11.1.6 EXEMPTION FROM PAYMENT OF ASSESSMENT RATES<br />

(C/M 2012/06/28 - D 3/2)<br />

Ordinary Management Committee Meeting of 14 June 2012,<br />

Addendum 7.13 page 77 refers.<br />

A. The following item was submitted to the Management Committee for<br />

consideration:<br />

1. Provision is made in Section 75 (1) of the Local Authorities Act 23 of<br />

1992, as amended, that Council, subject to certain conditions, may<br />

exempt certain organisations or institutions from the payment of<br />

assessment rates.<br />

A copy of Section 75 is attached as Annexure “A”<br />

2. According to the stipulations of subsection (3) of the Local Authorities Act<br />

(as amended), a local authority shall not grant any exemption under<br />

subsection (1), unless the application referred to in that subsection has<br />

been lodged to, or actually received by it on or before 31 May in the year<br />

immediately preceding the financial year to which the application relates.<br />

3. In addition, it should be noted that Council on 31 March 2010 under item<br />

11.1.18 resolved to propose the following amendment to the Local<br />

Authorities Act, Act 23 of 1992, as amended, to the Minister of Regional<br />

and Local Government, Housing and Rural Development:<br />

That the proposed amendments be submitted to the Permanent Secretary of the Ministry<br />

of Regional and Local Government, Housing and Rural Development for consideration,<br />

subject to following corrections:<br />

(iii) Section 75 be amended as: That only those rectories which are registered in the<br />

name of the church / mission be exempted.<br />

Should the above proposed amendment be approved, Pastors /<br />

Reverends / Priests / Preachers will no longer be able to claim exemption<br />

for private residences as manses / parsonages / rectories. To date no<br />

reply was received from the said Ministry.<br />

4. A notice was published on 30 March 2012 and 27 April 2012 in The<br />

Namib Times and The Namibian respectively with closing date 31 May<br />

2012.<br />

5. The following applications (Annexure “B”) were received in terms of<br />

Section 75 (3) of the Local Authorities Act 23 of 1992 (as amended), for<br />

the exemption from payment of Assessment Rates:<br />
