1. In the 2008 <strong>Annual</strong> <strong>Report</strong>, the total pending cases on Dec. 31, 2008, was 892. <strong>The</strong> total<br />
should have been 893 cases, as Case No. 2008-1942 was mistakenly not included in the count of<br />
pending cases.<br />
2. This category includes cases in which the appellant sought jurisdiction as both a discretionary<br />
appeal and a claimed appeal of right.<br />
3. One death penalty case was filed in 2009. It was an appeal from the court of common pleas in<br />
which the death penalty was imposed for an offense committed on or after Jan. 1, 1995.<br />
