<strong>People's</strong> Watch condemns blast in New Delhi<br />
A Press report was released condemning the bomb blast in Delhi High Court<br />
th<br />
complex on Wednesday the 7 of <strong>September</strong> 2011 in which 10 people died and<br />
many were injured. PW expressed its deepest condolence to the bereaved.. While<br />
condemning this as an atrocious act, Mr.Henri Tiphagne, Executive Director said<br />
that the state should not end with providing compensation for the deceased family<br />
members and medical treatment and rehabilitation of the injured victims, but the<br />
state should start the investigation process and justice must be given which will give<br />
them satisfaction that their beloved one did not die in vain.<br />
Attempt-to-rape case Intervention by PW<br />
A 13 year old boy has been booked for attempting to rape a one-and-a-half year<br />
old baby in Madurai on Friday. The victim identified as Jeya (name changed) a<br />
resident of Muthupatti was allegedly assaulted the girl sexually. The Police rushed<br />
to the spot and saved the baby from the boy.. The victim's parents died a couple of<br />
months ago and was taken care of by her grandmother. When the grandmother<br />
approached the police, they failed to file a case. When the issue came to the<br />
knowledge of PW, Ms.Palaniammal, TNHRP Unit brought it to the knowledge of<br />
the City Police Commissioner Mr.P.Kannappan who ordered the police to register<br />
a complaint. Ms.Palaniammal also said that the local Police wanted to hush up the<br />
issue.<br />

TRAININGS FOR LAWYERS<br />
Legal Services Authority. The meeting was facilited by Senior Advocates in the<br />
Madras High Court, Mr.Henri Tiphagne, Executive Director-PW, the Board<br />
Members of CPSC. All the staff under ESR project participated in this program.
Paramakudi Police Firing Demonstration by PW<br />
th<br />
The 11 of <strong>September</strong>, 2011 marked a scene of violations that is<br />
continuously being probed by political parties, Dalit<br />
organizations, human rights organizations, writers, academics<br />
and several others from Tamil Nadu and from throughout the<br />
country. There were 3 different incidents took place at three<br />
different places. The first police firing that took place was in<br />
Madurai district in a place called Chinthamani wherein nobody<br />
was killed, but two persons were very seriously injured.<br />
Then came the Paramakudi police firing where 6 persons<br />
were shot dead; and after that another police firing that<br />
took place in Ilayankudi that falls within the jurisdiction of<br />
Sivagangai district.<br />
It was in this context that PW had organized an agitation at<br />

Madurai on 14 <strong>September</strong> 2011. Members from Political<br />
parties, Human Rights Activists, NGOs and movements<br />
participated in this mass agitation. The main demand of the agitation was “A re-post mortem should be performed<br />
on all the bodies in the presence of family members and human rights defenders; No high ranking police official<br />
should enter the affected districts of Ramanathapuram, Sivaganga and Tuticorin without the permission of the<br />
District Magistrate; It was pointed out that there were cases of “brutal” police torture of some selected Dalit<br />
activists and Police firing was not preceded by the mandatory lathi charge and use of teargas.<br />
CHRM - PW Participation in Global Warming Seminar<br />
CONFERENCE AGAINST GLOBAL WARMING A mass<br />
rally was conducted and it started from Teppakulam and<br />
ended in Tamukkam Grounds. The rally was followed by<br />
a 3-days program in the Tamukkam ground. The<br />
campaign was organized by Joint Action Committee<br />

<strong>People's</strong> Watch had a stall at the Venue and conducted a<br />
seminar on “Global Warming and Human Rights”. The<br />
<strong>People's</strong> Watch
seminar was falicitated by Mr.Henri Tiphagne, Executive Director-PW, Mr.George Kurien @ Siddharth,<br />
Environmental Activist, Bangalore, Dr.Rajkumar, Huam Rights Activist, Chennai and Mr.Martin, Advocate<br />
from Trichy facilitated the program. All staff Members from PW , CHRM Cadres, General Public and Civil<br />
Society Organisations attended the seminar.<br />

