Second Offense<br />

A second violation of the drug and alcohol policy at any time while the student is enrolled at <strong>Saint</strong><br />

<strong>Viator</strong> <strong>High</strong> <strong>School</strong> may result in an immediate Disciplinary Review Board conference for a<br />

consideration of expulsion.<br />

DISCIPLINARY REVIEW PROCESS<br />

Disciplinary Review Board<br />

The Disciplinary Review Board is appointed by the President and chaired by a member of the<br />

Clerics of St. <strong>Viator</strong> on the faculty. The Disciplinary Review Board may conduct disciplinary<br />

review conferences where any student may have committed gross misconduct, chronic violations of<br />

any combination of Level I, II, and/or III rules, or serious violations of Level II or III rules. The<br />

Disciplinary Review Board ordinarily conducts a conference in cases of Level IV violations.<br />

It shall be sufficient and necessary that at least five (5) of the seven (7) Disciplinary Review Board<br />

members be present to conduct the conference and render a decision in each case submitted to the<br />

Board. One of the Deans of Students shall present the case before the Board and not act as a voting<br />

member. The other Dean of Students shall act as a voting member of the Board.<br />

Each Disciplinary Review Board member reserves the right to recuse himself/herself, at his/her sole<br />

discretion, from a particular case submitted to the Board. If the student and/or his/her<br />

parent(s)/guardian(s) should request that a Board member recuse him/herself, it shall remain the<br />

President’s decision, at his sole discretion, whether to recuse the member of the board.<br />

Charge of Misconduct<br />

Where any such misconduct or violation shall come to the attention of the President or Dean of<br />

Students directly, indirectly, or by means of a disciplinary referral form, after investigation, he/she<br />

may require that the student meet with the Disciplinary Review Board.<br />

Evidence of Charge<br />

The Dean of Students under the direction of the President will investigate and gather the evidence<br />

required to validate the charge of gross misconduct or serious or chronic violations of the <strong>School</strong>’s<br />

rules against the student. Once he/she completes the investigation, the Dean of Students shall then<br />

make a recommendation to the President as to the submission of the confirmed charge(s) to the<br />

Disciplinary Review Board that will be based upon the criteria noted in the “Disciplinary Review<br />

Board” section above.<br />

Notice of Charge<br />

After the President has validated the charge(s) and determined that the charge(s) are submissible to<br />

the Disciplinary Review Board, the Dean of Students shall submit the charge(s) in writing to the<br />

Board. The Dean of Students shall then promptly notify the parent(s)/guardian(s) by phone and<br />

schedule a conference for the family with the Disciplinary Review Board to take place in a timely<br />

fashion. The President will place the student on out-of-school suspension pending the conference<br />

with and decision of the Disciplinary Review Board.<br />
