STATEMENT OFTHECASE Nature of the Case : This original proceeding arises out of a healt h care Iiability claim filed pursuant to Chapter 7 4 of the Texas Civil Practices & Remedies Code , styled Andre McCoy, Individually and a s Permanent Guardian of Shannon Miles McCoy , an Incapacitated Person v. Woman 's Hospita l of Texas, Inc. ; CHCA Woman 's Hospital, L.P. d/b/a Woman 's Hospital of Texas; Houston Woman's Hospital Partner, L.L.C. ; Debra C. Gunn, M.D . ; Mark A . Jacobs, M.D . ; Obstetrica l and Gynecological Associates, P.A . ; and James A. Collins, M.D., Cause No . 352,923-401 , pending in Probate Court Number Two, Han-i s County, Texas (the "underlying suit") . Real Parties sued to recover damages for th e alleged negligent medical care and treatment rendered by Relators to Shannon Miles McCoy while she was a patient at Woman's Hospital of Texas, from September 13, 2004 to Septembe r 14, 2004 .