CHRM District Council Meeting was held at Erode and Coimbatore on 8 <strong>September</strong> 2011. Mr.C.J.Rajan,<br />
Director-TNPHR&D and Mr.G.Ganesan, SC- TNPHR&D facilitated the programs and Adv.Nicholas and<br />
Mr.Senthilraja, RHRC coordinated the program.<br />
IHRE - NCPCR IHRE ON RTE -Public Hearing in Erode,<br />
Sivaganga and Vellore Districts in Tamilnadu far behind in<br />
implementing RTE Act<br />
After having participated in the Public hearing, on the<br />
functioning of Government schools in Tamilnadu, jointly<br />
organized by NCPCR and IHRE in Erode, Sivagangai and<br />
Vellore districts, the NCPCR officials complained that<br />
many government schools in TN even lacked toilets and<br />
drinking water, which led to children dropping out of<br />
schools. NCPCR national coordinator for RTE, Ms Kiran<br />
Bhatty, said, “Parents and teachers association meetings<br />
are not organised in many schools. It is compulsory to form school management committees (SMCs) in each<br />
school under the RTE Act.<br />
NCPCR state representative Mr. Henri Tiphagne said in Manamadurai block alone, as many as 40 per cent of<br />
teacher had been appointed on deputation even though they claimed there were only few vacancies. He said<br />
during the social audit, teachers, parents, students and government officials took part with interest. They came<br />
out with solutions for problems such as lack of transportation to reach the school.<br />

Organisations and NGOs. There were 300 people participated in this<br />

Dr.Vasanthi Devi in her address said that the State Government should implement RTE Act 2010 which had<br />
not been implemented till now. According to the Act, a schools management committee should be<br />
constituted in all institutions to manage the schools and ease the burden of CEO who is vested with all<br />
powers and responsibilities. The management committee should include Members from NGOs and parents<br />

230 People from political parties, NGOs, college students, ADW school HRE Teachers, CHRM Members, students<br />
from universities, Madurai corporation school HRE Teachers. Participated in this program.<br />
IHRE organized this program. Dr.Devasahayam facilitated the program.. The Main speakers were Mr.John<br />
Moses, Janata Dal(Secular), Mr.Vijaya Kumar, MUTA, Dr.Vasanthi Devi, Chairperson-IHRE, Mr.Nanmaran,<br />

2011 at Sophia School, Ajmer. The program was coordinated by Ms.Manisha Tak, State Coordinator, IHRE-<br />

Discussion on Uniform Education at Madurai<br />
The education system in the State has worsened from what it was during the 1960s and 70s and there has been<br />
an unseen level of commercialization and caste and class based prejudices in the field of education and that too<br />
in primary education, according to Dr.V.Vasanthi Devi, Chairperson of the Institute of Human Rights Education<br />
(IHRE)<br />
She delivered the special address after releasing the 'Chennai Declaration.' at Tamil Nadu Theological Seminary,<br />
Madurai. She also said that Samacheer Kalvi only serves to bring a common syllabus for schools, while the<br />
equality in education is missing<br />
She shared that the Chennai declaration is an outcome of a consultative meeting held in Chennai where experts<br />
in the field of education shared their views on the efforts to be taken by the Government towards the common<br />
education system in Tamilnadu. The discussion also covered the “predatory” fee system in schools and the<br />
implementation of the Right to Education Act in the state. Dr.V.Vasanthi Devi stated Social audits and public<br />
hearings on the school management committees have revealed the fact that most schools in some parts of Tamil<br />
Nadu lack basic amenities like drinking water and toilets. The main demand is to insist on Common school<br />
system in Tamilnadu.<br />
Dr. Vasanthi Devi released the document and the first copy was received by N.Nanmaran former MLA, Madurai<br />
East. The film “Enakku Illaiya Kalvi” was screened which portrayed the condition of Tamil Nadu's government<br />
schools and talks about the existing reality of education as discriminatory and prohibitory to the large sections<br />
of the masses.<br />
Seminar on HRE in ANJA College, Sivakasi<br />
The ANJA College, Sivakasi conducted a seminar on “Human<br />
Rights Education a Holistic development of Humanity”.on 22<br />
<strong>September</strong> 2011. Mr.Baskaran, Principal, ANJA College presided<br />
over the function. Mr.Henri Tiphagne, Executive Director-PW<br />
was one of the Guests invited for the Seminar. He insisted the fact<br />
that there were sexual torture still happening in schools. Every<br />
human being take steps to stop this inhuman attitude. Human<br />
rights violations against women is prevailing in every family and we must take efforts to abolish them. Human<br />

Social Impact Award to PW<br />
<strong>People's</strong> Watch was conferred with Social Impact Award by Times of India in <strong>September</strong> 2011 for creating<br />
and propagating a three-year module on human rights for school children in several states in India.<br />

