Programme in Jewellery Designing (CJD) programme<br />
On behalf of Indira Gandhi National Open University the DIRECTOR (SOVET) invites<br />
limited tender for developing the E - Content matrix for the Certificate in Jewellery<br />
Designing (CJD) programme.<br />
The tender document containing the terms and conditions with requirement specifications<br />
are attached herewith. The tender document duly filled in and completed in all respects<br />
should be submitted to the Director, School of Vocational Education and Training, Room<br />
10 , Block <strong>No</strong>1 , Indira Gandhi National Open University , Maidan Garhi, New Delhi-<br />
110068 on or before 21/02/2011 upto 2:30 P.M.<br />
Bids will be opened on the same day at 3:00 P.M. This will be followed by presentations<br />
and demos of technical capabilities in E-Content Matrix by each bidding vendor to<br />
evaluate the bids, if necessary. Late submission of tender documents shall be summarily<br />
rejected.<br />
<strong>IGNOU</strong> reserves the right to accept or reject any of all the tenders without any reason<br />
thereof.<br />

On behalf of the Indira Gandhi National Open University, REGISTRAR<br />
(Administration), hereafter referred as „The Purchaser‟, invites tenders for<br />
developing E- Content matrix for the Certificate Programme in Jewellery<br />
Designing (CJD) programme hereafter referred as „The <strong>Tender</strong>er‟, for the<br />
supply and installation of the items as per the specifications mentioned.<br />
All offers in the prescribed format should be submitted before the time and date fixed<br />
for the receipt of offers as set forth in the tender document offers received after the<br />
stipulated time and date are liable to be rejected. The <strong>Tender</strong>er must ensure that the<br />
conditions laid down for submissions of offers detailed are correctly and completely<br />
fulfilled. <strong>Tender</strong>s found to be deficient in any respect shall be summarily rejected.<br />
Similarly, conditional offers and offers with terms and conditions inconsistent with<br />
those contained in this document shall be rejected.<br />
In the event of the tender being submitted by a firm, it must be signed separately by<br />
each member thereof, or in the event of the absence of any partner, it must be<br />
signed on his behalf by a person holding power of attorney and in case the firm is<br />
registered, a copy of the certificate issued by the Registrar of firms be furnished. In<br />
the event the tender is submitted by a Company, it must be signed by a person who<br />
is authorized under the Articles of Association of the Company to do so or by a<br />
person holding a duly authorized power of attorney supported by Board Resolution<br />
of the Company.<br />
An incomplete offer is liable to be rejected. The <strong>Tender</strong>er must fill this checklist and<br />
submit along with his offer in his own interest.<br />

Chapter –II<br />
2.1 Conditions to Qualify for Evaluation of Technical Bid<br />
The <strong>Tender</strong>er shall provide the following information with the technical bid. These<br />
information will be used for technical evaluation under the, two bid system<br />

A brief write up clear specilisation/describing the key features as to how<br />
proposed E – content matrix is suitable for meeting the <strong>IGNOU</strong>‟s needs<br />
duly supported with complete technical details of the services quoted<br />
including its detailed technical catalogue, etc.<br />
<strong>Tender</strong>er should indicate the details of their branches/channel partners for<br />
taking up installation, commissioning and after sale and services,<br />
maintenance at the locations at H/Q with their address, telephone nos. E-<br />
mail and number of service engineers at that office (Service Engineer<br />
should be qualified engineer with a University Degree/Diploma) who are<br />
specialists in e-Learning<br />
Development and installation, of such work orders executed in last three<br />
years giving details of organizations for which work was executed, value of<br />
order, work on hand, time period taken for completion, user feedback, etc.<br />
Development period for E – content matrix from the date of issue of the<br />
Work Order will be maximum 30 days.<br />
2.2 Compliance with Technical Specifications<br />
The technical bid must have compliance certificate with exact mention of<br />
deviation, if any as per Annexure II chapter VI.<br />

2.3 Earnest Money Deposit<br />
<strong>Tender</strong>ers are exempted from depositing EMD alongwith <strong>Tender</strong> document.<br />
2.4 Submission of Offer<br />
(a)<br />
(i) All prices and other information like discounts etc. having a bearing on the price<br />
shall be written both in figures and words in the prescribed form. Where there is a<br />
difference between amounts quoted in words and figures, the amounts quoted in<br />
words shall prevail.<br />
(ii) The interested <strong>Tender</strong>ers will submit bid as asked for in the <strong>Tender</strong> Document.<br />
<strong>No</strong>n-compliance of these may lead to rejection of bid.<br />

