting<br />
systems. The carport is quick and easy to assemble and can<br />
be expanded into a multi carport with ease. The galvanised<br />
steel structure with a supporting roof frame made of aluminium<br />
profiles guarantees high static safety.<br />
The carport can be purchased separately or with modules and<br />
power inverters. On request we can also supply other accessories<br />
separately, e.g. charging stations. On customer request, the<br />
supports and parapet can be powder coated in RAL colours.<br />

design – that is our innovative SolarCarport BASIC.<br />
It is fitted as standard with 15 photovoltaic modules. The<br />
corrugated sheet substructure means the system is classed as<br />

is achieved. An extension to a multi carport is easily possibly.<br />

Sales and delivery conditions<br />

1. Scope of application<br />
These terms of business apply for all contracts, supplies and other services between ALTEC<br />
Solartechnik AG and other companies. They apply equally to future transactions even if not<br />
referred to specifically hereafter. Contractors, as defined for these terms of business, are<br />
natural or legal entities or legal business partnerships conducting business on their own or<br />
with others, with whom a business relationship is entered into. Contradictory provisions or<br />
provisions differing from these general terms and conditions shall not be recognised and<br />
will not be accepted. They shall apply in exceptional circumstances, however only if written<br />
consent has been given.<br />
2. Effectiveness of the contract and the written form<br />
Our offers are subject to confirmation. We reserve the right to make changes as a result<br />
of technical developments. The documents pertaining to the offer such as illustrations,<br />
drawings, weights and measures are provided for guidance only unless they are expressly<br />
specified as binding. We cannot be held liable for their accuracy. We reserve ownership and<br />
copyright of cost proposals, drawings and other documentation. These shall not be disclosed<br />
to third parties without our express permission. The representation of products in the <strong>catalog</strong>ue<br />
or on the internet shop does not represent a binding offer on conclusion of a purchase<br />
contract. The customer is simply asked to submit an order. The submission of the order<br />
is a binding offer by the customer to conclude a purchase contract for the goods ordered.<br />
The contract becomes only effective when we send an order confirmation no later than two<br />
weeks after the purchase order has been received or by delivering the goods ordered. Legally<br />
relevant declarations and notifications (for example setting a deadline, reports of deficiencies,<br />
letter of order cancellation or change) must be submitted in writing by the customer.<br />
Commitments from representatives or auxiliary agents of the vendor are only binding when<br />
the vendor has issued written confirmation.<br />
our discretion. The customer shall allow the vendor the necessary time and opportunity to<br />
do this. Replaced parts become our property. If the customer has failed to meet his contract<br />
obligations we not obliged to replace or to rectify goods. If our operation or maintenance<br />
instructions are not followed, products are altered, parts replaced or consumables are<br />
used which do not comply with the original specifications, all claims for damages are void.<br />
That is unless the customer can disapprove the assumption that in this case one of these<br />
circumstances led to the defect. Damages due to transport, improper handling, inadequate<br />
maintenance or misuse are not covered by this warranty. The warranty period for new goods<br />
is one year from delivery of the goods. No warranty period applies on second hand products.<br />
For mainly third-party produced goods the liability of the vendor is limited to transferring<br />
the liability claims against the vendor of the third-party product.<br />
7. Other liability<br />
Unless otherwise indicated in these general business terms and conditions including the<br />
following provisions, we are liable for breach of primary or secondary duties according to<br />
the local legal directives. We are liable for damage and compensation in the case of intent<br />
and gross negligence – irrespective of the legal position. In the case of negligence we are<br />
only liable a) for loss or damage as a result of death, bodily injury or impairment of health,<br />
b) for damage from the breach of a substantial contract duty (duty whose fulfilment is<br />
essential for the proper fulfilment of the contract and on the compliance with which the<br />
contract partner regularly relies and may rely). In this case our liability is however limited<br />
