including “the removal of obstacles to the equal enjoyment each of such<br />

rights”;<br />

4. Require the President to immediately direct the Secretary of Interior and<br />

Local Governments and the Chief of the <strong>Philippine</strong> National Police to<br />

immediately and unconditionally release all children, especially girls,<br />

languishing in police jails to the care and custody of the Department of Social<br />

Welfare and Development, without need of any court order, pursuant to<br />

Paragraph 3 of <strong>Committee</strong> General Comment 28, Covenant Article 2(3)(a),<br />

Article 10(2)(b), and Article 10(3), and Paragraph 13 of <strong>Committee</strong> General<br />

Comment 21;<br />

5. Require the President to permanently cease and desist from further jailing<br />

children with adult crime suspects, under any and all circumstances, pursuant<br />

to Paragraph 3 of <strong>Committee</strong> General Comment 28, Article 2(3)(a), Article<br />

10(2)(b), Article 10(3), and Paragraph 13 of <strong>Committee</strong> General Comment<br />

21;<br />

6. Require the President to order the investigation and prosecution in good faith<br />

of law en<strong>for</strong>cers, their superiors, the Chief of the <strong>Philippine</strong> National Police,<br />

and the Secretaries of the Department of Justice and of the Department of<br />

Interior and Local Governments <strong>for</strong> their culpability <strong>for</strong> the wide scale violation<br />

of the Covenant provisions in accordance with Article 2(3)(a) and Article 9(1)<br />

of the Covenant, specifically in relation to their command responsibility,<br />

based on the Tadic, Celebici, Pinochet, Yamashita, and Nuremberg<br />

doctrines, <strong>for</strong> the widespread violation of Article VI, Section 10(a) of the<br />

Special Child Protection Act (Republic Act 7610), and/or Section 3(e) of the<br />

Anti-Graft and Corrupt Practices Act (Republic Act 3019), in order to destroy<br />

the wall of impunity and erect the barrier of non-recurrence of these Covenant<br />

violations, and pursuant to the <strong>Committee</strong> Concluding Observations on the<br />

<strong>Philippine</strong>s, under Section 11, paragraph 2;<br />

7. Require the President to ensure that all past and present victims of police<br />

child detention and the mixing up of children with adult crime suspects be<br />

provided with the necessary psychosocial and healing assistance and<br />

services according to Article 2(3)(a) and Article 9(1) of the Covenant;<br />

8. Require the President to compensate all past and present child prisoners on<br />

account of the egregious violations of the <strong>Philippine</strong> state’s treaty<br />

commitments in accordance with Article 2(3)(a) and Article 10(1), as<br />

elucidated in paragraph 3 of <strong>Committee</strong> General Comment 21, and Articles 7,<br />

9(1), 10(2)(b), and 10(3),.specifically with reference to Section 12(4), Article<br />

III of the 1987 <strong>Philippine</strong> Constitution, 39 requiring compensation <strong>for</strong> victims of<br />

torture, cruel, inhuman, and degrading treatment and punishment, in<br />

accordance with paragraph 9 of Consideration of the Merits in the <strong>Committee</strong><br />

Views in the case of Ramil Rayos v. <strong>Philippine</strong>s; 40 ;<br />

9. Other just and equitable remedies are likewise prayed <strong>for</strong>.<br />