The <strong>IGNOU</strong> shall not be responsible for any delay in submission of the tender bids.<br />
The tender submitted by telex/telegram/fax or e-mail would not be construed as a<br />
valid tender and will not be considered. <strong>No</strong> further correspondence will be<br />
entertained on this matter.<br />
The Registration number of the firm along with ST/CST number allotted by the<br />
Sales Tax authorities in addition to PAN/TIN allotted by the IT Deptt. shall<br />
invariably be given in the tender<br />
The Excise Duty, Sales Tax/VAT etc., as applicable should be quoted<br />
Separately in absence of which it will be presumed that they are included in the<br />
rates and <strong>IGNOU</strong> shall have no liability to pay these charges.<br />
Each page of the offer shall be numbered and must bear the signature and Stamp of<br />
the tenderer at the bottom. All offers shall be either typewritten or written neatly in<br />
indelible ink. Any correction should be properly authenticated.<br />
The offers in the prescribed format should be addressed to Director, School of<br />
Vocational Education and Training. This is a two-bid system. The first sealed<br />
cover shall be superscribed “<strong>Tender</strong> for Technical Bids with Commercial Terms<br />
and Conditions” – as prescribed in Chapter IV (Please ensure that no<br />
financial details are mentioned in the Technical Bid otherwise the bid will be<br />
rejected) The second sealed cover shall be superscribed “<strong>Tender</strong> for Financial<br />
Bid” – as prescribed in Chapter V. Both these Envelopes, after being sealed<br />
properly, shall be put into one cover, which should be properly sealed before it is<br />
sent/ submitted. This cover should be superscribed “<strong>Tender</strong> for Development of<br />
e-content matrix for Certificate in Jewellery Design (CJD) programme to be<br />
opened at 3:00 P.M. on 21/02/2011. The sealed cover shall be addressed to the<br />
Director, School of Vocational Education and Training, Room <strong>No</strong> 10, Block 1,<br />
<strong>IGNOU</strong>, Maidan Garhi, New Delhi, 110068.<br />
The first cover shall contain all details about technical capability, experience,<br />
number of qualified software engineers for e-Learning, and other information as<br />
per condition to Qualify for Evaluation of Technical Bid, clause 2.1. Those who do<br />
not qualify the pre-qualification conditions given in clause 2.1 (a-d), 2.4 (e) and<br />
2.4(f) shall be summarily rejected and their Financial Bids shall not be opened.<br />
The <strong>IGNOU</strong> reserves the right to accept or reject any tender without assigning any<br />
reason.<br />

(h)<br />
(i)<br />
The “Technical Bids with Commercial Terms and Conditions” shall be opened<br />
in the first instance in the presence of tenderers or representatives who may wish to<br />
be present. Only one authorized representative per tenderer will be permitted to be<br />
present at the time of opening of the tender unless otherwise permitted by the<br />
<strong>Tender</strong> Opening Committee for more representatives from tenderer.<br />
The “Financial Bid” must have pricing for evaluation of bids in absence of which<br />
bids will not be considered. Financial bids shall be opened only for technically<br />
qualified bidders.<br />
2.5 Evaluation of <strong>Tender</strong><br />
(a) The <strong>Tender</strong> Evaluation Committee (TEC) will evaluate the tenders on the basis of<br />
techno-commercial parameters, Presentation and Background Information. If<br />
considered necessary, the Committee (TEC) may decide to visit and inspect the<br />
facilities. Other related sites, as it may find worth in order to gather further information<br />
leading to evaluation of bids, may also be visited by TEC. <strong>Tender</strong>er will be bound to<br />
provide all necessary information as desired by TEC at such sites. The short-listed<br />
tenderers will be called for detailed discussions at a specified date, time and venue<br />
including demonstration of their proposal methodology as submitted in the bid.<br />
(b) The Technical Proposal will be evaluated on the basis of applicant‟s experience, its<br />
undertaking of Terms of Reference (TOR), proposed methodology and work plan, and<br />
the experience of key personnel. Only those applicants whose technical proposal score<br />
70 marks or more out of 100 shall be declared as technically suitable and will be<br />
empanelled<br />
(c) The scoring criteria to be used for evaluation shall be as follows:<br />

