Sealed Tenders are invited from RQPs/ Consultants/Agencies (herein after will be referred as
Tenderer/Agencies) having valid registration as RQP from Indian Bureau of Mines (IBM) and fulfilling
the eligibility criteria as prescribed below.

i) The agency must have valid registration as RQP from Indian Bureau of Mines (IBM) on the
date of opening of tender. The copies of RQP certificate duly authenticated by the agency are to
be furnished.
ii) The Agency should have prepared and got approved a minimum of 5(five) nos. of Mining
plan/Mining Scheme/Modification of Mining Plans/modification of mining Schemes/FMCP
within last 10 financial years. At least one out of the Mining Plans/Mining
Schemes/Modification to the Mining Plan/Modification to the scheme of mining/ FMCP should
be of fully mechanized category). List & copy of proof of all such approvals duly authenticated
by the agency should be furnished.
iii) The Agency must have valid Service Tax Regn. Number if applicable & PAN No. (Photo copy
of the documents duly authenticated by the agency should be produced).

4). The interested Agencies, may download the Tender Schedule from the website of OMC
(www.orissamining.com) and the tenderer are required to submit the tender along with Demand
Draft/Pay order for Rs.5250/-(Rs.5000 plus VAT @ 5% totaling Rs.5250/-Rupees Five
Thousand two hundred & fifty only) drawn in favour of Odisha Mining Corporation Limited,
Bhubaneswar payable at any Scheduled Bank at Bhubaneswar towards the cost of the Tender
Schedule (non-refundable).
5) Sealed tenders enclosing the technical bid and price bid in separate sealed covers shall be
received on or before 15.03.2013 up to 3.00 P.M. The tenderers are required to submit both parts
of the tender in a separate envelope duly sealed and appropriately superscribed with the Tender
Notice No.& Name of the work. The Earnest Money Deposit (EMD) will be submitted as a part
of Technical Bid. Each bid should be superscribed on the sealed cover as “Technical bid” or
“Price bid”. Sealed envelope containing both parts of the offer shall be placed inside another
envelope duly sealed and addressed to Addl. General Manager (Mining), OMC Ltd., Post Box
No.34, Bhubaneswar-751001. The full name and address of the tenderer, name of the work and
tender number shall be clearly represented on the envelope. The Technical bid must be
accompanied with the Earnest Money Deposit (EMD) of Rs.25,000/- (Rupees Twenty-five
Thousands only) in shape of Demand Draft/Pay Order drawn in favour of Odisha Mining
Corporation Limited, Bhubaneswar payable at any Scheduled Bank at Bhubaneswar . Technical
bids will be opened on the same day at 4.00 P.M. in presence of the bidders or their authorized
representatives, if available.
After evaluation of the technical bids by a committee of OMC, price bids of the Agencies
qualifying in the technical bid, will be opened on a date, which will be separately intimated to
the bidders qualifying in the technical bid. The Agencies bidding L 1 price, will be allocated with
the work after negotiation.
6) This tender call notice shall be subject to the terms & conditions of the tender schedule.
The Odisha Mining Corporation Limited reserves the right to accept or reject the tender
offers without assigning any reason thereof.

