<strong>The</strong> <strong>Orissa</strong> <strong>Mining</strong> <strong>Corporation</strong> is having stock of 62-60% Iron Ore Fines, Basis:<br />

62%Fe of Gandhamardan & Daitari Region in Keonjhar district ,<strong>Orissa</strong> for immediate<br />

sale at prevailing price mentioned below:<br />

Applications alongwith the following documents are invited from end users and<br />

the traders for the above materials, latest by 5.00 P.M. on or before 10/12/2009<br />

(working days). <strong>The</strong> application should be addressed to General Manager(S&M)I/C,<br />

<strong>Orissa</strong> <strong>Mining</strong> <strong>Corporation</strong> Limited, Bhubaneswar.<br />

a) Copy of Sales Tax/VAT Registration Certificate.<br />

b) Valid Trading License of respective region from concerned Dy.Director of<br />

Mines/<strong>Mining</strong> Officer for trading of Iron Ore.<br />

c) In case of use in own plant the clearance/consent of State Pollution<br />

Control Board/MOEF for Sintering/Palletisation Plants should be enclosed<br />

(otherwise the buyer shall be considered as a trader).<br />

d) Sale Notice signed in each page (with seal) as token of acceptance of<br />

terms & conditions along with filled in enclosed format.<br />

e) Commitment amount equivalent to 5% value of the quantity<br />

requested for in shape of DD in any nationalized /scheduled bank<br />

to be drawn in favour of M/s. <strong>Orissa</strong> <strong>Mining</strong> <strong>Corporation</strong> <strong>Ltd</strong><br />

payable at Bhubaneswar.<br />

TERMS & CONDITIONS:<br />

1. Place & Mode of Delivery : Ex- Gandhamardan , Daitari Mines in<br />

Keonjhar district . <strong>The</strong> buyer will arrange to lift the material by Truck from mines on


his own arrangement. <strong>The</strong> responsibility of OMC <strong>Ltd</strong>, ceases once the material is<br />

loaded into trucks.<br />

<strong>The</strong> buyer shall keep the seller indemnified for any liability which may arise<br />

during the contract or thereafter on account of loading , transport and such other<br />

matters as are incidental to there exercises.<br />

As per Environment Protection Act-2006 & guideline, the buyer should ensure<br />

that the loaded trucks are to be covered with tarpaulin during transport.<br />

2. Payment Terms : <strong>The</strong> agency has to lift the material against advance covering<br />

approximate cost of ore plus Sales Tax & 50%analysis & other Govt. duties (as<br />

applicable). <strong>The</strong> mode of payment are as follows:<br />

(a) In shape of Demand Draft/Banker’s Cheque drawn on any Nationalised<br />

/Scheduled Bank operating at Gandhamardan/ Daitar in favour of <strong>Orissa</strong> <strong>Mining</strong><br />

<strong>Corporation</strong> <strong>Ltd</strong>. <strong>The</strong> buyer has to deposit the above Demand Draft/Banker’s Cheque<br />

in advance with concerned Regional Manager, (Gandhamardan/Daitari).<br />

3. LABOUR WELFARE CESS:<br />

Instead of OMC paying Labour Welfare Cess to buyers of ore separately,<br />

applicable labour welfare cess, as payable by OMC to the buyer of ore shall be<br />

deducted from the sales invoice of each buyer.<br />

<strong>The</strong> buyer shall deposit the cess duty with the welfare commissioner in<br />

due time and produce documentary evidence in support of such payment to OMC<br />

every month. Any deviation to the above shall be liable for cancellation of the supply<br />

order by OMC <strong>Ltd</strong>.<br />

4. Sampling & Analysis :<br />

Sampling and analysis shall be carried out by a reputed public analyst. <strong>The</strong><br />

report of public analyst will be binding on both buyer and seller. 50% of the analysis<br />

charges will be borne by the buyer. <strong>The</strong> agency may depute its’ representative for<br />

supervision of sampling & analysis and stock of ore to be supplied to the buyer to<br />

avoid any complicacy regarding quality and physical specification during the process.<br />

<strong>The</strong> responsibility of OMC <strong>Ltd</strong>, ceases once the product is loaded into the carrier and<br />

no complain in this regard shall be entertained.<br />

5. QUALITY CONTROL:<br />

<strong>The</strong> ore will be supplied by the seller to the buyer on ex-mines basis . <strong>The</strong> prestack<br />

analysis will be carried out by the public analyst. <strong>The</strong> buyer may depute his


authorized representative for inspection of ore which is pre-stacked before dispatch in<br />

order to avoid complicacy in quality after the ore is dispatched (Loaded into truck).<br />

