Recommendation 15:<br />

The RQIA recommends that HSC Trusts:<br />

• develop new records management policies<br />

• update all polices not reviewed follow<strong>in</strong>g the merger <strong>of</strong> Trusts<br />

• develop a system to ensure staff are aware <strong>of</strong> the content <strong>of</strong> all relevant policies.<br />

8.3i The organisation has procedures for protection <strong>of</strong> service user <strong>and</strong> carer <strong>in</strong>formation which <strong>in</strong>clude the timely<br />

shar<strong>in</strong>g <strong>of</strong> <strong>in</strong>formation with other pr<strong>of</strong>essionals, teams <strong>and</strong> partner organisations as appropriate, to ensure safe<br />

<strong>and</strong> effective provision <strong>of</strong> care, treatment <strong>and</strong> services, e.g. <strong>in</strong> relation to the protection <strong>of</strong> children or vulnerable<br />

adults, <strong>and</strong> the safe <strong>and</strong> effi cient discharge <strong>of</strong> <strong>in</strong>dividuals from hospital care.<br />

All Trusts have policies <strong>and</strong> procedures <strong>in</strong> place to manage the protection <strong>of</strong> service user <strong>and</strong> carer <strong>in</strong>formation<br />

<strong>and</strong> to promote "best practice" however these are <strong>of</strong>ten still <strong>in</strong> draft .<br />

A number <strong>of</strong> methods are used to ensure that good protection measures are be<strong>in</strong>g used such as adherence<br />

to CREST guidel<strong>in</strong>es <strong>and</strong> the use <strong>of</strong> POCVA check<strong>in</strong>g systems as well as other systems to ensure patient<br />

confi dentiality.<br />

8.3j The organisation has effective <strong>and</strong> effi cient procedures for obta<strong>in</strong><strong>in</strong>g valid consent for exam<strong>in</strong>ation, treatment<br />

<strong>and</strong>/or care.<br />

Effective consent processes are important to protect patients <strong>and</strong> all Trusts reported that they operate with<strong>in</strong><br />

these processes. With<strong>in</strong> the Trusts there are regional consent forms <strong>and</strong> <strong>in</strong>formation leafl ets <strong>and</strong> work is be<strong>in</strong>g<br />

carried out to review consent issues, to update exist<strong>in</strong>g policies <strong>and</strong> procedures <strong>and</strong> provide tra<strong>in</strong><strong>in</strong>g <strong>in</strong> relation to<br />

these. The NIAS use the National <strong>Cl<strong>in</strong>ical</strong> Guidel<strong>in</strong>es on Consent issued by the Jo<strong>in</strong>t Royal Colleges Ambulance<br />

Liaison Committee (JRCALC).<br />

8.3k The organisation has an effective compla<strong>in</strong>ts <strong>and</strong> representation procedure <strong>and</strong> feedback <strong>arrangements</strong>,<br />

which is made available to service users, carers <strong>and</strong> staff <strong>and</strong> which is used to <strong>in</strong>form <strong>and</strong> improve care, treatment<br />

<strong>and</strong> service delivery.<br />

Compla<strong>in</strong>ts are important <strong>in</strong> help<strong>in</strong>g to` reduce poor or <strong>in</strong>effective practices. Five HSC Trusts operate us<strong>in</strong>g<br />

policies which have not been updated s<strong>in</strong>ce the merger <strong>of</strong> Trusts. The NIAS already has a well established<br />

compla<strong>in</strong>ts mechanism <strong>and</strong> operates under a "lessons learned" system, which is also be<strong>in</strong>g applied <strong>in</strong> the<br />

Southern Trust. This enables amendments to be made to exist<strong>in</strong>g systems.<br />

In addition to the compla<strong>in</strong>ts system, other approaches for service user feedback <strong>in</strong>clude satisfaction surveys,<br />

service user <strong>and</strong> patient forums, compla<strong>in</strong>ts review groups or service user feedback committees. The Northern<br />

Trust was highlighted by the RQIA as hav<strong>in</strong>g an over reliance on their compla<strong>in</strong>ts system to the detriment <strong>of</strong> other<br />

options.<br />
