fails to comply with the terms of any notice served upon him in terms of<br />

these By-laws,<br />

shall be guilty of an offence <strong>and</strong> liable, upon conviction, to the maximum penalty<br />

prescribed for the offence by section 266 (7) (a) of the Local Authorities Ordinance, No.<br />

25 of 1974.<br />

(2) Failure to comply with the terms of any condition or notice referred to in<br />

subsection (1) (b) or (c) above shall constitute a continuing offence <strong>and</strong> a person failing to<br />

comply with the terms of such condition or notice shall be guilty of a separate offence for<br />

each day during which he fails to comply with such terms.<br />

25. Repeal of By-laws.—(a) These By-laws shall come into force upon the<br />

expiration of thirty days after the date of their promulgation.<br />

(b) The following By-laws are repealed, with effect as from the date upon<br />

which these By-laws shall come into force, namely—Public Health By-laws dealing with<br />

the Registration, Licensing <strong>and</strong> Inspection of Dairies <strong>and</strong> <strong>Milk</strong> Depots, promulgated on<br />

8th July, 1931 (Provincial Notice No. 229 of 1931, as amended by Provincial Notice No.<br />

251 of 1931, Provincial Notice No. 300 of 1939 <strong>and</strong> Provincial Notice No. 120 of 1943).<br />

(c) Anything to the contrary in this By-law or in these By-laws contained or<br />

implied notwithst<strong>and</strong>ing, it shall not be necessary for any dairyman, milk dealer or<br />

purveyor or any person engaged in the production <strong>and</strong>/or distribution of milk products to<br />

obtain any certificate or registration under these By-laws in respect of the period from the<br />

date of coming into force of these By-laws up to <strong>and</strong> including 31st December, 1950.<br />

26. Structure of Premises.—No person shall carry on any business which involves<br />

the manufacture, production, preparation, storing, h<strong>and</strong>ling, sale or distribution of milk or<br />

milk products in or upon any premises which do not comply with the following<br />

provisions, namely—<br />

(a)<br />

Walls: Materials.—Walls shall be constructed of brick, concrete, or other<br />

approved solid material <strong>and</strong> the internal surface of such walls shall be well<br />

<strong>and</strong> smoothly rendered; provided that in respect of any portion or portions<br />

of the premises used for the manufacture or preparation, storage, h<strong>and</strong>ling,<br />

sale or distribution of milk or milk products, internal walls shall in<br />

addition be suitably covered with tiles or other approved impervious<br />

material.<br />

Floors.—The floors of all portions of the premises shall be constructed of<br />

concrete or other similar solid <strong>and</strong> impervious rat-proof material <strong>and</strong> shall<br />

be adequately drained.<br />

Ceilings.—All ceilings shall be of approved solid material covered with<br />

lime or cement plaster or other suitable impervious material finished to a<br />

smooth surface <strong>and</strong> rendered dust-proof.<br />

Lighting <strong>and</strong> Ventilation.—There shall be provided adequate natural or<br />

article means of lighting <strong>and</strong> ventilation in conformity with the st<strong>and</strong>ards<br />

laid down in the City Building By-laws <strong>and</strong> the Factories, Machinery <strong>and</strong><br />

Building Work Act, 1941.<br />

Vermin Proofing.—The buildings shall be so constructed as to obviate, as<br />

far as practicable, any harbourage for rats or other vermin <strong>and</strong> the milk<br />

room, wash room, feed stores <strong>and</strong> structures used in connection with the