(d) If the Purchaser considers necessary, it may ask for revised financial bids from the<br />
short listed tenderers which should be submitted within three days of intimation of this<br />
effect in sealed envelopes on specified date and time. The revised bids shall not be for<br />
amounts more than one quoted earlier for an item, unless the specification is of higher<br />
than the earlier ones, by the respective tenderer. Any tenderer quoting higher rates for<br />
the same item with same specification quoted earlier in their revised financial bid shall<br />
be disqualified for further consideration.<br />
(e) The Financial Bid of the technically short listed tenderers only shall be opened in the<br />
presence of their representative, who may wish to be present, on a specified date and<br />
time at the office of the Director, School of Vocational Education and Training.<br />
(f) The Purchaser reserves the right to select the tenderer on the basis of best possible<br />
features quoted. The decision of <strong>IGNOU</strong> arrived at as above shall be final and<br />
representation of any kind shall not be entertained on the above. Any attempt by any<br />
tenderer to bring pressure of any kind shall disqualify the tenderer for the present<br />
tender and the tenderer shall be liable to be debarred from bidding for <strong>IGNOU</strong> tenders<br />
in future for a period of three years.<br />
(g) The <strong>Tender</strong> will be awarded to L-1. However, the Purchaser reserves the right to award<br />
the contract to any of the bidders irrespective of not being lowest and in this respect.<br />
The decision of the University shall be final.<br />
(h) The <strong>Tender</strong>er must mention in writing the current projects in hand to asses their ability<br />
to complete the project in time<br />
2.6. Acceptance of tender<br />
(a) The <strong>IGNOU</strong> may accept a tender for a part or whole of the quantity offered, reject any<br />
tender without disclosing any reason and may not accept the lowest or any tender.<br />
(b) The <strong>Tender</strong>ers must ensure that the conditions laid down for submission of offers<br />
detailed in the preceding Clauses and Sub-Clauses, are completely and correctly<br />
fulfilled. <strong>Tender</strong>s, which are not complete in all respects as stipulated above, shall be<br />
summarily rejected.<br />
(c) The tender shall be processed as per standard procedures. The Purchaser, however,<br />
reserves the right to reject any tender without disclosing any reason. The Purchaser<br />
would not be under obligation to give any clarifications to those <strong>Tender</strong>ers whose<br />
tenders have been rejected.<br />

2.7 Effect and Validity of Offer<br />

The offer shall be kept valid for acceptance for a minimum period till completion<br />
of the project<br />
Order shall be placed as per <strong>IGNOU</strong>‟s requirements by the authorized officer i.e.<br />
DIRECTOR (SOVET) or his nominee. The successful tenderer will develop E-<br />
content matrix in a maximum period of one month.<br />
The contract shall be valid till the development, installation and completion of all<br />
e-content matrix material . If required, additional orders shall be placed within this<br />
period with financial benefits, due to reduction in price if any, to <strong>IGNOU</strong>.<br />
All the terms and conditions for the supply, testing, commissioning and acceptance,<br />
payment terms, penalty etc. shall be as those mentioned herein and no change in the<br />
terms and conditions will be acceptable. Alterations, if any, in the tender bid shall<br />
be attested properly by putting their signatures and seal by the tenderer, failing<br />
which the tender is liable to be rejected.<br />
The Registration number of the firm along with CST and PAN/TIN allotted by the<br />
authorities shall invariably be given in the tender.<br />
2.8 SECURITY DEPOSIT/PERFORMANCE GUARANTEE<br />
The successful tenderer(s) shall, after placing the work order, deposit an amount of<br />
Rupees equivalent to 5% of the value of the contract as security deposit for<br />
due performance of the contract. The security deposit may be furnished in the form<br />
of a Bank Guarantee/ Demand Draft drawn in favour of <strong>IGNOU</strong> or a bank<br />
guarantee from a commercial bank/scheduled bank guaranteed by RBI, duly<br />
countersigned by the bankers. The validity of Bank Guarantee/Security Deposit<br />
shall be for the entire period of the contract plus Two months. The Security<br />
Deposit/Bank Guarantee shall be furnished within 10 days from the date of<br />
acceptance of the offer in terms of work order. Failure to furnish Security<br />
Deposit/Bank Guarantee shall be treated as breach of contract and entail<br />
cancellation of the contract, forfeiture of EMD and procurement of e-Learning<br />
modules from the next acceptable tenderer at the Cost and risk of the Contractor<br />
(tenderer at default). If the tenderer is not able to develop, E – content matrix<br />
completely within the specified period to the complete satisfaction of the <strong>IGNOU</strong>,<br />
the Bank Guarantee/Security Deposit shall be invoked/ forfeited as the case may<br />
be.<br />

