A DISPUTE has erupted <strong>in</strong> Ayeyarwady<br />

Region between two<br />

groups of farmers who are both<br />

claim<strong>in</strong>g ownership of farmland<br />

confiscated by a subsidiary of U<br />

Tay Za’s Htoo Group, <strong>in</strong> a case<br />

that highlights the challenges<br />

the authorities face <strong>in</strong> try<strong>in</strong>g to<br />

w<strong>in</strong>d back decades of land confiscations.<br />

Htoo Group subsidiary Ayeyar<br />

Shwe Wah, of which Thura U<br />

Shwe Mann’s son, U Aung Thet<br />

Mann, is also a director, agreed<br />

to return more than 41,200 acres<br />

of farmland <strong>in</strong> Ayeyarwady Region<br />

<strong>in</strong> 2011 because its contract<br />

farm<strong>in</strong>g operations were economically<br />

unviable.<br />

The land, <strong>in</strong> Tharpaung, Kangyidaunt,<br />

Kyaunggon and Yegyi<br />

townships, was transferred to<br />

the township authorities and<br />

the parliamentary land dispute<br />

commission decided on March<br />

29 that it should be given back<br />

to the orig<strong>in</strong>al owners.<br />

However, under a 1963 land<br />

law, those who work land for<br />

at least five consecutive years<br />

are considered the owners. As<br />

a result, two groups of farmers<br />

– the orig<strong>in</strong>al owners and those<br />

who cultivated the land under<br />

contract from Ayeyar Shwe Wah<br />

s<strong>in</strong>ce 1999 – are seek<strong>in</strong>g formal<br />

ownership of 550 acres <strong>in</strong> Tharpaung<br />

township.<br />

Almost four months after the<br />

commission made its decision,<br />

the regional authorities are still<br />

consider<strong>in</strong>g how to proceed.<br />

“There are problems <strong>in</strong><br />

decid<strong>in</strong>g who we should give the<br />

farmland back to,” said U W<strong>in</strong><br />

Ko Ko, the m<strong>in</strong>ister for f<strong>in</strong>ance<br />

from Ayeyarwady Region.<br />

“The company took the land<br />

from farmers <strong>in</strong> 1999. And between<br />

1999 and 2013, the company<br />

and then the regional<br />

authorities employed tenant<br />

farmers so we can say that those<br />

tenant farmers have some <strong>right</strong>s<br />

to possess the land accord<strong>in</strong>g to<br />

the [1963 farmland law]. That’s<br />

the problem we are fac<strong>in</strong>g,” he<br />

said.<br />

He said the regional <strong>government</strong><br />

is tak<strong>in</strong>g its time to decide<br />

because it wants a fair result that<br />

m<strong>in</strong>imises losses to both sides.<br />

“We are look<strong>in</strong>g for the <strong>right</strong><br />

decision and I th<strong>in</strong>k we can<br />

solve the problems <strong>in</strong> a couple of<br />

months.”<br />

Impatient with the regional<br />

<strong>government</strong>’s refusal to implement<br />

the hluttaw’s decision,<br />

some of the orig<strong>in</strong>al land owners<br />

have started to cultivate the<br />

fields. About 20 have s<strong>in</strong>ce been<br />

charged with trespass<strong>in</strong>g after<br />

the tenant farmers filed compla<strong>in</strong>ts<br />

to police.<br />

The orig<strong>in</strong>al owners have accused<br />

township authorities of<br />

stall<strong>in</strong>g <strong>in</strong> return<strong>in</strong>g the land because<br />

