TENDER CALL NOTICE<br />

CHROME ORE (LUMPS/CHIPS)<br />

Sealed quotations are invited for sale of various grades of Chrome Ore (lumps & chips) lying<br />

at Bangur mines of OMC Ltd. at Bangur Region, in Keonjhar district, (Orissa) subject to the following<br />

terms and conditions. The bidders are required to submit their sealed quotations on 03.03.2009 by<br />

1 P.M. in the Tender Drop Box in Sales & Marketing Section, OMC, Bhubaneswar. The sealed<br />

quotations are required to be submitted in two separate sealed envelopes as Technical bid envelope<br />

and Price bid envelope in the prescribed format.<br />

Technical bid: The technical bid containing the Technical Bid format duly filled in along with<br />

Price Bid: Price bid shall comprise of the price quoted per WMT by the tenderer for each<br />

desired item only in the prescribed format<br />

The entire information including the technical bid and price bid should be type written (except<br />

signature). Any deviation from the above in submission of bids , the same will be subject to<br />

rejection. Both the technical bid and price bid will be opened in presence of the participants or their<br />

authorised representatives. The schedule for opening of Tender as follows:<br />

Tender for part quantity against any desired item shall not be accepted and the entire bid of<br />

the agency shall be rejected.<br />

2: INSPECTION: The interested bidders are advised for inspection of chrome ore Lumps and<br />

Chips<br />

(for which they are interested) lying at Bangur Mines prior to submission of their<br />

tender / bids. No complaint regarding quality of the material shall be entertained by the OMC<br />

Ltd. after execution of the contract for sale.<br />

3; ELIGIBILITY: Only end users producing Ferro Chrome and refractory finished<br />

products in their plant shall participate. This tender is not applicable for traders, beneficiation<br />

units / processing units. No lease holders {including lessees ( individual/Company) ,<br />

companies under the same group of the lessees or associates, subsidiary company or any<br />

company where at least one Director or share holder of substantial quantity, is common<br />

between the lessee and the other company} shall get chrome ore from OMC except against<br />

specific assurance of the State Govt. through MoU.<br />

4: EARNEST MONEY DEPOSIT (EMD): The bidder has to deposit EMD in shape of DD for<br />

each desired item as at clause - 1 separately drawn on any Nationalised / Scheduled Bank<br />

operating at Bhubaneswar in favour of OMC Ltd., Bhubaneswar, payable at Bhubaneswar. No<br />

interest shall be paid for EMD/DD. EMD has to be submitted separately for each item of<br />

chrome ore along with the technical bid in order to facilitate scrutiny and quick disposal of<br />

EMD amount to the unsuccessful bidders. In the event, the H1 bidder fails to lift the allotted<br />

quantity against each item of the above tender participation in schedule time in conformity<br />

with the tender norms, the EMD deposited with OMC by the buyer will be forfeited. Return of<br />

EMD shall be considered only after the bidder lifts the entire available quantity limiting to<br />

tendered quantity as certified by the Regional Manager, Bangur. The bidder will put the seal<br />

of Company at the rear side of each DD deposited towards EMD. In order to facilitate refund<br />

of EMD by hand to the unsuccessful bidders on the date of opening of tender the bidders may<br />

submit an authorization letter through the bearer to take back the DD of unsuccessful bidders<br />

by hand, Otherwise, the EMD of unsuccessful bidders shall be refunded within 30 days after<br />

opening of tender.


5: VALIDITY OF OFFER. The bidders may keep their offer valid at least for 30 days from the<br />

opening of tender.<br />

6: PLACE & MODE OF DELIVERY: Ex-Chromite Mines at Bangur Chrome Ore Mines of OMC<br />

Ltd. at Bangur. The buyer shall keep the seller indemnified for any liability which may arise<br />

during the contract or thereafter on account of loading, transport and such other matters as<br />

are thereto to their exercise.<br />

As per Environment Protection Act – 2006 and guideline the buyer should ensure that the<br />

loaded trucks are to be covered with tarpaulin during transport.<br />

7: SUPPLY PERIOD: 3 (three) months from the date of allotment.<br />

8: PAYMENT TERMS: The buyer has to lift the material (a) against advance through DD /<br />

