FINAL RULE ANNOUNCEMENTBASED ON <strong>NPA</strong> <strong>14</strong>/<strong>2012</strong> <strong>CAR</strong> OPS 1 (AEROPLANE)Release date: 31 January 2013Date: Amendment of this Civil Aviation Regulation will become effective 28 February 2013BACKGROUNDWith this <strong>NPA</strong>, the UAE General Civil Aviation Authority (GCAA) has published a proposed amendment to<strong>CAR</strong> OPS 1 to be in line with ICAO Standards and Recommended Practices with initial closing date <strong>for</strong>comments of 9 September <strong>2012</strong>.The GCAA is pleased with the number of comments considering <strong>NPA</strong> No.<strong>14</strong>/<strong>2012</strong> as acceptable andappreciates as well the constructive comments.Page 1 of 3


SUMMARY OF RESPONSES (<strong>SOR</strong>)<strong>CAR</strong>-OPS 1.037 Safety Management SystemComment 1.1.037 (c) and (f) to have standard terminology, the Person in charge of SMS should be designated asSMS Post Holder.Response1.GCAA accepts the comment and the term “SMS manager” has been replaced throughout theregulations with “SMS Post Holder”.Comment 2.1.037 (C) one operator did not accept the Flight data Analysis to be part of SMS and to be managedby SMS Post Holder.Response 2.GCAA rejects the comment as ICAO requires FDM to be part of SMS. Ref Annex 6 Part I 3.3.6.<strong>CAR</strong>–OPS 1.398 Use of Airborne Collision Avoidance System (ACAS)Comment 3.1.398(e) One operator did not accept this requirement as it may contradict with one aircraft SOP. Theoperator was to consult the manufacturer and comeback to GCAA.Response 3.GCAA did not receive further communication, hence maintains its position.<strong>CAR</strong>–OPS 1.940 (a)(7) & <strong>CAR</strong>–OPS 3.940 (a.6) Composition of Flight CrewComment 41.940(a.7) Bilateral agreement amongst UAE AOC holder should be less restrictive as some operatorsmay hire from an agency.Response 4.1.940(a.7) GCAA accepts the comment. Paragraph reworded to remove the ambiguity.<strong>CAR</strong>-OPS 1.425 Deficiencies reported by an Inspecting AuthorityComment: There is a need to introduce requirements <strong>for</strong> the operator to report SAFA inspectionreports to the GCAA and the Inspecting Authorities to ensure the cycle is closed and to deal withsuch cases consistently.Response: Accepted. Requirements added in 1.425IEM OPS 1.965(b)(2) pilot proficiencyComment 5.The title is irrelevant with paragraph; Co-pilot should be rephrased with Pilot as it covers any captain orcopilot.Response 5.AcceptedPage 2 of 3

Basis of changes ICAO, UK CAP371, EU OPS 1 Subpart Q.In consideration of the <strong>for</strong>egoing, the Director General of the GCAA, hereby, announces that theproposed draft of <strong>CAR</strong> OPS 1 as published to the public by <strong>NPA</strong> <strong>14</strong> and the later amendments made to itpursuant to the <strong>SOR</strong> above, a final rule effective 28 February 2013.Page 3 of 3
