The Performance <strong>of</strong> 287(g) Agreements FY 2012<br />
Follow-Up<br />
Section 287(g) <strong>of</strong> the Immigration and Nationality<br />
Act, as amended, authorizes DHS to delegate<br />
Federal immigration enforcement authorities to<br />
State and local law enforcement agencies through<br />
formal, written agreements. The agreements<br />
outline terms and conditions for program activities<br />
and establish a process for ICE to supervise<br />
and manage program functions. This report<br />
is an update to three DHS OIG reports: (1)<br />
OIG-10-63, The Performance <strong>of</strong> 287(g) Agreements, <br />
issued in March 2010; (2) OIG-10-124, The <br />
Performance <strong>of</strong> 287(g) Agreements Report Update, <br />
issued September 2010; and (3) OIG-11-119, The <br />
Performance <strong>of</strong> 287(g) Agreements Report FY 2011<br />
Update, issued September 2011, with a total <strong>of</strong> 62<br />
recommendations to improve overall operations <strong>of</strong><br />
the 287(g) program.<br />
In this review, we determined that ICE needs to<br />
continue efforts to implement our prior recommendations.<br />
In addition, we identified staffng and<br />
budgetary issues that need to be addressed in order<br />
to further enhance ICE’s ability to achieve program<br />
objectives. We recommended that ICE (1) provide<br />
the Offce <strong>of</strong> Pr<strong>of</strong>essional Responsibility with<br />
the classification study results by December 31,<br />
2012, and (2) if needed, develop a transition plan<br />
to complete any reclassification efforts during FY<br />
2013.<br />
We made two recommendations for ICE to<br />
enhance its ability to achieve program objectives <strong>of</strong><br />
the 287(g) program.<br />

INVESTIGATIONS<br />
ICE Employee Pleads Guilty <strong>of</strong> Theft<br />
We investigated an allegation that an ICE<br />
employee stole $200 from the property <strong>of</strong> a<br />
detainee. Following our investigation, the<br />
employee entered a plea <strong>of</strong> guilty to a misdemeanor<br />
charge <strong>of</strong> Offcer or Employee <strong>of</strong> the United<br />
States Converting Property <strong>of</strong> Another, and was<br />
sentenced to 1 year unsupervised probation, fined<br />
$800, and ordered to pay restitution <strong>of</strong> $200.<br />
ICE Special Agent in Charge Awaits Sentencing<br />
for Transporting Child Pornography<br />
A Child Exploitation task force contacted us to<br />
report that it had developed indications that an<br />
ICE law enforcement manager was involved in<br />
sending and receiving online child pornography.<br />
We partnered with the FBI and a local sheriff ’s<br />
<strong>of</strong>fce to serve a search warrant at the subject’s<br />
residence and arrest him. After he pleaded<br />
guilty to a count <strong>of</strong> knowingly transporting child<br />
pornography, he was immediately remanded to<br />
custody and ordered to register as a sex <strong>of</strong>fender.<br />
The charge carries a minimum sentence <strong>of</strong> 5 years<br />
and a maximum <strong>of</strong> 20 years’ incarceration.<br />
ICE Contract Employee Pleads Guilty to<br />
Possession <strong>of</strong> Child Pornography<br />
An ICE telecommunications contract employee<br />
self-reported that his ICE-issued laptop had<br />
been seized by a local police department in<br />
connection with an allegation that the contractor<br />
was distributing child pornography. We joined<br />
with the local police in a search <strong>of</strong> the contractor’s<br />
residence and developed further evidence <strong>of</strong> child<br />
pornography. He resigned from his position and<br />
was subsequently found guilty at trial in Federal<br />
court with three counts <strong>of</strong> Possession <strong>of</strong> Child<br />
Pornography. He is currently awaiting sentencing.<br />