2.9 DELIVERY AND PENALTY FOR DELAY<br />
2.9.1 The <strong>Tender</strong>er shall deliver, in accordance with the conditions of the order<br />
placed by the Purchaser the time/place and in the manner specified in the<br />
<strong>Tender</strong>. Execution of job is time –bound. Any delay in the supply, installation<br />
and commissioning within the time fixed or in the event of repudiation of the<br />
contract, the Purchaser reserves the right to recover damage for Breach of<br />
Contract as indicated below:<br />
a) To recover from the <strong>Tender</strong>er liquidated damages including administrative<br />
expenses a sum equivalent to 0.05% of the price of the project, incase the<br />
contractor has failed to deliver within the period of 45 days after the issue of<br />
work order fixed for delivery/commissioning for each week or part thereof<br />
during which delivery is in arrears subject to an overall ceiling of 10% of the<br />
total contract price.<br />
b) Contact any other <strong>Tender</strong>er elsewhere without a show-cause notice to<br />
contractor, on the account and at the risk of the <strong>Tender</strong>er of the services not so<br />
delivered or others of a similar description (where services exactly complying<br />
with particulars are not in the opinion of the Purchaser, which shall be final,<br />
readily procurable) without canceling the contract in respect of the installments<br />
not yet due for delivery. If the <strong>Tender</strong>er had defaulted in the performance of the<br />
original contract, the purchaser shall have the right to ignore his tender for risk<br />
purchase even though the lowest.<br />
c) Cancel the contract or a portion thereof without a show-cause notice to the<br />
<strong>Tender</strong>er and if so desired contract or authorize contracting for the services not<br />
so delivered or others of a similar description (where services exactly<br />
complying with particulars are not in the opinion of the Purchaser, which shall<br />
be final, readily procurable) at the risk and cost of the <strong>Tender</strong>er. If the <strong>Tender</strong>er<br />
had defaulted in the performance of the original contract, the purchaser shall<br />
have the right to ignore his tender for risk purchase even though the lowest.<br />
d) All the deliverables, as per the work order placed would be subjected to<br />
appropriate standard testing procedure to the satisfaction of the Purchaser. Only<br />
those items would be considered for acceptance of delivery, which would<br />
qualify such tests.<br />

PAYMENT TERMS<br />
(i)<br />
Payment shall be made within 30 working days of submission of bills of the evaluation<br />
committee duly supported by the consignee‟s receipt with satisfactory performance<br />
report and as governed by the following:<br />
<strong>No</strong> part of the contract price shall become due or payable until the tenderer has<br />
developed, installed and commissioned the e-learning modules to the complete<br />
satisfaction of <strong>IGNOU</strong>. Payment shall be made subject to recoveries, if any.<br />
(ii) A pre-receipted bill shall be submitted in duplicate in the name of <strong>IGNOU</strong> at the<br />
Location mentioned in the purchase order. It shall be done soon after the delivery,<br />
installation and commissioning of the items along with a copy of the duly receipted<br />
delivery challan in original of the consignee certifying satisfactory commissioning.<br />
(iii) TDS as applicable will be deducted as per the Income Tax Rules.<br />
Settlement of Dispute & Jurisdiction<br />
In the event of any question, dispute or difference arising under these conditions or<br />
„Instructions to <strong>Tender</strong>ers' or in connection with this contract both the parties shall try to<br />
resolve their dispute by mutual discussion within a period of 30 working days failing<br />
which only the courts at Delhi/New Delhi will have Jurisdiction to adjudicate upon the<br />
matter.<br />
