<strong>Environmental</strong> crimes <strong>in</strong> <strong>Ethiopia</strong><br />

with imprisonment of not less than one year and not<br />

exceed<strong>in</strong>g five years, or both. 48 Under article 15(4) of<br />

the proclamation, wildlife anti-poach<strong>in</strong>g officers are<br />

empowered to deta<strong>in</strong> any offender who violates article<br />

16 of the proclamation without a court warrant, and to<br />

hand over the offender to the appropriate law enforc<strong>in</strong>g<br />

body. Furthermore, with the objectives of ensur<strong>in</strong>g the<br />

development, conservation and the susta<strong>in</strong>able utilisation<br />

of the country’s wildlife resource, Proclamation No.<br />

575/2008 establishes the <strong>Ethiopia</strong>n wildlife Development<br />

and Conservation Authority.<br />

The Forest Development, Conservation and<br />

Utilisation Proclamation No. 542/2007 prohibits the<br />

cutt<strong>in</strong>g down or use of <strong>in</strong>digenous natural trees from<br />

a state forest, settl<strong>in</strong>g temporarily or permanently <strong>in</strong>,<br />

graz<strong>in</strong>g domestic animals <strong>in</strong>, carry<strong>in</strong>g out hunt<strong>in</strong>g activity<br />

<strong>in</strong>, keep<strong>in</strong>g bee-hives <strong>in</strong> a state forest, or remov<strong>in</strong>g<br />

natural resources from state forest, all of which are punishable<br />

offenses. 49 Furthermore, it is made a prerequisite<br />

to obta<strong>in</strong> a license from the M<strong>in</strong>istry of Agriculture and<br />

Rural Development prior to undertak<strong>in</strong>g large-scale<br />

farm<strong>in</strong>g, m<strong>in</strong><strong>in</strong>g, road construction, water drill<strong>in</strong>g, irrigation,<br />

dam construction and other similar <strong>in</strong>vestment<br />

activities. 50 The proclamation makes the cutt<strong>in</strong>g down<br />

of trees from a state forest punishable by imprisonment<br />

for a term of not less than one year and not more<br />

than five years plus a f<strong>in</strong>e 10 000 birr. The sett<strong>in</strong>g of<br />

fire <strong>in</strong> a forest shall be punishable by imprisonment of<br />

not less than ten years and not more than 15 years, of<br />

rigorous imprisonment. 51<br />

An analysis of the legal regime pert<strong>in</strong>ent to environmental<br />

crimes <strong>in</strong> <strong>Ethiopia</strong> shows that it suffers from<br />

<strong>in</strong>consistent and contradictory structural arrangements.<br />

It also lacks structural hierarchy. This is best illustrated<br />

perhaps by the rules govern<strong>in</strong>g EIAs. On the one hand,<br />

the EIA proclamation makes the conduct of an EIA a<br />

mandatory prerequisite before any project is commended.<br />

On the other hand, <strong>in</strong>vestment licenses are issued to <strong>in</strong>vestors<br />

by the Investment Office rather than the EPA, even<br />

though the Investment Office is ill equipped to review EIA<br />

reports. Moreover, this creates confusion as to whether or<br />

not conduct<strong>in</strong>g an EIA is really a prerequisite. Regardless<br />

of the EIA, <strong>in</strong>vestors still manage to get the green light to<br />

commence their projects.<br />

In addition, the M<strong>in</strong>istry of Agriculture and<br />

Rural Development is <strong>in</strong> charge of implement<strong>in</strong>g the<br />

Forest Development, Conservation and Utilisation<br />

Proclamation. This places the department <strong>in</strong> control<br />

of two contradictory tasks, namely the promotion of<br />

farm<strong>in</strong>g on the one hand and forest conservation on the<br />

other. Quite apart from its lack of expertise and research<br />

capability, the EPA is <strong>in</strong> addition faced by the challenge<br />

of hav<strong>in</strong>g to carry out its mandate through another<br />

executive body. It is obvious that this situation reduces its<br />

effectiveness <strong>in</strong> prevent<strong>in</strong>g environmental crimes.<br />

PUBLIC INTEREST LITIGATION<br />

It is important to note that <strong>in</strong> addition to the <strong>in</strong>herent<br />

powers vested <strong>in</strong> the state to prosecute environmental<br />

crimes, members of the public are by law also empowered<br />

to prosecute environmental crime through public-<strong>in</strong>terest<br />

litigation. Such litigation is a legal action <strong>in</strong>itiated <strong>in</strong> a court<br />

of law for the enforcement of the public or general <strong>in</strong>terest<br />

<strong>in</strong> which the public as a class has a pecuniary or other <strong>in</strong>terest<br />

by which the legal rights or liabilities are affected. 52<br />

Effective public <strong>in</strong>terest litigation <strong>in</strong>volves a unique<br />

bundle of procedures and substantive guarantees of<br />

rights. These <strong>in</strong>clude procedural flexibility, relaxed rules<br />

of stand<strong>in</strong>g, a broader <strong>in</strong>terpretation of fundamental<br />

freedoms enshr<strong>in</strong>ed <strong>in</strong> the Constitution, remedial flexibility<br />

and ongo<strong>in</strong>g judicial participation and supervision. 53<br />

Under the <strong>Environmental</strong> Pollution Control Proclamation<br />

locus standi is granted to a private <strong>in</strong>dividual for <strong>in</strong>itiat<strong>in</strong>g<br />

action ‘aga<strong>in</strong>st any person’ who is allegedly caus<strong>in</strong>g or is<br />

likely to cause damage to the environment. Article 11 of<br />

the proclamation provides as follows:<br />

Any person shall have, without the need to show any<br />

vested <strong>in</strong>terest, the right to lodge a compla<strong>in</strong>t at the<br />

authority or the relevant regional environmental<br />

agency aga<strong>in</strong>st any person allegedly caus<strong>in</strong>g actual or<br />

potential damage to the environment.<br />

When the authority or regional environmental agency<br />

fails to give a decision with<strong>in</strong> 30 days, or when the<br />

person who has lodged the compla<strong>in</strong>t is dissatisfied<br />

with the decision, he may <strong>in</strong>stitute a court case with<strong>in</strong><br />

60 days from the date the decision was given, or the<br />

deadl<strong>in</strong>e for decision has elapsed.<br />

Moreover, article 37 of the Constitution gives ‘everyone’<br />

the right to br<strong>in</strong>g any justifiable matter to a court of law,<br />

or to any other competent body with judicial power, for<br />

the purpose of seek<strong>in</strong>g to obta<strong>in</strong> judgment. These provisions<br />

enable environmentalists, NGOs and even <strong>in</strong>dividuals<br />

to <strong>in</strong>stitute public <strong>in</strong>terest litigations. However, the<br />

practicality of the rights given by the Constitution and<br />

article 11 of the proclamation are be<strong>in</strong>g tested <strong>in</strong> court,<br />

and the outcome does not look particularly encourag<strong>in</strong>g<br />

at this po<strong>in</strong>t of time.<br />

In public <strong>in</strong>terest litigation the flexibility and a liberal<br />

approach of courts are of great importance <strong>in</strong> br<strong>in</strong>g<strong>in</strong>g<br />

to life the substantive laws enshr<strong>in</strong>ed <strong>in</strong> the Constitution<br />

and the <strong>Environmental</strong> Pollution Control Proclamation.<br />
