(b) Those registrations renewed 30 days after the deadline must be<br />

accompanied by the delinquency fee required in section 1392.1.<br />

(c) A psychological assistant who has been registered with the<br />

board but whose registration has not been renewed by the employer<br />

shall not function as a psychological assistant.<br />

(d) A psychological assistant employed and registered by more<br />

than one employer shall have his or her registration renewed by each<br />

employer.<br />

(e) Those registrations not renewed within 60 days after the<br />

renewal date shall become void and a new application for registration<br />

shall be submitted by the employer.<br />

Article 6. Fees<br />

§ 1392. Psychologist Fees.<br />

(a) The application fee for a psychologist is $40.00.<br />

(b) The fee for the <strong>California</strong> Jurisprudence and Pr<strong>of</strong>essional<br />

Ethics Examination is $129.00.<br />

(c) An applicant taking or repeating either licensing examination<br />

shall pay the full fee for that examination.<br />

(d) The initial license fee and the biennial renewal fee for a<br />

psychologist are $400.00. except that if an initial license will expire<br />

less than one year after its issuance, then the initial license fee is an<br />

amount equal to 50 percent <strong>of</strong> the renewal fee in effect on the last<br />

regular renewal date before the date on which the license is issued.<br />

(e) The biennial renewal fee for an inactive license is $40.00.<br />

§ 1392.1. Psychological Assistant Fees.<br />

(a) The application fee for registration <strong>of</strong> a psychological assistant<br />

which is payable by the supervisor is $40.00.<br />

(b) The annual renewal fee for registration <strong>of</strong> a psychological<br />

assistant is $40.00.<br />

(c) The delinquency fee for a psychological assistant is $20.00.<br />

Restoration <strong>of</strong> Suspended or Revoked<br />

Licenses<br />

§ 1393. Requirements for Psychologists on Probation.<br />

Each psychologist who has been placed on probation by the board<br />

shall be subject to the board’s probation program and shall be required<br />

to fully cooperate with the assigned probation monitor.<br />

§ 1394. Substantial Relationship Criteria.<br />

For the purposes <strong>of</strong> denial, suspension, or revocation <strong>of</strong> a license<br />

or registration pursuant to Division 1.5 (commencing with Section<br />

475) <strong>of</strong> the code, a crime or act shall be considered to be substantially<br />

related to the qualifications, functions or duties <strong>of</strong> a person holding a<br />

license or registration under the Psychology Licensing Law (Chapter<br />

6.6 <strong>of</strong> Division 2 <strong>of</strong> the Code), if to a substantial degree it evidences<br />

present or potential unfitness <strong>of</strong> a person holding a license or<br />

registration to perform the functions authorized by his or her license<br />

or registration or in a manner consistent with the public health, safety,<br />

or welfare. Such crimes or acts shall include but not be limited to those<br />

involving the following:<br />

(a) Violating or attempting to violate, directly or indirectly, or<br />

assisting in or abetting the violation <strong>of</strong> or conspiring to violate any<br />

provision or term <strong>of</strong> that law.<br />

(b) Conviction <strong>of</strong> a crime involving fiscal dishonesty.<br />

§ 1395. Rehabilitation Criteria for Denials and<br />

Reinstatements.<br />

When considering the denial <strong>of</strong> a license or registration under<br />

section 480 <strong>of</strong> the code, or a petition for reinstatement under section<br />

11522 <strong>of</strong> the Government Code, the board in evaluating the<br />

rehabilitation <strong>of</strong> the applicant and his or her present eligibility for a<br />

license or registration, will consider the following criteria:<br />

(1) The nature and severity <strong>of</strong> the act(s) or crime(s) under<br />

consideration as grounds for denial.<br />

(2) Evidence <strong>of</strong> any act(s) committed subsequent to the act(s) or<br />

crime(s) under consideration as grounds for denial which also could<br />

be considered as grounds for denial under section 480 <strong>of</strong> the Code.<br />

(3) The time that has elapsed since commission <strong>of</strong> the act(s) or<br />

crime(s) referred to in subdivision (1) or (2).<br />

(4) The extent to which the applicant has complied with any terms<br />

<strong>of</strong> parole, probation, restitution, or any other sanctions lawfully<br />

imposed against the applicant.<br />

(5) Evidence, if any, <strong>of</strong> rehabilitation submitted by the applicant.<br />

§ 1395.1. Rehabilitation Criteria for Suspensions or<br />

Revocations.<br />

When considering the suspension or revocation <strong>of</strong> a license or<br />

registration on the ground that a person holding a license or<br />

registration under the Psychology Licensing Law (chapter 6.6 <strong>of</strong><br />

division 2 <strong>of</strong> the code) has been convicted <strong>of</strong> a crime the board in<br />

evaluating the rehabilitation <strong>of</strong> such person and his or her eligibility<br />

for a license or registration will consider the following criteria:<br />

(1) Nature and severity <strong>of</strong> the act(s) or <strong>of</strong>fense(s).<br />

(2) Total criminal record.<br />

(3) The time that has elapsed since commission <strong>of</strong> the act(s) or<br />

<strong>of</strong>fense(s).<br />

(4) Whether the licensee or registration holder has complied with<br />

any terms <strong>of</strong> parole, probation, restitution or any other sanctions<br />

lawfully imposed against such person.<br />

(5) If applicable, evidence <strong>of</strong> expungement proceedings pursuant<br />

to section 1203.4 <strong>of</strong> the Penal Code.<br />

(6) Evidence, if any, <strong>of</strong> rehabilitation submitted by the licensee or<br />

registration holder.<br />

Article 8.<br />

Rules <strong>of</strong> Pr<strong>of</strong>essional Conduct<br />

§ 1396. Competence.<br />

A psychologist shall not function outside his or her particular field<br />

or fields <strong>of</strong> competence as established by his or her education, training<br />

and experience.<br />

§ 1396.1. Interpersonal Relations.<br />