Part-I
Technical Bid
TENDER SCHEDULE FOR PREPARATION, SUBMISSION & OBTAINING APPROVAL OF MINING SCHEME
WITH PMCP & FEASIBILITY REPORT OF KATHPAL CHROMITE MINES & NISHIKHAL MANGANESE
MINES OF OMC LTD IN DHENKANAL & RAYAGADA DISTRICTS OF ODISHA RESPECTIVELY.
INSTRUCTION TO TENDERER.
1. The tender consists of two parts, i.e. Technical Bid and Price Bid. Both parts shall be duly filled
in and signed by the tenderer.
2. Duly filled in tenders are to be deposited in the Tender Box kept in the Office of Addl.General
Manager (Mining), OMC, Head Office on or before 3.00 PM on 15.03.2013. The tender can be
sent by post or courier but tender(s) delivered after the due date/time shall not be entertained at
all.
3. The main sealed envelope containing the two sealed envelopes (Part-I, Part-II) will be opened at
4.00 PM on 15.03.2013 in the presence of the tenderers or their authorised representatives who
wish to be present. Immediately thereafter, The Part-I offer of the tenderers will be opened.
Instead of a tenderer, when a representative wishes to remain present at the time of opening of
the Part-I of the tender on the date fixed, he shall have to produce a letter of authority on the
letterhead/pad of the tenderer duly signed or a power of attorney executed by the tenderer to that
effect.
4. The price bid of the technically qualified tenderers after completion of scrutiny of the Technical
part, will be opened at a later date in presence of the tenderers or their authorised representatives
who wish to be present. The date of opening of the price bid (Part-II) will be separately
intimated to all the qualified tenderers in advance.
5. The tenderer shall sign each and every page of the tender documents and submit the tender
complete in all respect and in the appropriate part of the bid.
6. Tenders not received in the prescribed form as specified in the Tender Notice/documents and
without earnest money shall be summararily rejected.
7. The Agencies either proprietor/partner/company should have his/its own experience in
preparation of Mining Plans/Mining Schemes/Modification of Mining Plans/ modification of
Mining Scheme/FMCP of mechanized & other than fully mechanized mines.
8. The tenderers shall furnish the following documents in addition to those listed under submitted
by the agency.
Category of tenderer, whether proprietary concern/partnership whether registered or
unregistered, Private Limited Company, Public Limited Company, Co-Operative Society etc.
along with following documents.
i) In case of proprietary firm, affidavit of Sole Proprietorship.
ii) In case of Partnership firm, attested copy of Registered Partnership deed along with
amendments, if any, and the proof of registration, if any.
iii) In case of Limited Companies, Memorandum and Articles of Association, Certificate of
Incorporation, authorised, subscribed and paid up capital.
iv) In case of Co-operative Society, attested copy of the certificate of registration from the
Registrar of Co-operative Societies.

9. Tender by a partnership firm shall be signed in the firm’s name by the Managing Partner or one
of the partners by any other duly authorised representative followed by the name and
designation of the person so signing; Tender by a limited Company shall be signed in the name
of the company, by a person duly authorised on its behalf. A power of attorney or other
satisfactory proof showing that the person signing the tender document on behalf of the
company is duly authorised to do so, shall accompany the tender. Tender submitted by tenderers
without furnishing the full particulars and/or documents as asked in tender documents or
furnishing particulars or submitting tender documents without strictly adhering to the directions
given herein shall be rejected.
10. Price Bid: The tenderer(s) shall submit the price bid as per the format given herein as “price
bid”.
11. Tenders containing signature on the page(s) of Price Bid and amount/quantity not shown in
figures and words will be liable for rejection. No overwriting in price bid would be allowed.
12. The rates and quantities quoted in the tender by the tenderer shall be in figure as well as in
words. In case of discrepancy in the rate(s) amount/quantities between figure and words, the
value written in words shall be taken as finally quoted rate(s)/amount/quantities.
13. Canvassing in any form is strictly prohibited and tenders submitted by the tenderer who resort to
canvassing, will be liable for rejection.
14. The Company reserves the right to accept/reject any or all tenders without assigning any reason
thereof.
15. It shall be deemed that the tenderer has visited and carefully inspected the location and
topography of the mine lease area at the mines before submitting the tender and no dispute that
the mines area for which this tender is floated was in any way vague, indefinite and smacked of
specificity would be entertained at any time.
16. The above criteria and or conditions are immutable and do not admit of any exception.

The Agencies should furnish information & enclose supporting authenticated documents
as listed under, while participating in the tender for the above work. The information so submitted are
subject to verification by the OMC Ltd. and in case, the information so furnished or a part thereof is
found to be false/exaggerated/manipulated, the bid offered by the Agencies shall be liable for rejection
and the OMC Ltd. reserves all rights to reject the bid without assigning any reason thereof.
Bidders are advised to study the requirement of OMC and the Tender Schedule carefully on their
own. Submission of bid shall be deemed to have been done after careful study and examination of the
OMC requirements.

MINES & NISHIKHAL MANGANESE MINES OF OMC LTD IN DHENKANAL &
RAYAGADA DISTRICTS OF ODISHA RESPECTIVELY.

