In the event that the GCAA has observed a trend which, if unchecked,<br />
would lead it to cease to be satisfied as to the competence <strong>of</strong> the<br />
certificate holder, the GCAA will contact the certificate holder to set out the<br />
GCAA’s concerns. <strong>The</strong> GCAA will make it clear that unless the trend is<br />
reversed the GCAA may cease to be satisfied as to the competence <strong>of</strong> the<br />
certificate holder, in which circumst<strong>an</strong>ces it may take further action in<br />
accord<strong>an</strong>ce with Case 3 or Case 4 as listed in 1.5.<br />
It is import<strong>an</strong>t to recognise that every case needs to be judged on the<br />
individual circumst<strong>an</strong>ces. Examples <strong>of</strong> what could prompt action in<br />
accord<strong>an</strong>ce with Cases 2, 3 or 4 are:<br />
• Safety Signific<strong>an</strong>t Non Compli<strong>an</strong>t Audit Findings;<br />
• Repetitive Audit Findings, including a failure to identify root causes<br />
<strong>of</strong> findings or a ‘sticking plaster’ approach to findings;<br />
• Signific<strong>an</strong>t incidents, together with a failure to investigate properly<br />
<strong>an</strong>d deal with the root causes;<br />
• An increasing number <strong>of</strong> incidents, indicating <strong>an</strong> underlying<br />
systemic failure;<br />
• Poor m<strong>an</strong>agement attitude to compli<strong>an</strong>ce;<br />
• A m<strong>an</strong>agement that prefers solutions that simply address the detail<br />
<strong>of</strong> the finding <strong>an</strong>d that is unwilling or unable to put measures in<br />
place that address the root cause <strong>of</strong> non-compli<strong>an</strong>ces;<br />
• Unstable/ineffective m<strong>an</strong>agement. Instability c<strong>an</strong> be caused by<br />
excessive ch<strong>an</strong>ges in structure, personnel, or both.<br />
<strong>The</strong> GCAA will set out its concerns <strong>an</strong>d request a recovery pl<strong>an</strong> from the<br />
certificate holder to address the causes <strong>of</strong> the adverse trend. <strong>The</strong> recovery<br />
pl<strong>an</strong> should provide deliverables that c<strong>an</strong> be measured, including specific<br />
timescales. <strong>The</strong> recovery pl<strong>an</strong> should set out clearly the “who, what,<br />
