ACTIVISTS say last week’s amnesty<br />
will boost peace efforts as<br />
most freed political prisoners<br />
released were jailed for l<strong>in</strong>ks to<br />
the Kach<strong>in</strong> Independence Army<br />
and Shan State Army-South.<br />
Of the 73 people freed on<br />
July 23, 68 were considered<br />
political prisoners, the Former<br />
Political Prisoners (FPP) group<br />
said.<br />
President U The<strong>in</strong> Se<strong>in</strong> ordered<br />
the amnesty under section<br />
204(a) of the constitution<br />
and 401(1) of the Code of Crim<strong>in</strong>al<br />
Procedure “with the aim of<br />
plac<strong>in</strong>g emphasis on humanitarian<br />
grounds and encourag<strong>in</strong>g<br />
them to be able to serve<br />
the national <strong>in</strong>terest after understand<strong>in</strong>g<br />
the goodwill of the<br />
state”, state media said.<br />
They were released from Inse<strong>in</strong><br />
Prison <strong>in</strong> Yangon, as well<br />
as jails <strong>in</strong> Mandalay, Myitky<strong>in</strong>a,<br />
H<strong>in</strong>thada, Thayet, Mawlamy<strong>in</strong>e,<br />
My<strong>in</strong>gyan, Kengtong, Tharyarwaddy,<br />
Kyaukpyu, Bhamo and<br />
Hle Hlaw Inn at 3pm on July 23.<br />
Most had been convicted for<br />
high treason under the Penal<br />
Code or for offences under section<br />
17(a) of the Unlawful Association<br />
Act and section 19 of the<br />
Arms Act.<br />
“Most [of the freed political]<br />
prisoners are ethnic people<br />
those have been jailed for contact<br />
with ethnic armed forces.<br />
Most of them are related to the<br />
KIO and RCSS/SSA as well as<br />
Kay<strong>in</strong> and Rakh<strong>in</strong>e,” said FPP<br />
member U Ye Aung. “I’m not<br />
sure of the exact figure but<br />
about two-thirds of the political<br />
prisoners are ethnics.”<br />
The group’s spokes<strong>person</strong>,<br />
Ko Thet Oo, said he was “sure”<br />
that amnesty would “support<br />
the national reconciliation between<br />
<strong>government</strong> and ethnic<br />
groups”.<br />
U Sai Nyunt Lw<strong>in</strong>, general<br />
secretary of the Shan Nationalities<br />
League for Democracy<br />
(SNLD), also welcomed the release<br />
of so many ethnic prisoners.<br />
“It is a good decision and<br />
I expect good results will come<br />
from the amnesty,” he said.<br />
He confirmed that 29 Shan<br />
nationals l<strong>in</strong>ked to the SSA-<br />
South and its political w<strong>in</strong>g, the<br />
Restoration Council of Shan<br />
State. The SNLD had been lobby<strong>in</strong>g<br />
for their release, he said.<br />
“Actually, they are war prisoners.<br />
They were arrested maybe<br />
<strong>in</strong> 2009,” said U Sai Nyunt<br />
Lw<strong>in</strong>, who is also a member<br />
of the <strong>government</strong>’s political<br />
prisoner committee headed by<br />
M<strong>in</strong>ister for the President’s Office<br />
U Soe The<strong>in</strong>. “We are prepar<strong>in</strong>g<br />
to meet up with prisoners<br />
<strong>in</strong> Mandalay and then we<br />
will send them to the RCSS/<br />
SSA liaison office <strong>in</strong> Muse [<strong>in</strong><br />
northern Shan State].”<br />
In Myitky<strong>in</strong>a, the 13 freed<br />
convicts were greeted by M<strong>in</strong>ister<br />
for the President’s Office<br />
U Aung M<strong>in</strong>, who was visit<strong>in</strong>g<br />
Kach<strong>in</strong> State for the open<strong>in</strong>g of<br />
the Kach<strong>in</strong> Independence Organisation’s<br />
liaison office. They<br />
were temporarily settled <strong>in</strong> a<br />
camp for displaced people <strong>in</strong><br />
Myitky<strong>in</strong>a township.<br />
Maran Naw Sann, 29, who<br />
was released from Inse<strong>in</strong> Prison,<br />
said he was delighted to be<br />
able to be able to see his family<br />
aga<strong>in</strong> and had been “emotional”<br />
when told he would be<br />
released about 14 months <strong>in</strong>to<br />
a three-year jail term.<br />
“I was arrested and convicted<br />
under section 17(a) [of the<br />
Unlawful Association Act] <strong>in</strong><br />
Kamai [<strong>in</strong> Hpakant township]<br />
<strong>in</strong> 2012 but I did not contact<br />
the KIA ... Now that I’m free I<br />
plan to go back my family,” he<br />
said.<br />
United Nations secretary<br />
general Ban Ki-moon also<br />
praised the president’s decision,<br />
say<strong>in</strong>g <strong>in</strong> a statement that<br />
he hoped it “and other measures<br />
undertaken recently <strong>in</strong> the<br />
country’s transition to democracy<br />
will further strengthen<br />
efforts toward a comprehensive<br />
nation-wide cease-fire<br />
and national reconciliation <strong>in</strong><br />
Myanmar”.<br />
The amnesty came after<br />
President U The<strong>in</strong> Se<strong>in</strong> pledged<br />
on July 15 to release all political<br />
prisoners by the end of the<br />
year.<br />
Former political prisoners<br />
said they believed about<br />
100 political prisoners are still<br />
beh<strong>in</strong>d bars. The <strong>government</strong><br />
committee formed <strong>in</strong> February<br />
to oversee the release of all<br />
political prisoners was to meet<br />
aga<strong>in</strong> on July 27 to discuss further<br />
amnesties.<br />