III. TERMS AND CONDITIONS

6 The Agency shall give a final draft to OMC for submission
to IBM, which will be signed by authorized signatory &
submitted along with requisite fee to IBM.
7 The Agency shall : i) persuade processing of the submitted
draft & fixing up date for inspection at office of RCOM,IBM
Bhubaneswar. ii) Co-ordinate the Inspection iii) Be
physically present to explain the querries raised by the
inspecting official during the inspection, iv)Supplement with
any additional information for clarification. v)Constantly
intimate AGM(Min), HO,OMCLtd regarding status till
receipt of scrutiny remarks form IBM,Nagpur.
8 The Agency shall ask OMC for any additional data as per
scrutiny remarks issued by IBM Nagpur, and OMC shall
supply
9 The Agency shall comply scrutiny remarks raised by IBM
Nagpur and submit final rectified copies to IBM.(In case of
receipt of scrutiny remarks again, the rectification shall be
effected & submitted )
10 The Agency shall obtain approval of IBM. Agency shall
constantly intimate AGM(Min), HO,OMCLtd regarding
status till receipt of the approval from IBM.
11 The Agency shall submit 6(Six) hard copies along with 2
(Two) soft copies( (i) scan copies of the complete approved
document & plan converted to .pdf format, (ii) text, table &
calculations in editable format & drawings in AutoCAD/Arc
GIS format) to Addl Gen Manager (Mining)OMC.

The above work shall be executed under the guidance of AGM(Min) ,Head office
The Agency shall submit duly signed requisition enclosing the consolidated list of
data/information required for the work awarded.
The agency is to prepare all plans & sections (Geological, Year wise Development, Conceptual,,
Environmental Management, Environment, Reclamation, Dump) consistent with supplied
exploration data, production target, environment monitoring data etc on it’s own.
Only authorized personnel/e.g. Geologists, Mining Engineers, Surveyors/AutoCAD draughtsman
etc those who are connected to the specific work shall communicate with AGM(Min) of OMC Head
office, with prior appointment regarding the work allotted/ information/data required & status.
Data/information required by the Agencies will be collected from mine/region/HO & will be
handed over to the agency on due acknowledgement.
The Agency shall visit mine/ region/HO as frequently as it is required to at their own cost
verify/discuss/clarify /deliberate & obtain suggestions for preparation of the Scheme of Mining
with PMCP & Feasibility Report.
Any discrepancy/ clarification in respect to data/ information so received or for requirement of
supplementary/additional data, the Agencies shall have to submit a requisition as above again
mentioning/justifying the requirement of such additional information.
The Agency shall assimilate, validate, compile & consolidate all data/information collected for
their consistency, prior to incorporation of the same in the Mining Scheme with PMCP &
Feasibility Report.
The draft complete in all respect enclosing texts, plates, Annexures & photographs, is to be
submitted in duplicate hard copy along with a letter under the signature of authorized signatory to
OMC for scrutiny. This is to be followed by a power point presentation at place, date & time to be
decided by OMC.
The Agency should verify the Lease plan of the M/L, Updated Surface plan, Land use Plan, and
conduct re-survey of the area, if the features in the submitted plan does not appear to have been
properly plotted, & survey is required on the basis of which Mining Scheme with PMCP &
Feasibility Report is to be prepared.
While preparing for submission of Mining Scheme for approval, the agency shall comply with the
IBM’s Circular No.1/93 and Circular No.10/2006 in this matter. This will include the
Environment Management plan and an Environmental Impact Assessment Statement. The
preparation of Mining Scheme must be in accordance with the latest guidelines/circulars issued by
IBM from time to time. In this regard, the agency may refer to the various circulars issued by IBM
and incorporate the same while preparing the Mining Scheme.
The agency shall adhere to the guidelines of IBM circular No.14/2003 and CCOM’s Circular
4/2006 while preparing Mine Closure Plans including a Progressive Mine Closure plan (as a
component of mining plan). The agency shall also adhere to the IBM circular No.1/2006,
regarding UNFC classification of reserves/ resources supported by pre-feasibility and feasibility
study. Preparation of Mining Scheme shall be in compliance with IBM Circular No. 2/91,
Regarding Outline of Mining Scheme including Environmental Management Plan(EMP) IBM
circular Nos 3/91, 4/91 & 3/92 to be followed. Regarding standardization of map and
plans/sections symbols IBM circular Nos 5/91 to be followed.
All documents are to be prepared in strict adherence to the applicable Acts, Rules, Regulations &
circulars, guidelines, orders issued there under.
Reclamation plan, as necessary, has to be prepared by the Agency.

