NOTICE INVITING TENDER
Sealed tenders are invited from the eligible bidders for design, supply,
erection & commissioning of Distribution Panel Board & supply of XLPE Cable to
our Bangur Under Ground Mines in the Dist. of Keonjhar, Odisha. Details regarding
the tender should be downloaded from our website i.e. www.orissamining.com
w.e.f. 17.04.2013. There will be no manual sale of tender paper. The last date for
receipt of tender in the office of the undersigned is 07.05.2013 up to 3.00P.M.
which will be opened on the same day at 3.30P.M. The undersigned reserves the
right to reject any or all the tender without assigning any reason thereof.

1. INSTRUCTIONS TO THE BIDDERS.
The tender shall be submitted in two parts in two separate sealed envelopes.
Part-I: Techno-commercial Bid
Part-II: Price Bid
The above two envelopes shall be covered in a third envelope super scribing
the name of items, tender number, due date of opening and complete address
of the tenderer. The tender should be addressed to Addl. General Manager
(Mat), The Odisha Mining Corporation Ltd., Bhubaneswar-751001, Odisha.
Each page of the tender document must be initialed & stamped by the
bidder.

4. PROCEDURE, DATE, TIME AND PLACE FOR SUBMITTING THE BIDS:
The Bid should be submitted within the stipulated date and time as stated in
the NIT. The bid or modifications to bids, which are received after the due
time & date shall not be taken into consideration. No canvas in this regard
shall be entertained.
5. DATE, TIME AND PLACE OF OPENING OF THE BID:
The techno-commercial bid shall be opened in presence of the bidders or
their authorized representatives in the date and time as specified in the NIT
in the office of the AGM (Material) OMC Ltd, Bhubaneswar. The Price Bid of
the eligible bidders qualified through techno-commercial bid shall be opened
on a suitable date with prior intimation to the bidders.
6. COST OF THE TENDER/BIDDING DOCUMENT & EMD:
a) Tender paper cost=Rs 500.00 + VAT @ 5%,totaling Rs 525.00 (Rupees
five hundred twenty five only)
b) Cost of EMD=
i) For panel board=Rs 2500.00(Rupees two thousand five hundred only)
ii) For cable= Rs 2500.00(Rupees two thousand five hundred only)
The cost of bidding document along with EMD as indicated above against
each category of items shall be submitted in shape of Bank Draft drawn on
any scheduled bank payable at Bhubaneswar in favour of ‘The Odisha Mining
Corporation Limited’. The DD towards the cost of tender paper and EMD

should be submitted in the envelope for techno commercial bid.
EMD
furnished by the tenderers not being successful after opening, shall be
returned after the expiry of tender validity period but not later than 30 days
of the award of the contract order, whichever is earlier without any further
request from the tenderer(s). If the successful bidder withdraws or amends,
impairs or derogates from the tender in any respect within the period of
validity of his tender or award of contract, the EMD will stand forfeited. The
EMD of the successful bidder shall be returned after successful execution of
the work without interest.
Exemption of EMD & cost of tender paper shall not be allowed. The bid
received without the cost of tender paper & EMD shall be rejected. The cost
of tender paper is non refundable.
7. ELIGIBILITY CRITERIA FOR TENDERERS
a) The documents in support of Sales Tax registration/ TIN / CST.
b) Manufacturer/ authorized dealer of L&T/ SIEMENS/ ABB (for panel
board) & Finolex/ Polycab/ Havells (for cable).Valid certificate/
document must be enclosed in the techno-commercial bid.
c) For panel board, the company must have its own service center in the
State of Odisha.
d) The tenderer must not have been black listed for bidding within a
period of 3 preceding years from the date of submission of the tender as
fixed above by any competent court of law, forum or any Govt. or
statutory entities. The tenderer has to furnish an affidavit in support of
not being blacklisted.
8. SCOPE OF WORK:
The scope of work of successful bidder shall be (a)design, supply, erection &
commissioning of the panel board (b) supply the cable as per the technical
specifications at our Bangur U.G. mines in the dist. of Keonjhar, Odisha. The
bidder shall demonstrate the performance of the Panel board at site to the
satisfaction of the OMC Engineer. The materials should be defect free and of
good workmanship.. The supplier shall install & commission the Panel Board
at site. The required civil work, earthings, and cable laying work up to panel
board shall be made by OMC. The supplier shall demonstrate the function of
each components of the panel board at site. The supplier is to submit the
single line diagram, cable termination diagram and other related drawings
and diagram at site in three copies. One copy is to be submitted with the bill.
9. DELIVERY:

The delivery period is one month for supply of cable & two months for
design, supply, erection & commissioning of the panel board. OMC may
negotiate a realistic delivery period with the bidder if the situation warrants
so. The bidder shall deliver the materials at our Bangur Mines in the district
of Keonjhar at a distance of around 170KM from Bhubaneswar & 40 kms
from Bhadrak.
10. VALIDITY OF THE BID:
The bid shall be valid for (Three months) 90 days from the date of opening of
the tender.
11. OTHER CONDITIONS
11.1. It is desirable that the firms should have the technical and the financial
capabilities to execute the order and with proven performance. Copy
of the similar work order/ certificate of the customer executed earlier
has to be enclosed.
11.2. All the documents submitted be serially numbered & indexed.
11.3. During evaluation process if it is felt by the OMC Management to visit
the works / establishment of the bidder to ascertain the facilities
available with the bidder then the technical committee of OMC shall
visit the works / establishments of the bidder.
11.4 The bidder must sign with seal the tender document as well as the
copy of all related papers/documents submitted in support of their
eligibility.
11.5 PAN issued by the I.T.Authorities.
12. PRICE:
The price should be quoted in the price Bid format as at Annexure-B. Printed
price list of the manufacturer, wherever available, is to be attached with the
price bid. The price quoted shall remain firm through out the validity period.
The price comparison shall be made separately for Panel Board & cables.The
price bid should be type written & no hand written/over writing is allowed.
13. WARRANTY:
The supplier shall extend warranty for the items supplied for a period of
eighteen months from the date of delivery or 12 months from the date of
installation & commissioning in respect of proper design, quality,
workmanship, correctness in dimension and their proper fitment to the
machines for which same are ordered. The supplier shall be liable to replace
such items/parts within 2(two) months on free of cost basis. No extra charge
for transportation shall be paid to the supplier against such replacement.

14. PAYMENT TERMS: All payment shall be released at Head Office,
Bhubaneswar.
(A)
For Panel Board:
(1) 80% shall be released after delivery & acceptance of materials at
site with due inspection by the representative of OMC and on
submission of the bill in duplicate along with test certificates.
(2) 10% shall be released after installation & commissioning of the
Panel Board at site.
(3) Balance 10% shall be released after completion of warrantee
period.
(B)
For Cables: 100% payment shall be released after delivery &
acceptance of materials at site with due inspection by the
representative of OMC and on submission of the bill in duplicate
along with test certificates.
15. FREIGHT & INSURANCE:
Transportation and transit insurance charges, if any, shall be borne by
supplier.

16. LIQUIDATED DAMAGE CLAUSE / PENALTY:
In case the supplier fails to deliver within the period agreed and stipulated in
the purchase order, the supplier shall be liable to pay penalty for such delay.
An amount equivalent to 0.25% value of the unexecuted part of the order
value per week subject to a maximum limit of 5% including taxes and duties.
The amount shall be deducted from the bills payable by the corporation to
the vendor. If the order is not executed within twice the duration of the
agreed delivery period then it will be at the discretion of OMC management
to cancel the PO./ Contract with forfeiture of EMD.
However, OMC shall review the evolving work requirement for the
accomplishment of order by the vendor and if required, may extend the time
period.
17. PRICE FALL CLAUSE:
In the event of the supplier found accepting lower prices or supplying at
lower rates prior to and after finalisation of rates to any other organization,
the said lower rates shall be made applicable to OMC against the Purchase
Order.

18. TEST CERTIFICATE:
The supplier shall submit the test certificates wherever required by OMC.
19. REJECTION OF TENDER:
OMC reserves the right to accept or reject any or all tenders received without
assigning any reason there of.
19. LEGAL DISPUTE:
Incase of any dispute arising out of this tender, it will be subject to the
jurisdiction of the courts at Bhubaneswar only in the state of Odisha.