to replacement of the anticipated typically occuring damage. The aforementioned liability<br />
limitations do not apply if we deliberately conceal a defect or have offered a guarantee for<br />
the quality of the goods. Where our liability is excluded or limited, this also applies to our<br />
employees, representatives and agents.<br />
8. Retention of title<br />
3. Delivery<br />
Delivery times are non-binding unless the vendor has made a specific commitment in writing.<br />
The commencement of the specified delivery period is dependent on the prompt and proper<br />
fulfilment of the obligations of the customer. The right to object to non-performance of the<br />
contract is reserved. The delivery deadline shall be considered as having been met if the<br />
goods have left the factory or dispatch readiness has been advised. If we are unable to<br />
meet binding delivery dates for reasons for which we are not responsible (non-availability<br />
of goods) we shall notify the customer and advise an anticipated new delivery date at the<br />
same time. If the goods are not available within the new delivery period we are entitled to<br />
withdraw wholly or partly from the contract. Any payments made by the customer shall be<br />
refunded immediately. Reasons for non-availability of the goods for this purpose include<br />
cases of force majeure, strike, operational interruptions or transport difficulties. The same<br />
applies if these circumstances arise for sub-contractors. The customer is not entitled to<br />
claim for damages in the event of such a withdrawal. If the customer suffers damages due<br />
to a delay for which the vendor is responsible, the customer is entitled to claim for damages<br />
resulting from delay to the exclusion of further claims. For every full week of the delay this<br />
amounts to 0.5% of the amount up a maximum 5% the value of that part of the overall delivery<br />
which cannot be used promptly or cannot be used in accordance with the contract due to<br />
the delay. If dispatch is delayed at the request of the customer the costs of storage shall be<br />
charged to the customer starting one month after the notification of readiness for dispatch,<br />
in the case of storage on the vendor's premises however at least 0.5% of the invoice amount<br />
for each month. If the deadline is not met however the vendor is entitled to obtain the object<br />
of the delivery by other means and to deliver to the customer by an appropriately extended<br />
deadline. The vendor is entitled to refuse the delivery until payment owed by the customer<br />
have been paid or are guaranteed if, as a result of commercial difficulties on the part of the<br />
customer there is justifiable concern that payment for the delivery will not be received or will<br />
be considerably delayed. Partial deliveries are admissible.<br />
4. Prices and payment<br />
Prices are, in the absence of special agreements, ex-works including loading at the factory<br />
but excluding packaging. Prices are subject to VAT at the current rate. The vendor shall issue<br />
the invoice on notification of the readiness for dispatch of the goods. Invoice amounts without<br />
deduction shall be paid within 8 days of the invoice date. The deadline is considered met<br />
when the money is received by the vendor. If the customer defaults on payment we are<br />
entitled to charge interest from the respective date at a rate of 8% above the base rate as<br />
a flat compensation rate. We are permitted to produce evidence for a claim for additional<br />
damages, notwithstanding any regulations to the contrary. If further damages are incurred,<br />
we are entitled to claim these. The customer may only offset with counterclaims which are<br />
legally justified, undisputed or recognized by us. The customer is entitled to exercise right of<br />
retention only in so far as the counterclaim relates to the same contract relationship. We are<br />
entitled irrespective of other provisions to use payments of the customer initially to settle<br />
earlier debts. If costs and interest already apply we are entitled to use payment to cover the<br />
costs initially, then the interest and finally the goods themselves.<br />
5. Transfer of risk<br />
On leaving the warehouse or notification of readiness to dispatch, the risk of loss or deterioration<br />
of the goods transfers to the customer. This also applies to partial deliveries or if the<br />
vendor has accepted additional services. We shall insure against breakage, theft etc. only at<br />
the request and cost of the customer. Otherwise insurance of the goods is the responsibility<br />
of the customer. Delivered goods, even if they exhibit minor flaws, shall be accepted by the<br />
customer irrespective of rights from articles 6 and 7.<br />
6. Warranty<br />
