2. The penitentiary system shall comprise treatment of prisoners the essential<br />

aim of which shall be their re<strong>for</strong>mation and social rehabilitation. Juvenile<br />

offenders shall be segregated from adults and be accorded treatment<br />

appropriate to their age and legal status.<br />

Notwithstanding the <strong>Philippine</strong> state’s obligation to comply with its treaty obligations<br />

in good faith pursuant to Article 26 of the Vienna Convention on the Law of Treaties, the<br />

President of the <strong>Philippine</strong>s criminally neglects and instead conspiratorially acquiesces,<br />

tacitly consents, and implicitly authorizes the wide scale jailing of children with adult<br />

crime suspects in police headquarters, stations, and substations, all over the country,<br />

save <strong>for</strong> Cebu City, and prior to their transfer to detention facilities controlled by the<br />

Bureau of Jail Management and Penology, by virtue of commitment orders issued by<br />

backlog-ridden and snail-paced courts, in contravention of Articles 10(1), 10(2)(b), and<br />

10(3), in relation to <strong>Committee</strong> General Commend 21.<br />

During police custody, child prisoners, especially girls who are pregnant, face greater<br />

risks of being raped, sodomized, tortured, tattooed, and abused.<br />

Law en<strong>for</strong>cers also routinely violate their right to be in<strong>for</strong>med of their constitutional<br />

right to remain silent and to avail of the services of an independent and competent<br />

counsel of their own choice and to be provided with one by their police captors since<br />

they could not af<strong>for</strong>d the services of such counsel pursuant to Section 12, Article III of<br />

the 1987 <strong>Philippine</strong> Constitution, 37 in violation of Covenant Article 9. They also face<br />

greater risks of being tortured and <strong>for</strong>ced to confess to crime by their police captors,<br />

beaten up and tattooed by adult crime suspects who belong to tattoo-sporting gangs,<br />

sodomized and raped, and subjected to other despicable <strong>for</strong>ms of indignities, in<br />

contravention of Covenant Article 7.<br />

The fact that child prisoners are subjected to this <strong>for</strong>m of Covenant violations is<br />

evidenced by the following duly certified documents obtained by counsel from the courts<br />

that <strong>for</strong>med part of the evidence submitted to, but unduly shunned, by the so-called<br />

Office of the Ombudsman in its ef<strong>for</strong>ts to shield and protect the President and state<br />

functionaries from any culpability <strong>for</strong> these treaty violations:<br />

‣ Annexes “A” to “A-2” to Ombudsman complaint – Criminal In<strong>for</strong>mation against Victim<br />

‣ Annex “A-3” to Ombudsman complaint – <strong>Philippine</strong> National Police letter addressed<br />

to the Department of Justice concerning Victim 4, whose origin shows the place of<br />

detention of Victim 4, a prison swarming with adult crime suspects<br />

‣ Annex A-4 to Ombudsman complaint – commitment order issued by the court<br />

directing the <strong>Philippine</strong> National Police to transfer the custody of Victim 4 , proving<br />

that the police, contrary to Article 191 of the Child and Youth Welfare Code<br />

(Presidential Decree 603) has been detaining children in police jails swarming with<br />

adult crime suspects<br />

‣ Annexes B and B-1 to Ombudsman complaint – the sworn statement of the<br />

complainant against Victim 1 showing the date of incident that gave rise to the<br />

detention of Victim 1 at the PNP jail stated in this document, where adults were<br />

actually locked up<br />

‣ Annex B-2 to Ombudsman complaint –- PNP referral letter to the Department of<br />

Justice, showing the place of detention of Victim 1, which is actually a police jail<br />

swarming with adult crime suspects<br />