The Scheme of Mining with PMCP & Feasibility Report is to be prepared considering the EC &
FDP conditions and in such a way, so that required data for EC and FDP can be retrieved.
All statutory clearances whether approved or in process like forest diversion proposal, environment
clearance, Consent to operate, DGMS approval etc are to be taken into consideration while
preparing the Mining Scheme with PMCP & Feasibility Report.
The total time of completion of the entire work under Clause III(Preparation and sub
mission of approved copy to OMC) is limited to one hundred eighty days(180 days).
During the pendency of this contract if any new Act/Rule/Regulation/circular/guideline is enforced
by any concerned authority, the agency entrusted with this work shall comply with the conditions
of the same for getting approval from IBM at the approved price without any additional financial
burden to OMC.
IV OBLIGATION OF THE OMC LTD.
1. The OMC Ltd will supply additional Geological data if any with supporting plans and sections,
updated pit position, profiles etc for development planning as per proposed rate of production to the
Agency for the preparation of the report within thirty(30) day’s from receipt of written requisition
from the Agency. The Agency shall check the adequacy of data/information supplied for carrying out
the assignment and will confirm to the OMC Ltd. the adequacy/ inadequacy of the available data
within 2 (Two) days of receipt of the relevant data/information from the OMC. Ltd failing which it
shall be construed that the information provided are adequate.
2. All statutory charges/expenses/application fees etc., if any, which are required to be paid to IBM, shall
be borne and paid by the OMC Ltd.
V. PAYMENT TERMS:
1. 30% (Thirty percent) of the total work value will be released on completion of the work indicated
as per item No 1 to 6 of Clause No. III.
2. Further 20% (Twenty percent) of the total work value will be released after completion of the work
indicated as per item No.10 of Clause No. III.
3. The balance 50% (Fifty percent) of the total work value will be released after completion of the
work indicated as per item No 11 of Clause No. III.
4. TDS and Surcharge as per IT Act-1961 shall be deducted from each running bill. Service Tax, as
applicable, shall be paid by OMC extra on production of invoice as per rule of service tax rule &
the agency has to produce service Tax Registration Certificate for the purpose under this service.
Other taxes, as applicable, shall be to the account of the Consultant/Agency. The above payments
will be released at HO on recommendation of Addl Gen Manager (Mining).
5. The bills in respect of above works are to be submitted in triplicate along with the approval letter,
Six bound copies of the approved proposal, 2 soft copies of the entire document (one in .pdf &
another in its own format) to Addl Gen Manager (Mining), OMC Ltd, Bhubaneswar.
6. For inspection of the visiting officials from the Govt. of India in connection with the approval of
the proposal, the OMC will arrange free transport & accommodation.
7. The Consultant/Agency shall visit the site at it’s own cost.
8. The visit to IBM and any other offices in connection with the above work, no separate payment
will be made. This is included in the total fees for the assignment of the above job.