The customer is obliged to check the goods upon receipt and to notify us immediately in<br />
writing with any complaints. The deadline for the assertion of claims for defects is no more<br />
than one week after delivery of the product. Defects which cannot be detected within this<br />
deadline despite careful examination shall be reported to us in writing immediately on<br />
discovery. In the event of defect goods we shall offer either remedial work or replacement at<br />
All goods remain our property until all obligations arising from the commercial relationship<br />
of whatever type, have been met. The same also applies for subsequent claims resulting<br />
from repairs, replacement and optional accessory deliveries. The customer is entitled to<br />
sell or process goods subject to the retention of title in properly arranged commercial<br />
transactions. In these cases the retention of title also extends to the processed, mixed<br />
or connected goods to existing products at their full value wherein we apply as the manufacturer.<br />
In the event of processing, mixing or connecting with third-party goods for which<br />
ownership rights exist, we shall acquire joint ownership in proportion to the invoice values<br />
of the processed, mixed or connected goods. Otherwise the same applies to the resulting<br />
products as for the goods supplied under retention of title. At this point the customer shall<br />
transfer security claims against third parties resulting from the further sale of goods and of<br />
the product wholly and/or to the amount of co-ownership proportion to us in accordance<br />
with the last paragraph. We shall accept the transfer. The customer is entitled to recover<br />
the debt alongside us. We are obliged not to recover the debt if the customer meets its<br />
payment obligations to us, does not fall into arrears, has not filed for insolvency and whose<br />
credit rating is intact. Should this become the case we can insist that the buyer discloses<br />
the transferred claims and its debtors, provide all necessary details for collection, hand<br />
over the associated documents and immediately inform the debtors (third parties) of the<br />
transfer. If the realisable value of the securities exceeds our receivables by more than 10%<br />
we may release the securities on request of the customer. While our retention of title exists,<br />
hire, seizure or similar transfer of the goods to a third party is not permissible without our<br />
written consent. In the event of intervention of the customper’s creditors, particularly in<br />
the case of seizure of the goods, the customer shall write to us immediately and pay the<br />
costs of any measures to remedy the intervention, particularly of intervention processes if<br />
they cannot be recovered by the other party. To secure our claims the customer guarantees<br />
us the right to visit its operating areas during normal business hours and to examine the<br />
necessary business papers with regard to securing our claims.<br />
9. Order cancellation/ return or replacement of goods<br />
The consent of the vendor is generally required for cancellation of an order after legal contract<br />
conclusion and/or replacement of goods after execution of the transaction. There is no<br />
legal entitlement to this. In the case of cancellation of an order with our consent the customer<br />
is obliged to repay all costs incurred by the vendor in confidence of a normal conclusion up<br />
until this time. The assertion of compensation claims and/or lost profit minus any saved<br />
costs are unaffected by the previous rule. In the case of replacement and / or return of the<br />
goods, the return shipment to the registered office of the vendor shall take place at the cost<br />
and risk of the customer. In the case of replacement or return of the goods, irrespective of<br />
further claims of the customer, a fixed restocking fee of 10 % of the eventual credit amount<br />
shall be charged. The vendor is entitled to deduct the corresponding amount immediately<br />
with the issue of a credit note.<br />
10. Data protection<br />
Order-specific customer data shall be saved and statistically processed internally via EDP.<br />
An order from the customer indicates revocable consent. Confidential handling of the data<br />
in terms of data protection shall be guaranteed.<br />
11. Concluding provisions<br />
The place of fulfilment and the sole venue for all disputes on whatever legal grounds is<br />
exclusively the location of our registered office. We are also entitled to make complaints<br />
to the head office of the customer. All legal relationships between us and the customer<br />
are subject to German law to the exclusion of all international and supranational (contract)<br />
legal systems, particularly the UN purchasing law.<br />
