Introduction (a) Regulation 26 of <strong>the</strong> Land Transfer Regulations 2002 (regulation 26)<br />

permits <strong>the</strong> Registrar-General of Land (RGL) <strong>to</strong> <strong>change</strong> <strong>or</strong> c<strong>or</strong>rect a<br />

name <strong>in</strong> his <strong>or</strong> her rec<strong>or</strong>ds if <strong>the</strong> RGL is satisfied that <strong>the</strong> name of a<br />

registered proprie<strong>to</strong>r:<br />

(i)<br />

(ii)<br />

(iii)<br />

has <strong>change</strong>d, <strong>or</strong><br />

is <strong>in</strong>c<strong>or</strong>rectly stated <strong>in</strong> <strong>the</strong> RGL's rec<strong>or</strong>ds, and<br />

<strong>the</strong> prescribed fee has been paid.<br />

(b)<br />

An application <strong>to</strong> <strong>change</strong> <strong>or</strong> c<strong>or</strong>rect <strong>the</strong> name of a registered<br />

proprie<strong>to</strong>r may be lodged as an electronic <strong>in</strong>strument under r 4(1)<br />

and (2) and Parts 1 and 2 of Schedule 1 of <strong>the</strong> Land Transfer<br />

Regulations 2002 (LTR).<br />

Purpose of<br />

guidel<strong>in</strong>e<br />

The purpose of this guidel<strong>in</strong>e is <strong>to</strong> assist people <strong>to</strong> apply <strong>to</strong> <strong>change</strong> <strong>or</strong><br />

c<strong>or</strong>rect <strong>the</strong> name of a registered proprie<strong>to</strong>r <strong>in</strong> <strong>the</strong> RGL’s rec<strong>or</strong>ds.<br />

Scope (a) This guidel<strong>in</strong>e provides guidance on:<br />

(i)<br />

(ii)<br />

how <strong>to</strong> apply <strong>to</strong> <strong>change</strong> <strong>or</strong> c<strong>or</strong>rect <strong>the</strong> name of a registered<br />

proprie<strong>to</strong>r <strong>in</strong> electronic and paper <strong>f<strong>or</strong></strong>m, and<br />

what documents are needed <strong>to</strong> supp<strong>or</strong>t such <strong>applications</strong>.<br />

(b)<br />

Regulation 26 and this guidel<strong>in</strong>e do not apply <strong>to</strong>:<br />

(i)<br />

(ii)<br />

(iii)<br />

any name <strong>in</strong>c<strong>or</strong>rectly stated <strong>in</strong> <strong>the</strong> RGL’s rec<strong>or</strong>ds as a result of<br />

an err<strong>or</strong> by <strong>the</strong> RGL. In that case <strong>the</strong> RGL can c<strong>or</strong>rect <strong>the</strong> err<strong>or</strong><br />

under s 80 of <strong>the</strong> Land Transfer Act (LTA) <strong>in</strong> acc<strong>or</strong>dance with<br />

LINZS20006: Standard <strong>f<strong>or</strong></strong> c<strong>or</strong>rections <strong>to</strong> <strong>the</strong> register;<br />

vest<strong>in</strong>g of land follow<strong>in</strong>g a <strong>change</strong> of identity by a c<strong>or</strong>p<strong>or</strong>ate<br />

body; <strong>f<strong>or</strong></strong> example, by amalgamation of companies under<br />

Part 13 of <strong>the</strong> Companies Act 1993. In that case refer <strong>to</strong><br />

LINZG20705: <strong>Guidel<strong>in</strong>e</strong> <strong>f<strong>or</strong></strong> transmission follow<strong>in</strong>g amalgamation<br />

of companies; <strong>or</strong><br />

c<strong>or</strong>rection of an err<strong>or</strong> that resulted <strong>in</strong> <strong>the</strong> wrong person <strong>or</strong><br />

c<strong>or</strong>p<strong>or</strong>ate body be<strong>in</strong>g registered as proprie<strong>to</strong>r.<br />

