REQUEST FOR PROPOSAL<br />

INVITATION OF BIDS FOR PROCUREMENT OF VIDEO CAMERA<br />

<strong>RFP</strong> No. 403/PC/01 Dated 08 Nov 11<br />

1. Bids <strong>in</strong> sealed cover are <strong>in</strong>vited for Procurement of one <strong>in</strong> No Digital <strong>Video</strong><br />

<strong>Camera</strong> as per details given <strong>in</strong> Part II of this <strong>RFP</strong>. Please super scribe the above<br />

mentioned Title, <strong>RFP</strong> number and date of open<strong>in</strong>g of the Bids on the sealed cover to<br />

avoid the Bid be<strong>in</strong>g declared <strong>in</strong>valid.<br />

3. This <strong>RFP</strong> is be<strong>in</strong>g issued with no f<strong>in</strong>ancial commitment and the Buyer reserves the<br />

right to change or vary any part thereof at any stage. Buyer also reserves the right to<br />

withdraw the <strong>RFP</strong>, should it become necessary at any stage.

Part I <strong>–</strong> General <strong>in</strong>formation<br />

4. The Follow<strong>in</strong>g detail should be clearly written on the face of the sealed<br />

envelop conta<strong>in</strong><strong>in</strong>g your quote:-<br />

5. You are requested to offer your rates with follow<strong>in</strong>g breakdown:-<br />

(c) LD/PBG : 10% of total order value with<strong>in</strong> a month of supply order <strong>in</strong><br />

form of Bank Guarantee <strong>in</strong> favour of PCDA(N) Mumbai which will be<br />

released after expiry of warranty period.<br />

6. Last date and time for deposit<strong>in</strong>g the Bids: 29 Nov 2011 by 1700 hrs.<br />

7. Manner of deposit<strong>in</strong>g the Bids: Sealed Bids should be either dropped <strong>in</strong> the<br />

Tender Box marked as TENDER BOX RAQAS (MB) or sent by registered post at the<br />

address given above so as to reach by the due date and time. Late tenders will not be<br />

considered. No responsibility will be taken for postal delay or non delivery/ non-receipt of<br />

Bid documents. Bids sent by FAX or e-mail will not be considered (unless they have been<br />

specifically called for by these modes due to urgency).<br />

8. Time and date for open<strong>in</strong>g of Bids: 1100 Hrs. on 30 Nov 2011<br />

(If due to any exigency, the due date for open<strong>in</strong>g of the Bids is declared a closed<br />

holiday, the Bids will be opened on the next work<strong>in</strong>g day at the same time or on any other<br />

day/time, as <strong>in</strong>timated by the Buyer).<br />

9. Location of the Tender Box: 5 th Floor Tech<strong>nic</strong>al Block, INS Shikra /<br />

RAQAS(MB)<br />

(Only those Bids that are found <strong>in</strong> the tender box will be opened. Bids dropped <strong>in</strong> the<br />

wrong Tender Box will be rendered <strong>in</strong>valid.)<br />

10. Place of open<strong>in</strong>g of the Bids: RAQAS (MB). The Bidders may depute their<br />

representatives, duly authorized <strong>in</strong> writ<strong>in</strong>g, to attend the open<strong>in</strong>g of Bids on the due date<br />

and time. Rates and important commercial/tech<strong>nic</strong>al clauses quoted by all Bidders will be<br />

read out <strong>in</strong> the presence of the representatives of all the Bidders. This event will not be<br />

postponed due to non-presence of your representative.<br />

11. Forward<strong>in</strong>g of Bids: Bids should be forwarded by Bidders under their orig<strong>in</strong>al<br />

memo / letter pad <strong>in</strong>ter alias furnish<strong>in</strong>g details like TIN number, VAT/CST number, Bank<br />

address with EFT Account if applicable, etc and complete postal & e-mail address of their<br />

office.<br />

12. Modification and Withdrawal of Bids: A bidder may modify or withdraw his bid<br />

after submission provided that the written notice of modification or withdrawal is received<br />

by the Buyer prior to deadl<strong>in</strong>e prescribed for submission of bids.

13. Rejection of Bids: Canvass<strong>in</strong>g by the Bidder <strong>in</strong> any form, unsolicited letter and<br />

post-tender correction may <strong>in</strong>voke summary rejection with forfeiture of EMD. Conditional<br />

tenders will be rejected.<br />

14. Unwill<strong>in</strong>gness to quote: Bidders unwill<strong>in</strong>g to quote should ensure that <strong>in</strong>timation<br />

to this effect reaches before the due date and time of open<strong>in</strong>g of the Bid<br />

15. Validity of Bids: The Bids should rema<strong>in</strong> valid till 28 Feb 2012 (90 days from<br />

open<strong>in</strong>g of bid).<br />

16. Earnest Money Deposit:<strong>–</strong> Bidders are required to submit Earnest Money Deposit<br />

(EMD) for amount of ------ along with their bids. The EMD may be submitted <strong>in</strong> the<br />

form of an Account Payee Demand Draft, Fixed Deposit Receipt, Banker's Cheque or<br />