Bankers cheque of Nationalised / Scheduled Bank duly approved by concerned R.M., Bangur<br />

as per prevailing sales practices and procedures of OMC. The payment for lifting of material /<br />

ore has to be made at Regional Office, Bangur.<br />

(b) Direct Credit to OMC Bank Account operating at Anandpur/Bangur.<br />

(c) LC at sight . However, 1% of the material cost shall be charged for LC processing.<br />

9: SAMPLING & ANALYSIS Sampling & Analysis shall be carried out by a reputed public<br />

analyst. The report of public analyst will be binding on both buyer and seller. 50% of the<br />

analysis charges will be borne by the buyer. The buyer may depute its representative for<br />

supervision of sampling & analysis and stock of ore to be supplied to the buyer to avoid any<br />

complicacy regarding quality and physical specification during the process. The responsibility<br />

of OMC Ltd. ceases once the product is loaded in to the carrier and no complain in this regard<br />

shall be entertained.<br />

10. PRICE: The buyer has to quote the price per WMT (Wet metric tonne) on ex-mines<br />

basis for each desired item (Clause – 1) separately, including royalty. The price may be<br />

offered on percent of Cr 2 o 3 basis and for unit scale fraction prorate. OMC management<br />

reserves the right to either accept the quoted price or fix a suitable price considering the<br />

market scenario. 50% analysis charges and other Govt. /Statutory duties will be charged<br />

extra. The buyer has to arrange loading and transportation etc. of their own.<br />

11: SALES TAX: Sales Tax/VAT as applicable shall be charged extra. To avail concessional rate<br />

of sales tax required forms duly filled in shall be deposited in due time with OMC without<br />

delay, failing which sales tax in full rate will be recovered from the buyer.<br />

12: WELFARE CESS: Instead of OMC paying Labour Welfare Cess to buyers of ore separately,<br />

applicable labour welfare cess, as payable by OMC to the buyers of ore shall be deducted<br />

from the sales invoice of each buyer.<br />

The buyer shall deposit the cess duty with the welfare commission in due time and<br />

produce documentary evidence in support of such payment to OMC every month. Any<br />

deviation to the above shall be liable for cancellation of the supply order by OMC Ltd.


13. WEIGHMENT: Weighment as recorded in OMC weighbridge or decided weigh bridge of<br />

OMC in case OMC’s weigh bridge is not available shall be final for the purpose of payment.<br />

14: DISPUTE: The decision of the Managing Director, OMC shall be final on any dispute<br />

arising out of the above deal.<br />

15: SPECIAL CONDITION: The tender has been called primarily to establish the best market<br />

price for different grades of Chrome Ore (lumps & chips) indicated in Clause - 1. OMC will<br />

allot different grades of Chrome Ore tendered following allotment procedure of Corporation at<br />

prices to be decided through this tender.<br />

Therefore, after allotment of tendered quantities to respective accepted highest bidders, this<br />

tender will extinguish. Validity of prices to be decided through this tender will be decided by<br />

OMC from time to time based on market parameters.<br />

In case the eligible highest bidder is a new buyer to OMC, he will not have the right to<br />

be enlisted as a regular buyer and allotment of the tendered quantity shall be made subject<br />

to successful plant inspection. Successful Plant inspection includes subsequent compliance<br />

and clarification, if necessary relating to submission of additional information/ documents to<br />

prove bonafideness and authenticity of the unit apart from documents asked for prior to<br />

supply of chrome ore as successful H1 bidder. In such case, if the compliance of the H1<br />

bidder agency is not upto the satisfaction of OMC, the supply of tender quantity of chrome<br />

ore to the said H1 bidder can not be made and OMC Ltd. shall have the right to be free of its<br />

tender obligations and take further suitable decision.<br />

16: LIFTING SCHEULE: 3 (three) months from the date of allotment.<br />

17: AUTHORISATION OF AGENTS / REPRESENTATIVES: For the bid submitted by<br />

agent/representatives, the name of their principal is to be furnished along with a letter of<br />

authority issued by the Principal authorizing the agent / representative to participate on their<br />

behalf.<br />

18. TENDER PAPER. This Tender Notice along with Technical and Price Bid format is to be<br />

downloaded from OMC website to file tender documents. No provision exists for sale of<br />

Tender paper.<br />

19. OMC Management reserves the right to defer/accept/discharge the part or whole of tender<br />

without assigning any reason thereof.<br />