1 Electronic application<br />

Electronic<br />

<strong>in</strong>strument<br />

An application <strong>to</strong> <strong>change</strong> <strong>or</strong> c<strong>or</strong>rect <strong>the</strong> name of a registered proprie<strong>to</strong>r may<br />

be lodged as an electronic <strong>in</strong>strument under r 4(1) and (2) and Parts 1<br />

and 2 of Schedule 1 of <strong>the</strong> LTR.<br />

Certification (a) An application <strong>f<strong>or</strong></strong> c<strong>or</strong>rection <strong>or</strong> <strong>change</strong> of name of a registered<br />

proprie<strong>to</strong>r must be certified by a practitioner act<strong>in</strong>g <strong>f<strong>or</strong></strong> <strong>the</strong> applicant<br />

(r 11 and s 164A of <strong>the</strong> LTA) <strong>in</strong> <strong>the</strong> <strong>f<strong>or</strong></strong>m prescribed <strong>in</strong> r 12.<br />

(b)<br />

On registration, an electronic application <strong>f<strong>or</strong></strong> c<strong>or</strong>rection <strong>or</strong> <strong>change</strong> of<br />

name has <strong>the</strong> same effect as an <strong>in</strong>strument made <strong>in</strong> writ<strong>in</strong>g executed<br />

by <strong>the</strong> applicant (r 13).<br />

Evidence (a) A certify<strong>in</strong>g practitioner must reta<strong>in</strong> evidence show<strong>in</strong>g <strong>the</strong> truth of <strong>the</strong><br />

certification (s 164C(1) of <strong>the</strong> LTA) and produce it when required by<br />

<strong>the</strong> RGL under s 164C(3) of <strong>the</strong> LTA.<br />

(b)<br />

The RGL has specified requirements <strong>f<strong>or</strong></strong> retention of evidence relat<strong>in</strong>g<br />

<strong>to</strong> an application <strong>f<strong>or</strong></strong> c<strong>or</strong>rection <strong>or</strong> <strong>change</strong> of name <strong>in</strong> "Statu<strong>to</strong>ry<br />

Requirements, F<strong>or</strong>ms of Electronic Instruments, and Requirements <strong>f<strong>or</strong></strong><br />

<strong>the</strong> Retention of Evidence" (26 September 2008) 144 New Zealand<br />

Under <strong>the</strong> Gazette notice, a practitioner must reta<strong>in</strong> <strong>the</strong> applicant's<br />

written auth<strong>or</strong>isation <strong>to</strong> apply <strong>to</strong> <strong>change</strong> <strong>or</strong> c<strong>or</strong>rect <strong>the</strong> name of a<br />

registered proprie<strong>to</strong>r <strong>in</strong> <strong>the</strong> RGL's rec<strong>or</strong>ds.<br />

The auth<strong>or</strong>isation should be signed by <strong>the</strong> applicant, <strong>the</strong>ir at<strong>to</strong>rney, <strong>or</strong><br />

auth<strong>or</strong>ised signa<strong>to</strong>ry.<br />

If <strong>the</strong> applicant is a c<strong>or</strong>p<strong>or</strong>ate body, <strong>the</strong> auth<strong>or</strong>isation must be signed<br />

acc<strong>or</strong>d<strong>in</strong>g <strong>to</strong> <strong>the</strong> relevant legislation; <strong>f<strong>or</strong></strong> example:<br />

(i) A company must comply with s 180 of <strong>the</strong> Companies Act 1993.<br />

Under <strong>the</strong> Gazette notice, a practitioner must reta<strong>in</strong> evidence that<br />

reasonable steps have been taken <strong>to</strong> confirm <strong>the</strong> identity and legal<br />

capacity of <strong>the</strong> applicant.<br />

Requirements <strong>f<strong>or</strong></strong> verify<strong>in</strong>g <strong>the</strong> identity of <strong>the</strong> applicant and reta<strong>in</strong><strong>in</strong>g<br />

evidence of <strong>the</strong> steps taken are set out <strong>in</strong> LINZS20002: Standard <strong>f<strong>or</strong></strong><br />

verification of identity <strong>f<strong>or</strong></strong> registration under <strong>the</strong> Land Transfer<br />

