CONDITIONS
GENERAL PURCHASING CONDITIONS
The commercial relationships formed between Orkli and the customers will be conditioned by the points that follow:
> The prices indicated in our lists are understood:
material, packing and sitted in our factory in Ordizia.
> Payment: 60 days net monthly.
> The increasing of the prices will be informed by Orkli to the clients
in a reasonable lapse of time, and, in any case, will be valid from the
date indicated in our price list.
> Orkli reserves the right to cancel any order in case the purchaser
had previously unfulfilled any previous contract.
> Delays by supplying, being the cause not due directly to Orkli will
not be enough cause to cancel an order or delay payment.
> At the time of order, the minimum quantities for each product
determined in the lists must be respected.
> No returns will be accepted without Orkli previous knowledge and
authorisation.
> Orkli does not accept returns of customised products.
> Orkli reserves the right of ownership of any material sent but not
paid for.
> Orkli will not accept any material supplied that is outside the
guarantee period, or which has been modified in any way.
> Failures due to the transport will not be attributed to Orkli.
3 YEAR WARRANTY
This is to certify that Orkli Sociedad Cooperativa warrants to the first purchaser only, the products manufactured by it to
be free from defects in materials and workmanship, when properly maintained, and under normal use and service.
Orkli Sociedad Cooperativa’s sole obligation under this warranty shall be limited to the repair or replacement, at its
option, of any defective part of said product which is the result of defective material and/or defective workmanship of
parts furnished by Orkli Sociedad Cooperativa. This warranty will expire thirty-six (36) months from date of delivery,
and repairs under this warranty shall be at repairs facilities designated by Orkli Sociedad Cooperativa. Transportation
expenses to the repair facility are to be borne by the Purchaser.
The warranty herein is expressly in lieu of any and all other warranties, expressed or implied.
The warranty herein does not apply to, and Orkli Sociedad Cooperativa makes no warranties, expressed or implied,
with respect to any goods which after delivery hereunder have been repaired or altered by anyone other than has been
authorized and approved by Orkli Sociedad Cooperativa, unless, in manufacturer’s reasonable opinion, such repairs are
in no way responsible for the condition complained of.
Customer and Manufacturer agree that customer’s sole remedy for any defects in new goods delivered hereunder,
whether customer’s claim arises under the warranty set forth above, or otherwise, shall be limited to the repair or replacement
at manufacturer’s option within three (3) years after delivery of such goods to the first purchaser, of any defective
goods, of which notice of the defects is given by Customer to Manufacturer immediately after such defect is or ought to
have been discovered and which goods are returned to Manufacturer within ten (10) days after Manufacturer requests
their return for inspection and/or repair or replacement.