ASER Master training was held from 19 to 22<br />
<strong>September</strong> 2011 at ICSA Centre, Chennai. The Training was<br />
organized by AID India. 60 Members participated in this program. The purpose of this program was to discuss on<br />
conducting survey on the educational status of children in rural areas. Dr.Vasanthi Devi, Dr.S.S.Rajagopalan<br />
and Dr..Balaji Sampath, Secretary, AID India were the Chief Guests.<br />

Villages and also to study about the infrastructural facilities in the schools.<br />

Discussion Forum on “Abolish Death Penalty” was held at PW Campus on 21 August 2011. Dr.Arulraj, Deputy<br />
Executive Director presided over the meeting. Mr.Shunmugavelu, State Coordinator, CHRM coordinated the<br />
program. Advocate Pandiarajan, Mr.Peter, Regional Coordinator-CHRM shared their views on Death Penalty.<br />
Mr.Thiyagu, General Secretary, Tamil Thesiya Viduthalai Iyakkam was the Chief Guest. In his address, he<br />
pointed out that Indian judicial system resembles the same as in United Kingdom. But in UK, the death penalty is<br />
completely abolished. But in India, this continues. Death Penalty is against the livelihood of humanity. In many<br />
western countries, Death Penalty has been abolished. In some countries, they have specific reason for<br />
implementing this punishment. Whatever be the reason, it is a question whether this has stopped terrorism or<br />
other illegal activities. He also shared that according to the 1978 Criminal Act, the Supreme Court Judges can<br />
pass judgement only in rare cases. But what are rare cases has not been mentioned in this act. .He concluded his<br />
speech saying that Death Penalty is a threat to humanity and this should be complete abolished.<br />
Discussion Forum on “The Death of Merit”<br />
A Discussion Forum on “The Death of Merit” was conducted by <strong>People's</strong> Watch on 2<br />
<strong>September</strong> 2011 at PW<br />
Office, Madurai. A documentary film explaining the status of Dalit students committing suicide in Higher<br />
educational Institutions was screened. Mr.Anoop Kumar, the Director of the Film from Mumbai was the<br />
Resource Person. He narrated through the film several incidents of Dalit students committing suicide in the<br />
Institutions and the reason ranging from 'could not cope up with rigorous academic pressure' to 'personal<br />
reasons'. But in reality, the sole reason was caste discrimination. Such attitude of caste discrimination should<br />
stop with our generation. Mr.Henri Tiphagne, Executive Director-PW said that the documentary could be<br />
distributed to the Office of Equal Opportunity established in about 200 colleges in Tamilnadu through which<br />
the film would catch the attention of students and help Dalit students to open up.<br />

Annual Book Fair at<br />

Tamukkam grounds, Madurai from 2 to 11<br />
<strong>September</strong> 2011. <strong>People's</strong> Watch participated in the<br />
Book Fair and released 4 Books on Human Rights. The<br />
4 books “Human Rights in Tamilnadu-2009, Human<br />
Rights in Tamilnadu-2010, “Manitha Urimaikalai<br />
Kondaduvom” and “Salva Judum Puratchikara Theerppu were released by <strong>People's</strong> Watch. Dr.Devasahayam<br />
presided over the Book release function. All major publishers participated in this Book Fair.<br />
RCTV-Illegal detention of Kal Oddars PW Intervention<br />
Four persons belonging to the Kal Oddar community, who were illegally detained by the police recently, were<br />
released without any charges on 7<br />
th<br />
August 2011. Despite the pleas and cries of the women folk, the police<br />
officials forcibly took away Radhakrishnan, Santhosh, Deva (aka) Velu and Ayyappan, who is a minor, to Karimedu<br />
Police Station where their photographs were taken as ordered by Inspector Vivekananda and SubInspector Seeni.<br />
They were threatened that they would be charged with at least five cases each and will be branded as a convict for<br />
the rest of their lives. The Sub-Inspector Seeni verbally abused them and during the raid Radhakrishnan, an<br />
asthma patient, was severely manhandled.<br />
The Inspector also claimed that the detention was an order from the Superintendent of Police which turned out<br />
to be a false as clarification was sought from the SP regarding this remark.<br />
Regarding the illegal detention, Pradeep, Helpline Coordinator at <strong>People's</strong> Watch, who helped the victims with<br />
free legal aid commented, “Though the Kal Oddars still come under the Habitual Offenders Act, the basic<br />
guidelines laid by the Supreme Court in DK Basu case for arrest were not followed by these police officials.<br />
Also, it is suspected that the City Police are involved in this issue as the police van that was used for the arrest<br />
belonged to them.”<br />

program was organized by <strong>People's</strong> Watch and DASHRA - Dalit Association for Social and Human Rights<br />
Awareness, Bihar in collaboration with Bihar State Legal Services Authority and District Legal Services<br />
Authority (Gaya and East Champaran Districts). Mr.Henri Tiphagne, Executive Director-<strong>People's</strong> Watch<br />

