(d) The licensed correctional treatment center shall furnish other<br />
pertinent information related to such occurrences as the local health<br />
<strong>of</strong>ficer or the Department shall require.<br />
(e) All reports required in this Section shall be retained on file by<br />
the licensed correctional treatment center for three (3) years.<br />
(f) Every fire or explosion that occurs in or on the premises shall<br />
be additionally reported immediately to the local fire authority, or in<br />
the areas not having an organized fire service, to the <strong>State</strong> Fire<br />
Marshal.<br />
(g) The local health <strong>of</strong>ficer <strong>of</strong> the county to which an<br />
inmate–patient is to be released shall be notified at least one day in<br />
advance before an inmate–patient on any tuberculosis medication is<br />
released from the correctional facility.<br />

§ 79789. Patient Transfer.<br />
(a) The licensee shall maintain written transfer agreements with<br />
one or more general acute care hospitals to make the services <strong>of</strong> those<br />
facilities accessible and to facilitate the transfer <strong>of</strong> patients. Complete<br />
and accurate patient information, in sufficient detail to provide for<br />
continuity <strong>of</strong> care, shall be transferred with the patient at the time <strong>of</strong><br />
transfer. A copy <strong>of</strong> the current agreement shall be available for review<br />
by the Department.<br />
(b) No patient shall be transferred or discharged for purposes <strong>of</strong><br />
effecting a transfer from a facility to another facility, unless<br />
arrangements have been made in advance for admission to such a<br />
health facility.<br />
(c) When a patient is transferred to another facility, the following<br />
shall be entered in the patient health record:<br />
(1) The date, time, condition <strong>of</strong> the patient and a written statement<br />
<strong>of</strong> the reason for the transfer.<br />
(2) Documentation that the receiving facility has been informed <strong>of</strong><br />
the patient’s transfer.<br />

§ 79791. Personnel Policies.<br />
(a) Each correctional treatment center shall adopt and implement<br />
written personnel policies concerning qualifications, responsibilities,<br />
and conditions <strong>of</strong> employment for each classification employed<br />
which shall be available to all personnel. Such policies shall include<br />
but not be limited to:<br />
(1) Hours <strong>of</strong> work.<br />
(2) A plan for orientation for all new staff members that shall<br />
ensure that all new staff providing program services shall receive at<br />
least 20 hours <strong>of</strong> orientation and training within 14 days <strong>of</strong><br />
employment. Staff attendance shall be documented. Initial training<br />
shall include, but not be limited to, the following:<br />
(A) Orientation to all policies, procedures and objectives <strong>of</strong> the<br />
facility.<br />
(3) A plan for at least annual evaluation <strong>of</strong> employee performance.<br />
(b) Provision <strong>of</strong> a continuing in–service education program<br />
designed to improve patient care and employee efficiency. This<br />
training shall be in compliance with Section 79797 <strong>of</strong> this Chapter. All<br />
staff members shall attend, and attendance shall be documented.<br />
(c) Personnel policies shall require that employees and other<br />
persons working in or for the facility familiarize themselves with the<br />
<strong>California</strong> Code <strong>of</strong> Regulations, Title 22, pertaining to correction<br />
treatment centers and such other regulations as are applicable to their<br />
duties.<br />
(d) The facility shall recruit qualified personnel.<br />
(e) If language or communication barriers exist between facility<br />
staff and patients, arrangements shall be made for interpreters or for<br />
the use <strong>of</strong> other means to ensure adequate communications between<br />
patients and personnel.<br />
(f) All correctional treatment center staff shall be subject to the<br />
reasonable application <strong>of</strong> security procedures necessary for the<br />
operation <strong>of</strong> the jail or prison. Written policy and procedures<br />
governing the application <strong>of</strong> security procedures to correctional<br />
treatment center programs and staff shall be developed and adopted<br />
by the jail or prison administrator with input from the correctional<br />
treatment center administrator or director. Correctional treatment<br />
center staff shall not be primarily responsible for the enforcement <strong>of</strong><br />
security policies or procedures.<br />

§ 79793. Employee Personnel Records.<br />
(a) All facilities shall maintain personnel records <strong>of</strong> all employees.<br />
Such records shall be retained for at least three (3) years following<br />
termination <strong>of</strong> employment.<br />
(b) The record shall include the employee’s full name, Social<br />
Security number, the license or registration number, if any, a brief<br />
resume <strong>of</strong> experience, employment classification, date <strong>of</strong> beginning<br />
employment and date <strong>of</strong> termination <strong>of</strong> employment.<br />
(c) Records <strong>of</strong> hours and dates worked by all employees during at<br />
least the most recent six–month period shall be kept on file at the place<br />
<strong>of</strong> employment.<br />

§ 79795. Employee Health Examinations and Health Records.<br />
(a) A health examination, performed by a person lawfully<br />
authorized to perform such an examination shall be performed as a<br />
prerequisite for employment within ninety (90) days prior to<br />
employment or within one (1) week after employment. Written<br />
examination reports, signed by the person performing the<br />
examination, shall verify that employees are able to perform assigned<br />
duties and do not have any health conditions that would create a<br />
hazard for the employee, fellow employees, patients or visitors.<br />
(b) The initial health examination shall include a tuberculin skin<br />
test using the Mantoux method using a 5 Tuberculin Unit dose <strong>of</strong><br />
Purified Protein Derivative (PPD) stabilized with Tween–80, the<br />
result <strong>of</strong> which is read and recorded in millimeters <strong>of</strong> induration. If the<br />
result is positive, a chest film shall be obtained. A tuberculin skin test<br />
need not be done on a person with a documented positive reaction to<br />
PPD but a baseline chest X–ray shall be obtained.<br />
(1) Policies and procedures that address the identification,<br />
employment utilization and medical referral <strong>of</strong> persons with positive<br />
skin tests, including those who have converted from negative to<br />
positive, shall be written and implemented.<br />
(2) An annual skin test for tuberculosis shall be performed on those<br />
individuals with a previously documented negative tuberculin skin<br />
test. If an individual with a previously documented negative skin test<br />
has a subsequent positive reaction, a chest X–ray shall be obtained.<br />
(c) Employee health records shall be maintained by the facility, and<br />
shall include the records <strong>of</strong> all required health examinations. Such<br />
records shall be kept for a minimum <strong>of</strong> three (3) years following<br />
termination <strong>of</strong> employment.<br />

§ 79797. Staff Development.<br />
(a) Each correctional treatment center shall have an ongoing<br />
educational program planned and conducted for the development and<br />
improvement <strong>of</strong> necessary skills and knowledge for all facility<br />
personnel. Each program shall include but not be limited to:<br />
(1) Orientation <strong>of</strong> all newly employed staff to all appropriate<br />
facility policies and procedures and specific job requirements.<br />
(2) Prevention and control <strong>of</strong> infections.<br />
(3) Fire prevention and safety.