VI.
OTHER TERMS AND CONDITIONS.
1 The Agency is required to discuss with the concerned Manager (Mining) at site, Regional
Manager & Head of Geology at the Regional Office after receiving the details information from
O.M.C head office & before submission of draft to OMC regarding development of mines and
other related mining activities in connection with preparation of the Mining scheme at it’s cost.
2, The subject indicating the lease and details of the Mining scheme should not be published in any
manner or discussions made in any Seminar/Technical Forum without prior permission of the
OMC’s Management.
3 Regarding any dispute arising while undertaking the job and extension of time of contract etc. the
decision of the Managing Director/CMD, OMC Ltd., will be final and binding on the
Consultant/Agency.
4. The OMC Ltd reserves the right to reject any bids/offers without assigning any reason thereof.
5. The lowest price quoted for a lease will be the basis for selection for awarding the work relating to
concerned lease.
7. Arbitration:
a) All disputes arising out of this work order shall be resolved amicably as provided under Clause VI
(3) above. In the event the dispute is not resolved amicably, the same shall be referred for
Arbitration in accordance with the Arbitration and Conciliation Act, 1996. The OMC Ltd. shall
appoint the sole arbitrator, who shall ordinarily be retired High Court or District Judge of this
state.
b) The place of arbitration shall be Bhubaneswar and the language of the arbitration shall be
English.
VII.
CONDITIONS FOR EMD.
1. Technical bid must be accompanied with the Earnest Money Deposit ( EMD) in shape of Demand
Draft/Pay Order of Rs.25,000/-(Rupees Twenty five Thousand only) in favour of Odisha Mining
Corporation Limited, Bhubaneswar payable at any Scheduled Bank at Bhubaneswar
2. Tender without prescribed EMD shall be rejected.
3. No interest shall accrue on the Earnest Money.
4. The Earnest Money will be refunded to the unsuccessful bidders with in 15 days of finalization of the
tender on submission of application. If after issue of work order to the successful bidders, the work is
abandoned or left incomplete, the EMD/ISD shall be forfeited.
5. The Earnest Money of all the bidders shall be refunded in case the tender is cancelled by OMC Ltd.
6. The EMD will be converted into initial security deposit (ISD) once the work is awarded to the
Consultant/Agency. The ISD will be released after 30 days of the final payment is released on
successful completion of work.
VIII.
PENALTY:
(i)
For any discrepancy observed regarding suitability of the Mining scheme with PMCP &
Feasibility report as per requirement and efforts taken by the Agency in obtaining
approval of IBM, the corresponding part of the work value shall not be paid and EMD/ISD
deposited with OMC shall be forfeited, considering that the Agency has not properly
attended the work assigned. OMC may take steps to black list such agency & debar from
participating in similar tender for any work to such Agency in future.

(ii)
Penalty @ 0.25% of the work value for delay of each week calculated from the next day of
scheduled date of completion. The total penalty to be imposed is subject to a maximum of
5% of the work value, which will be deducted from the bills. Any fraction of week more
than 3 days will be calculated as one week for the above purpose by OMC. Where as less
than 3 days may be condoned by OMC. However if the delay is not due to the fault of the
contractor/Agency, it can be waived off with the due approval of MD/CMD.
IX.
RISK PURCHASE:
In the event of failure to fulfill the contract terms for execution of work as per letter of
intent/contract, the company reserves the right to make the contractual obligations carried out by
alternative arrangement and the company shall recover from the tenderer any additional cost
involved therein.
The ISD of the agency shall be liable to be forfeited in case of failure to complete the job
within stipulated period or within such extended period approved by the management.
X. FORCE MAJURE:
Either party shall be relieved of its obligations and responsibilities under this contract if the
performance of this contract is wholly or partially prevented and/or delayed by act of GOD and any
other causes beyond the control of either party such as fire, flood, strike, lockout, riot or civil
commotion, epidemic, war and acts of Government etc. Either party shall promptly give notice to
the other party of any force majure even affecting its obligations under this contract along with
documentary evidence such as any competent authority connected with the cause. If such notice is
given, the obligations and responsibilities of the other party shall be relieved to the extent made
necessary by and during the continuance of force majure.
XI.
GENERAL:
1. OMC reserves the right to terminate the work order at any point of time if the progress of
work is not found satisfactory and the penalty provision as at Clause-VIII shall be
applicable.
2. Incase any dispute arises during the contract period, the decision of the MD/CMD, OMC
shall be final and binding, for appointment of the sole arbitrator.
3. The work shall be completed within the specified period of one hundred eighty days
Decision of the MD/Chairman, OMC shall be final and binding on extension of time for
the reasons beyond control of the Agency.
4. OMC reserves the right to distribute the work if required among other eligible bidders if
agreed to perform in the same rate, terms and conditions.
XII.
ACCEPTANCE OF WORK ORDER:
Out of two copies of work order to be issued in favour of the Agency, one copy shall be returned to
the Addl Gen Manager(Mining), OMC Ltd, Bhubaneswar within three days of issue of work order duly
signed on each page by the Consultant/Agency as a token of acceptance of the work order.

PRICE BID

the period 01.04.2014- 31.03.2019 of Kathpal Chromite Mines over 264.466ha in Dhenkanal, & Nishikhal
