either individual complainants or a company <strong>and</strong> complainant on fair, reasonable, <strong>and</strong>/or<br />

cus<strong>to</strong>mary procedures or solutions that could be used <strong>to</strong> settle a complaint; <strong>and</strong> serving as<br />

facilita<strong>to</strong>rs or media<strong>to</strong>rs.<br />

Regardless of whether staff or others involved in designing or operating a grievance mechanism<br />

are from a company or community, it is critical <strong>to</strong> clearly define <strong>and</strong> have common underst<strong>and</strong>ings<br />

concerning roles, responsibilities, <strong>and</strong> authority.<br />

Review <strong>and</strong> Refine the Design<br />

Once the design team has detailed the components of the grievance mechanism <strong>and</strong> designed<br />

the infrastructure <strong>for</strong> the mechanism, it is important <strong>to</strong> capture this plan in a comprehensive<br />

design document. The team should then step back <strong>and</strong> evaluate the design, considering<br />

questions such as those listed below.<br />

• Will the mechanism be effective in meeting our stated goals, objectives, <strong>and</strong> principles?<br />

• Have we taken in<strong>to</strong> consideration good practice markers?<br />

• Will the mechanism be able <strong>to</strong> respond <strong>to</strong> the range of grievances specified in our scope?<br />

• Have we built in an adequate diversity of resolution approaches?<br />

• Have we adequately identified means <strong>to</strong> improve upon those resolution approaches,<br />

if necessary (such as through an outside mediation option, technical expert consultation,<br />

or capacity building)?<br />

• Do we believe that the infrastructure we have designed is sufficient <strong>to</strong> support the effective<br />

operation of the grievance mechanism?<br />

• Is the grievance mechanism effectively integrated in<strong>to</strong> the company’s overall stakeholder<br />

engagement approach <strong>and</strong> management (See box 5.10)?<br />

With the design complete, the design team should then present the grievance resolution<br />

mechanism <strong>to</strong> senior management <strong>for</strong> their approval, along with recommendations <strong>for</strong><br />

governance, staffing, <strong>and</strong> the support structure. Suggestions from company management <strong>and</strong><br />

community stakeholders are reviewed <strong>and</strong> incorporated in<strong>to</strong> the final grievance mechanism<br />

plan. With the necessary approval in h<strong>and</strong>, the design team shifts its attention <strong>to</strong> implementation.