Bank Guarantee from any of the public sector banks or a private sector bank authorized<br />

to conduct government bus<strong>in</strong>ess.<br />

Part III <strong>–</strong> Standard Conditions of <strong>RFP</strong><br />

The Bidder is required to give confirmation of their acceptance of the Standard<br />

Conditions of the Request for Proposal which will automatically be considered as part of<br />

the Contract concluded with the successful Bidder.<br />

21. Effective Date of the Contract: The contract shall come <strong>in</strong>to effect on the date of<br />

signatures of both the parties on the contract (Effective Date) and shall rema<strong>in</strong> valid until<br />

the completion of the obligations of the parties under the contract. The deliveries and<br />

supplies and performance of the services shall commence from the effective date of the<br />

contract.<br />

22. Arbitration: All disputes or differences aris<strong>in</strong>g out of or <strong>in</strong> connection with the<br />

Contract shall be settled by bilateral discussions. In case of arbitration with the firm and<br />

this unit on any issue, the f<strong>in</strong>al decision would be that of the Flag Officer Command<strong>in</strong>g,<br />

Headquarters Western Naval Command, Mumbai.<br />

23. Liquidated Damages: Delay <strong>in</strong> supply of item will attract a penalty of 0.5% per day<br />

of amount agreed per item, subject to a maximum of 10% unclaimed goods/ services.<br />

24. Term<strong>in</strong>ation of Contract: The competent F<strong>in</strong>ancial Authority reserves the right to<br />

accept or reject any or all tenders without assign<strong>in</strong>g any reasons whatsoever.<br />

25. Amendments: No provision of present Contract shall be changed or modified <strong>in</strong><br />

any way (<strong>in</strong>clud<strong>in</strong>g this provision) either <strong>in</strong> whole or <strong>in</strong> part except by an <strong>in</strong>strument <strong>in</strong><br />

writ<strong>in</strong>g made after the date of this Contract and signed on behalf of both the parties and<br />

which expressly states to amend the present Contract.<br />

26. Taxes and Duties: If Bidder desires to ask for excise duty or Sales Tax / VAT<br />

extra; the same must be specifically stated.<br />

i) Excise Duty:- Where the excise duty is payable on advalorem basis, the Bidder<br />

should submit along with the tender, the relevant form and the Manufacturer’s price<br />

list show<strong>in</strong>g the actual assessable value of the stores as approved by the Excise<br />

authorities.<br />

ii) Sales Tax / VAT If it is desired by the Bidder to ask for Sales tax / VAT to be<br />

paid as extra, the same must be specifically stated.

iii) Octroi Duty & Local Taxes. Materials to be supplied to Government<br />

Departments aga<strong>in</strong>st Government Contracts are exempted from levy of town duty,<br />

Octroi Duty, Term<strong>in</strong>al Tax and other levies of local bodies. The local<br />

Town/Mu<strong>nic</strong>ipal Body regulations at times, however, provide for such Exemption<br />

only on production of such exemption certificate from any authorised officer.<br />

Part IV <strong>–</strong> Special Conditions of <strong>RFP</strong><br />

The Bidder is required to give confirmation of their acceptance of Special Conditions of<br />

the <strong>RFP</strong> if any.<br />

27. Payment Terms for Indigenous Sellers: It will be mandatory for the Bidders to<br />

<strong>in</strong>dicate their bank account numbers and other relevant e payment details so that<br />

payments could be made through ECS/EFT mechanism <strong>in</strong>stead of payment through<br />

cheques, wherever feasible<br />

28. Advance Payments: No advance payment(s) will be made.<br />

29. Pay<strong>in</strong>g Authority: PCDA (Navy), Mumbai. The payment of bills will be made on<br />

submission of all the relevant documents by the Seller to the Pay<strong>in</strong>g Authority along with<br />

the bill:<br />

30. Force Majeure clause: Neither party shall bear responsibility for the complete or<br />

partial nonperformance of any of its obligations (except for failure to pay any sum which<br />

has become due on account of receipt of goods under the provisions of the present<br />

contract), if the non-performance results from such Force Majeure circumstances as<br />

Flood, Fire, Earth Quake and other acts of God as well as War, Military operation,<br />

blockade, Acts or Actions of State Authorities or any other circumstances beyond the<br />

parties control that have arisen after the conclusion of the present contract.<br />

31. Inspection Authority: The Inspection will be carried out by RAQAS (MB). The<br />

mode of Inspection will be Departmental Inspection / User Inspection / Jo<strong>in</strong>t Inspection /<br />

Self-certification.<br />

32. Risk and Expense: It is undertaken by the purchaser <strong>in</strong> the event of supplier<br />

fail<strong>in</strong>g to honour the contracted obligations with<strong>in</strong> the stipulated period, Risk purchase will<br />

be resorted to at the cost and expense of supplier.<br />

Part V <strong>–</strong> Evaluation Criteria & Price Bid issues<br />

33. Evaluation Criteria: Only those Bids will be evaluated which are found to be<br />

fulfill<strong>in</strong>g all the eligibility and qualify<strong>in</strong>g requirements of the <strong>RFP</strong>, both tech<strong>nic</strong>ally and<br />

commercially.<br />
