PROPOSED MODEL GUIDELINES OF PRIOR INFORMED CONSENT FOR<br />

SEEKING RESEARCH ACCESS TO HERBS, PLANTS, BIOLOGICAL RESOURCES<br />

AND ASSOCIATED TRADITIONAL KNOWLEDGE IN THAILAND.<br />

DRAFT V.2, MARCH 2006 (MIINAAKHOM 2549)<br />

NOTE: These proposed guidelines should be understood as a draft measure for the<br />

consideration <strong>of</strong> the Government <strong>of</strong> Thail<strong>and</strong> <strong>and</strong> others. It should not be misconstrued as a<br />

legal instrument unless it meets Government approval. In the interim, Government<br />

departments have their own respective policies about research access <strong>and</strong> these bodies should<br />

be consulted independent <strong>of</strong> these guidelines. Subsequent versions <strong>of</strong> this guideline will be<br />

developed <strong>and</strong> made available for comment.<br />

Recognising: the contributions <strong>of</strong> traditional knowledge holders <strong>and</strong> the custodians <strong>of</strong> herbs,<br />

local plant varieties <strong>and</strong> biological resources, in conservation, sustainable use, knowledge<br />

development, sharing <strong>of</strong> such knowledge for broader societal benefits, <strong>and</strong> the threats posed<br />

to traditional knowledge systems, there is a need to promote <strong>and</strong> protect traditional knowledge<br />

<strong>and</strong> related biological resources.<br />

Objective: To facilitate a practical mechanism <strong>of</strong> prior informed consent (PIC) <strong>of</strong> traditional<br />

knowledge holders <strong>and</strong> the custodians <strong>of</strong> herbs, plants <strong>and</strong> other biological resources when<br />

researcher access is sought to such materials <strong>and</strong> knowledge.<br />

This guideline should be recognized as a first step towards the development <strong>of</strong> a system <strong>of</strong><br />

providing fair, equitable <strong>and</strong> appropriate benefits to traditional knowledge holders <strong>and</strong><br />

biological resource custodians, arising from such research.<br />

Regulatory Framework: These guidelines are put forward for consideration by relevant<br />

<strong>of</strong>ficials <strong>of</strong> the Government <strong>of</strong> Thail<strong>and</strong>. It is intended that they be considered for provisional<br />

implementation as part <strong>of</strong> the Ministerial Regulations under the Act on Protection <strong>and</strong><br />

Promotion <strong>of</strong> <strong>Traditional</strong> Thai Medicinal Intelligence B.E. 2542 (1999) as administered by the<br />

Department for Development <strong>of</strong> Thai <strong>Traditional</strong> <strong>and</strong> Alternative Medicines (TTAM<br />

Department), Ministry <strong>of</strong> Public Health; <strong>and</strong> the Plant Variety Protection Act, B.E. 2542<br />

(1999) as administered by the Plant Variety Protection (PVP) Division <strong>of</strong> the Department <strong>of</strong><br />

Agriculture.<br />