PYIDAUNGSU Hluttaw last<br />
week approved the formation of<br />
a constitutional review committee<br />
compris<strong>in</strong>g 109 members.<br />
The committee was approved<br />
with no objections on<br />
July 25, speaker U Kh<strong>in</strong> Aung<br />
My<strong>in</strong>t said.<br />
It was proposed <strong>in</strong> March<br />
by senior members of the Union<br />
Solidarity and Development<br />
Party.<br />
All 18 parties represented<br />
<strong>in</strong> the hluttaw have at least<br />
one member on the committee.<br />
The USDP has 52 members,<br />
while the Tatmadaw has 25. Of<br />
the other parties, the National<br />
League for Democracy has the<br />
most with seven. Parties were<br />
allowed to nom<strong>in</strong>ate which of<br />
their representatives they wanted<br />
to sit on the committee.<br />
While there are only eight<br />
female representatives, committee<br />
member Daw Dwe Bu said<br />
she was satisfied that the members<br />
were chosen based on their<br />
merits rather than gender.<br />
“In my party at least members<br />
were chosen on their skill<br />
rather than their gender,” said<br />
Daw Dwe Bu, who is from the<br />
Unity and Democracy Party of<br />
Kach<strong>in</strong> State.<br />

“Our party leaders chose the<br />
most suitable people - those<br />
who can discuss the constitution<br />

The committee will be<br />
chaired by the Pyidaungsu Hluttaw<br />
deputy speaker, with the<br />
Amyotha Hluttaw and Pyithu<br />
Hluttaw speakers as deputies.<br />
The secretary and jo<strong>in</strong>t secretary<br />
will be appo<strong>in</strong>ted by the<br />
chairman.<br />
Despite the approval of its<br />
formation, there is still little<br />
clarity on the committee’s “exact<br />
responsibilities, <strong>right</strong>s, rules<br />
and regulations”, said U Ye Tun,<br />
the Pyithu Hluttaw representative<br />
for Hsipaw.<br />
While he said he was unsure<br />
when it would beg<strong>in</strong> review<strong>in</strong>g<br />
the constitution, U The<strong>in</strong> Nyunt,<br />
the Pyithu Hluttaw representative<br />
for Th<strong>in</strong>gangyun, said he<br />
thought it would be next month.