National Training Program on DHRM<br />
National Program on Dalit Human Rights Monitoring was<br />
conducted at Madurai. Superindentent of Police Mr.Esra Cork<br />
inaugurated the program. Mr.Henri Tiphagne, Executive<br />
Director-<strong>People's</strong> Watch participated in this program. The event<br />
was organized by Dalit Foundation.<br />
INTERNATIONAL PROGRAMS OF ED<br />
1st Biennial Conference of the Asia Pacific Forum of National Human Rights Institutions,<br />
7 - 8 <strong>September</strong> 2011, Bangkok, Thailand<br />
Human rights defenders at the Asian NGO Network on National Human Rights Institutions (ANNI) Regional<br />
Conference on the Engagement with the Asia-Pacific Forum of National Human Rights Institutions (APF) on 5-6<br />
<strong>September</strong> 2011, under took a review of the Kandy Program of Action: Co-operation between National<br />
Institutions and Non Governmental Organizations 1999 (KPA) after twelve years of its existence.<br />
The review was amidst 45 representatives of civil society organizations drawn from 20 different organizations<br />
in the Asia Pacific region together with representatives of international human rights organizations, including<br />
the International Service for Human Rights, and observers from the national human rights institutions (NHRIs)<br />
of three countries present throughout.<br />
The review commenced with two presentations being made, the first on the KPA and the second on the role of<br />
NHRIs in the UN human rights mechanisms<br />

One day seminar on Right to Education Act was held at Arepalayam Government Middle school near<br />

Sathiamangalam, Erode district. The seminar was held on 16 <strong>July</strong> 2011. Mr.Henri Tiphagne, State Representative<br />
for NCPCR facilitated the program. Mr.Chellapandi, IHRE coordinated the program. The meeting was jointly<br />
organized by NCPCR and IHRE.<br />

Kalayarkoil blocks in Sivagangai District was<br />

conducted on 12 and 13 <strong>July</strong> 2011. Mr. Henri Tiphagne,<br />
Special Representative of RTE in Tamil Nadu of the National<br />
Commission for Protection of Child Rights (NCPCR) and<br />
IHRE Team members organised and participated in the<br />
program. The Government officials from the educational<br />
and other department officials participated in the program.<br />

Regional Consultation Meeting<br />
As per the National Commission for Protection Child Rights (NCPCR) recommendation the State Representative<br />
for RTE in Tamilnadu Mr.Henri Tiphagne Executive Director of <strong>People's</strong> Watch conducted regional<br />
consultation meetings for Nagapattinam, Tanjore, Thiruvarur, Hosur ,Cuddalore, Erode and Trichy Districts.<br />
This is the first time where the National Commission for the Protection of Child Rights had appointed a Nongovernmental<br />
organisation as a Special Representative.<br />
Since our main responsibility is to monitor the functioning of the RTE with particular reference to violence<br />
against children in schools, we gathered the civil society and particularly those who are engaged in the<br />
protection and promotion of the rights of the child in monitoring RTE 2009 in Tamil Nadu. Members of<br />
various organisations came forward and took the responsibility for monitoring the RTE Act in their nearby<br />
schools and they have also promised among themselves that they will elect representatives among them who<br />
will act accordingly. Some of the organisations joined hands with other such organisations to carry out the<br />
<strong>People's</strong> Watch
esponsibilities taken by them. It was really a great success on<br />
our part to create awareness about RTE Act and monitor its<br />
implementation through the various civil society organisations<br />
and NGOs<br />
ageing 6-14. The National commission for Protection of Child<br />
Rights is the sole authority to investigate into the matter and<br />
function as a civil court where there raise a question of<br />
violation of child right, mainly cases of corporal punishments.<br />
For the same we cannot work all the way from Delhi and look<br />
into each and every case, so the commission has appointed<br />
<strong>People's</strong> Watch to investigate and send them the reports on<br />
the issues and we will keep a check on them from Delhi and<br />
the commission itself will file a case on behalf of the child and<br />
fight for its rights in the court.<br />

The RTE Act has been implemented since one year but even then<br />
it is not implemented properly is a saddening fact. But the Right<br />
to Education is not a mere right but has become a fundamental<br />
right that vested in Article 21(a) of our constitution. The main<br />
aim of the RTE Act is to give compulsory education for children<br />