they want to keep rent<strong>in</strong>g<br />

the fields to the tenant farmers.<br />

“Our farmlands were seized<br />

<strong>in</strong> 1999 by Ayeyar Shwe Wah …<br />

We didn’t get any compensation.<br />

In 2011, Ayeyar Shwe Wah shut<br />

down its project and returned<br />

the farmland to the township<br />

authorities. Instead of giv<strong>in</strong>g<br />

it back to us, the township<br />

authorities kept the farmland<br />

and rented it to the farmers who<br />

could give them money or to<br />

their relatives,” said U Myo M<strong>in</strong><br />

Tun, who lost 55 acres to the<br />

company.<br />

“The orig<strong>in</strong>al farmers were<br />

told they would get their land<br />

back by the hluttaw so we have<br />

been wait<strong>in</strong>g … but there is no<br />

action and they couldn’t wait anymore<br />

as the ra<strong>in</strong> is heavier and<br />

it is nearly too late to cultivate.<br />

So they cultivated their old land<br />

without permission,” he said.<br />

U Thaung T<strong>in</strong>, one of the<br />

farmers who has been charged<br />

with trespass<strong>in</strong>g, said the land<br />

had effectively been confiscated<br />

twice, once by Ayeyar Shwe Wah<br />

and then by the township authorities.<br />

“The hluttaw gave us hope,”<br />

he said. “I need this land back;<br />

it is so important for my family’s<br />

survival.”<br />

U Than Htike, a member of<br />

the National Democracy Network<br />

<strong>in</strong> Ayeyarwady Region,<br />

said the delays could lead to<br />

serious unrest.<br />

“Conditions <strong>in</strong> Tharpaung<br />

and Myaungmya are the worst<br />

because farmers from these<br />

townships tried to cultivate the<br />

land without permission,” he<br />

said.<br />

“These farmer problems<br />

should be resolved faster and I<br />

want the authorities to make it<br />

a priority.<br />

“Farmers are becom<strong>in</strong>g more<br />

and more dissatisfied and I am<br />

worried that it will hold back<br />

the country’s development. It’s<br />

like construct<strong>in</strong>g a build<strong>in</strong>g: If<br />

the foundation is not strong, the<br />

build<strong>in</strong>g will collapse.”<br />

Heavy ra<strong>in</strong> expected to cont<strong>in</strong>ue<br />

RECENT heavy ra<strong>in</strong>s <strong>in</strong> Yangon<br />

are set to cont<strong>in</strong>ue, the Department<br />

of Meteorology and Hydrology<br />

said last week.<br />

A department spokes<strong>person</strong><br />

said the formation of a low pressure<br />

area <strong>in</strong> the Bay of Bengal<br />

<strong>in</strong> conjunction with the cont<strong>in</strong>uation<br />

of strong monsoon<br />

conditions <strong>in</strong> the Andaman Sea<br />

and Bay of Bengal will result <strong>in</strong><br />

heavy ra<strong>in</strong>fall until August 2.<br />

The department’s Weather<br />

Research and Forecast Model<br />

predicts parts of Rakh<strong>in</strong>e,<br />

Kay<strong>in</strong>, Shan and Mon states, as<br />

well as Bago and Tan<strong>in</strong>tharyi<br />

regions, can expect heavy daily<br />

ra<strong>in</strong>fall – more than 75 millimetres<br />

a day – until July 29.<br />

However, the threat of isolated<br />

torrential ra<strong>in</strong>s was expected to<br />

decl<strong>in</strong>e from July 27.<br />

Most of the country has received<br />

ra<strong>in</strong> s<strong>in</strong>ce July 20, with<br />

many coastal areas receiv<strong>in</strong>g<br />

more than 75mm of ra<strong>in</strong>fall a<br />

day.<br />

Launglone and Dawei <strong>in</strong><br />

Tan<strong>in</strong>tharyi Region recorded<br />

falls of 15.91<strong>in</strong>ches (398mm)<br />

and 13.78 <strong>in</strong>ches (345mm) <strong>in</strong> the<br />

24 hours to 9:30am on July 24,<br />

the department said.<br />

said low-ly<strong>in</strong>g parts of the<br />

town had been flooded on July<br />

24, <strong>in</strong>clud<strong>in</strong>g one of the town’s<br />

schools.<br />

“The [quarters] flooded after<br />

torrential ra<strong>in</strong>s on Tuesday and<br />

Wednesday,” he said. “But there<br />

was no need to relocate people.<br />

Farmers take fight aga<strong>in</strong>st<br />

draft law to Nay Pyi Taw<br />

REPRESENTATIVES of a national<br />