6. Price:<br />

<strong>The</strong> buyer has to agree the basic price (inclusive of royalty) as indicated in the<br />

notice. <strong>The</strong> price will be on 62%Fe basis and for unit scale fraction prorata. 50%<br />

analysis charges and other Govt. duties as applicable shall be charged extra. <strong>The</strong><br />

agency has to arrange loading and transportation etc, at their own cost. Unitage shall<br />

be charged on unit scale fraction prorata basis.<br />

7. Sales Tax:<br />

Sales Tax/VAT as applicable shall be charged extra. To avail concessional rate of<br />

sales tax, buyers are required to deposit required form duly filled in, with OMC failing<br />

which sales tax in full rate will be recovered from the buyer.<br />

8. Weighment:<br />

Weighment as recorded in OMC weighbridge or decided weighbridge of OMC in<br />

case OMC’s weighbridge is not available shall be final for the purpose of payment.<br />

9. Dispute:<br />

<strong>The</strong> decision of the Managing director, OMC <strong>Ltd</strong>, shall be final on any dispute<br />

arising out of the above deal.<br />

10. Special Condition :<br />

(a) This notice has been published primarily for liquidation of iron ore fines available<br />

at different iron Ore mines in Keonjhar district. OMC <strong>Ltd</strong>, will allot iron ore following<br />

allotment procedure of the <strong>Corporation</strong>. <strong>The</strong>refore, after allotment of the quantity to<br />

respective agency ( in case the agency is a new customer and willing to use Iron Ore<br />

fines in their own plant, the Iron ore will be supplied after successful plant verification<br />

by concerned Regional Office). <strong>The</strong>y will not have the right to be enlisted as a regular<br />

customer. However, OMC management reserves the right either to continue or<br />

discontinue further supply in future to such agencies.<br />

(b) <strong>The</strong> supply of material/ore shall be made on first come first serve basis.<br />

(c) After allotment of quantity, the buyer has to execute sales order (by depositing<br />

advance) towards cost of allotted quantity as follows at concerned Regional Office, as<br />

per the advice of concerned Regional Office.


(d) <strong>The</strong> buyer has to lift 80% of the alloted quantity within the stipulated period<br />

( i.e. by 31.12.2009), otherwise the commitment amount shall be forfeited<br />

without any further correspondence.<br />

(e) <strong>The</strong> commitment amount shall also be forfeited , in case the buyer unable to lift<br />

the target quantity within the stipulated period due to non granting of permission by<br />

the concerned Dy.Director of Mines / <strong>Mining</strong> Officer of the concerned mining circle.<br />

(f) <strong>The</strong> buyer shall carryout loading and transporting of materials and comply<br />

strictly with all provisions of Mines Act – 1952, Rules-1955, Metalliferous Mines<br />

Regulation-1961, MMRD Act, Payment of Wages (Mines Rules), Maternity benefit Act<br />

of 1961, Industrial dispute Act-1947, M.V.Act etc, and all other government/statutory<br />

regulations, decisions, recommendations prevailing and applicable from time to time.<br />

(g) Further, the buyer should ensure registration of his establishment u/s 7<br />

of the Contract Labour (R&A) Act, 1970, so that the contractors engaged by<br />

you for loading and transportation work possess valid license u/s 12 of the<br />

Contract Labour (R&A) Act, to avoid any legal complicacies in the matter. <strong>The</strong><br />

above statutory requirement should strictly be adhered to and a copy of the<br />

valid license should be deposited with respective Regional Manager and<br />

Manager (<strong>Mining</strong>) of the concerned mines prior to executing loading and<br />

transportation work of ore/minerals allotted to you, failing which supply of<br />

ore shall not be allowed.<br />

11. Lifting Schedule :<br />

<strong>The</strong> entire allotted quantity should be lifted by 31.12.2009.<br />

12. Procedure for Application:<br />

Format for application is enclosed with this Notice separately which is to be<br />

down loaded for submission of application as per above schedule, terms & conditions<br />

of this notice (website- www.orissamining.com) . <strong>The</strong> agency should also furnish<br />

this Notice with signature in each page as a token of acceptance of the<br />

schedule, terms & conditions.<br />

13. OMC management reserves the right to defer/accept/cancel the whole or part of<br />

the notice without assigning any reason thereof.<br />