Act 1952.<br />

Supp<strong>or</strong>t<strong>in</strong>g<br />

documentation<br />

To meet <strong>the</strong> requirements of regulation 26 and <strong>the</strong> Gazette notice, a<br />

practitioner must reta<strong>in</strong> evidence of <strong>the</strong> grounds <strong>f<strong>or</strong></strong> <strong>the</strong> application.<br />

Certificates (a) A New Zealand government-issued certificate that shows <strong>the</strong> applicant<br />

has <strong>change</strong>d <strong>the</strong>ir name may be sufficient evidence <strong>f<strong>or</strong></strong> <strong>the</strong> grounds of<br />

an application, if it is self-explana<strong>to</strong>ry. Examples are:<br />

(i)<br />

(ii)<br />

New Zealand marriage certificate, marriage dissolution <strong>or</strong>der, <strong>or</strong><br />

name <strong>change</strong> certificate.<br />

New Zealand Companies Office certificate of <strong>in</strong>c<strong>or</strong>p<strong>or</strong>ation.<br />

(b)<br />

A certified copy of such a certificate will usually be sufficient.<br />

(a)<br />

Under <strong>the</strong> Gazette notice, a statu<strong>to</strong>ry declaration by <strong>the</strong> applicant is<br />

necessary if <strong>the</strong> documentary evidence of grounds <strong>f<strong>or</strong></strong> <strong>the</strong> application<br />

is not self-explana<strong>to</strong>ry <strong>or</strong> <strong>the</strong> <strong>in</strong><strong>f<strong>or</strong></strong>mation requires verification <strong>or</strong><br />

expansion. Examples of situations where a statu<strong>to</strong>ry declaration may<br />

be required are:<br />

The registered proprie<strong>to</strong>r’s name is <strong>in</strong>c<strong>or</strong>rect <strong>in</strong> <strong>the</strong> RGL's<br />

rec<strong>or</strong>ds.<br />

The registered proprie<strong>to</strong>r has adopted an alias, <strong>or</strong> <strong>the</strong>re is m<strong>or</strong>e<br />

than one version of his <strong>or</strong> her name, with no <strong>f<strong>or</strong></strong>mal supp<strong>or</strong>t<strong>in</strong>g<br />

documentation.<br />

There are discrepancies between documentary evidence <strong>or</strong><br />

identity documentation, such as a driver licence, and <strong>the</strong><br />

registered proprie<strong>to</strong>r's real name.<br />

When <strong>the</strong> evidence provided, <strong>f<strong>or</strong></strong> example, a marriage certificate,<br />

was issued by an unfamiliar <strong>or</strong>ganisation <strong>in</strong> ano<strong>the</strong>r country <strong>or</strong> is<br />

<strong>in</strong> a <strong>f<strong>or</strong></strong>eign language.<br />

(b)<br />

A statu<strong>to</strong>ry declaration <strong>or</strong> statement by a practitioner may be<br />

sufficient where <strong>the</strong> circumstances are with<strong>in</strong> his <strong>or</strong> her personal<br />

knowledge; <strong>f<strong>or</strong></strong> example, where <strong>the</strong> registered proprie<strong>to</strong>r's name is<br />

<strong>in</strong>c<strong>or</strong>rect <strong>in</strong> <strong>the</strong> RGL's rec<strong>or</strong>ds due <strong>to</strong> an err<strong>or</strong> <strong>in</strong> an <strong>in</strong>strument lodged<br />

by <strong>the</strong> practitioner.<br />

A statu<strong>to</strong>ry declaration supp<strong>or</strong>t<strong>in</strong>g an application by a c<strong>or</strong>p<strong>or</strong>ate body<br />

should be made by a person who has appropriate auth<strong>or</strong>ity <strong>to</strong> do so <strong>in</strong><br />