organisation of farmers<br />

say “cronies” should not be<br />

allowed to benefit from a bill<br />

aimed at improv<strong>in</strong>g liv<strong>in</strong>g conditions<br />

for the country’s millions<br />

of farmers.<br />

Seventeen representatives<br />

from the Farmer’s Network<br />

held a four-hour meet<strong>in</strong>g with<br />

the Agriculture, Livestock and<br />

Fishery Development Committee<br />

<strong>in</strong> Nay Pyi Taw on July 18<br />

to outl<strong>in</strong>e their objections to<br />

agriculture-related legislation,<br />

particularly a proposed farmer<br />

“enhancement” law.<br />

As The Myanmar Times<br />

reported last week, the draft<br />

legislation has been written<br />

by MPs, <strong>in</strong>clud<strong>in</strong>g Daw Aung<br />

San Suu Kyi and Thura U<br />

Shwe Mann, and would set a<br />

m<strong>in</strong>imum price for agriculture<br />

products. Orig<strong>in</strong>ally called the<br />

Farmer Protection Law, it has<br />

s<strong>in</strong>ce been renamed the Farmer<br />

Enhancement Law with a<br />

narrower focus.<br />

Many farmers are unhappy<br />

that the law def<strong>in</strong>es<br />

agribus<strong>in</strong>esses as farmers,<br />

which would allow them to<br />

also sell their products to the<br />

<strong>government</strong>.<br />

U Ohn Kywel, a farmer<br />

from Ayeyarwady Region’s<br />

Bogale township, said the legislation<br />

was be<strong>in</strong>g pushed by<br />

bus<strong>in</strong>essmen to support their<br />

own <strong>in</strong>terests and the network<br />

would fight aga<strong>in</strong>st its<br />

<strong>in</strong>troduction.<br />

“The aim of the bills should<br />

not be to profit cronies such<br />

as U Chit Kh<strong>in</strong>e and U Kh<strong>in</strong><br />

Shwe,” he said, referr<strong>in</strong>g to the<br />

owners of the Eden and Zaykabar<br />

bus<strong>in</strong>ess groups.<br />

They also said those draft<strong>in</strong>g<br />

the law had not properly<br />

consulted farmers on the<br />

legislation.<br />

“If the <strong>government</strong> really<br />

wants to alleviate poverty at the<br />

grassroots level, farmers should<br />

be <strong>in</strong>cluded <strong>in</strong> the process of<br />

draft<strong>in</strong>g laws ... because only<br />

other farmers know the difficulties<br />

we face,” said U Ohn Kywel.<br />

Another farmer, Ko Sithu<br />

from Py<strong>in</strong> Oo Lw<strong>in</strong> township<br />

<strong>in</strong> Mandalay Region, said the<br />

committee had agreed to redraft<br />

the law based on their<br />

concerns.<br />

“The committee chairman<br />

said they will start redraft<strong>in</strong>g<br />

the laws if farmers disagree<br />

with its current form. Bills<br />

relat<strong>in</strong>g to farmers should be<br />

drawn by respective officials<br />

and law experts along with<br />

farmers to be absolutely sure<br />

they improve the lives of farmers,”<br />

Ko Sithu said.<br />

At the meet<strong>in</strong>g network<br />

representatives also discussed<br />

land use <strong>right</strong>s <strong>in</strong> conflict-hit<br />

areas of Kach<strong>in</strong> State, where<br />

they said farmland has been<br />

seized by the military.<br />

Farmers also said the<br />

Pyithu Hluttaw’s Agriculture,<br />

Livestock and Fisheries Development<br />

Committee should<br />

<strong>in</strong>corporate a farmland survey<br />

– <strong>in</strong>clud<strong>in</strong>g lands seized from<br />

farmers <strong>in</strong> the past – as well<br />

as a rice price control policy<br />

and the extension of long-term<br />

loans to all remote areas.<br />

A f<strong>in</strong>al demand was that<br />

technical support be provided<br />

to farmers.<br />

“University students who<br />

have no experience farm<strong>in</strong>g<br />

paddy get the chance to learn<br />

modern farm<strong>in</strong>g techniques for<br />

four or five years as part of their<br />

courses,” said Ko T<strong>in</strong> Aung L<strong>in</strong>,<br />

a farmer from Ayeyarwady Region.<br />

“Farmers should be eligible<br />

to receive at least two days<br />

tra<strong>in</strong><strong>in</strong>g <strong>in</strong> these techniques. If<br />

not, we will keep farm<strong>in</strong>g us<strong>in</strong>g<br />
