<strong>Environmental</strong> crimes <strong>in</strong> <strong>Ethiopia</strong><br />

<strong>Ethiopia</strong> and the MEAs to which the country is a signatory<br />

is not reflected at all <strong>in</strong> patchy judicial decisions.<br />

Another form of <strong>in</strong>consistency is seen <strong>in</strong> adm<strong>in</strong>istrative<br />

bodies. Governmental authorities often f<strong>in</strong>d themselves<br />

<strong>in</strong> a limbo as a result of contradictory demands.<br />

This is best illustrated by the M<strong>in</strong>istry of Agriculture<br />

and Rural Development, which is the adm<strong>in</strong>istrative<br />

body responsible for regulat<strong>in</strong>g and develop<strong>in</strong>g <strong>Ethiopia</strong>’s<br />

extensive agricultural activities. Its found<strong>in</strong>g law demands<br />

that rural development is ensured and hence the m<strong>in</strong>istry<br />

is expected to support the requirements of a large population.<br />

Yet, on the other hand, the same m<strong>in</strong>istry is responsible<br />

for safeguard<strong>in</strong>g the country’s natural forests, which<br />

the general public <strong>in</strong> essence regards as good cropland.<br />

Then there is the clash between <strong>in</strong>vestment and<br />

environmental concerns. It is a legal requirement that<br />

EIAs are conducted before certa<strong>in</strong> <strong>in</strong>vestment projects<br />

are implemented. However, Investment Offices have<br />

failed to make this legal requirement a prerequisite for<br />

grant<strong>in</strong>g <strong>in</strong>vestment licenses, the reason ma<strong>in</strong>ly be<strong>in</strong>g<br />

that enforcement of this legal requirement is presumed to<br />

h<strong>in</strong>der the country’s development needs. Indeed, call<strong>in</strong>g<br />

for EIAs is perceived as underm<strong>in</strong><strong>in</strong>g the <strong>in</strong>vestment<br />

<strong>in</strong>centives that <strong>Ethiopia</strong> has to offer. Thus <strong>in</strong>vestment<br />

bureaus at both federal and regional levels seem to have<br />

given greater importance to ‘easy access’ than prevent<strong>in</strong>g<br />

often far-reach<strong>in</strong>g environmental consequences. The EPA,<br />

on its part, has failed to enforce the EIA requirements<br />

strongly and to prosecute those who fail to comply.<br />

In spite of the many challenges fac<strong>in</strong>g the enforcement<br />

of environmental legislation <strong>in</strong> <strong>Ethiopia</strong>, there are nevertheless<br />

some developments worthy of note. Cooperation<br />

between the Wildlife Trade Monitor<strong>in</strong>g Network<br />

(TRAFFIC), EWCA, the federal police and the courts <strong>in</strong><br />

the fight aga<strong>in</strong>st wildlife crimes <strong>in</strong> <strong>Ethiopia</strong> is one such<br />

example. Tra<strong>in</strong><strong>in</strong>g undertaken <strong>in</strong> this regard has led to<br />

a reduction <strong>in</strong> the number of reported cases of crime<br />

<strong>in</strong>volv<strong>in</strong>g wildlife. It has also resulted <strong>in</strong> greater public<br />

sensitisation about wildlife crimes and the prosecution of<br />

a greater number of offenders.<br />
