This Telephone Flow Chart is designed to<br />

assist individuals who may answer the<br />

telephone when a caller makes an initial<br />

inquiry to seek information or services.<br />

The “answerer” begins by helping the caller<br />

out with the question they called about,<br />

then, if the caller is open to talking about<br />

anything beyond his/her initial issue, go to<br />

the Flow Chart below. This Flow Chart will<br />

take the answerer through a brief series<br />

<strong>of</strong> questions. Depending on the caller’s<br />

SERVICES<br />

An adult day care center provides<br />

services generally Monday<br />

through Friday during normal<br />

business hours in a group setting<br />

to adults who need assistance<br />

with the activities <strong>of</strong> daily living<br />

and supervision. Participants<br />

in adult day care may receive<br />

assistance with personal cares,<br />

supervision, meals, medication<br />

administration, and may<br />

participate in various social<br />

activities and community outings.<br />

In Wisconsin, adult day care<br />

centers are not licensed, but may<br />

be certified. Adult day care may<br />

be provided in family homes, free<br />

standing centers, and multi-use<br />

facilities such as churches, schools<br />

Wisconsin Elder Abuse Law<br />

Chapter 46.90<br />

DEFINITION: An elder person, age 60 years or<br />

older, who may be subject to abuse, material abuse,<br />

neglect or self-neglect as defined below:<br />

1. Physical Abuse means “willful infliction<br />

on an elder person <strong>of</strong> physical pain or injury or<br />

unreasonable confinement.” This could include direct<br />

aggressive behavior such as bodily assault, sexual<br />

abuse, physical restraint, torture and imprisonment.<br />

2. Material Abuse means “the misuse <strong>of</strong> an<br />

elder person’s property or financial resources.” This<br />

would involve misuse, misappropriation <strong>of</strong> money,<br />

valuables or property; denial <strong>of</strong> right to access or<br />

control <strong>of</strong> personal funds, or interference in financial<br />

decisions, passive neglect <strong>of</strong> financial affairs or<br />

failure to intervene in financial mismanagement or<br />

exploitation.<br />

3. Neglect means “a significant danger to an<br />

elder person’s physical or mental health because<br />

the person who takes care <strong>of</strong> the older person is<br />

unable or fails to provide adequate food, shelter,<br />

clothing, medical or dental care.” This would include<br />

neglecting, withholding or refusing to permit<br />

others to provide food, clothing, shelter, medication,<br />

medical attention, or personal care and neglectfully<br />

permitting or deliberately causing exposure to<br />

unsafe, unsanitary, or unhealthful conditions.<br />

4. Self-Neglect means “a significant danger to an<br />

elder person’s physical or mental health because<br />

the elder person is responsible for his or her own<br />

care, but is unable to provide adequate food, shelter,<br />

clothing, medical or dental care.”<br />

A social worker will be assigned to assess the<br />

situation.<br />

II. DISPOSITION: There are four basic types <strong>of</strong><br />

situations:<br />

1. The elder person who consents to assessment<br />

and service delivery and who appears to be mentally<br />

competent.<br />

2. The elder person who refuses assessment and<br />

service delivery and who appears to be mentally<br />

competent.<br />

3. The elder person who (regardless <strong>of</strong> his or her<br />

degree <strong>of</strong> cooperation) appears to lack sufficient<br />

mental capacity to make decisions regarding his/her<br />

own care or an elder person who has a legal guardian.<br />

4. The elderly person is in danger <strong>of</strong> immediate<br />

and grievous bodily harm regardless <strong>of</strong> competency<br />

(emergency situations).<br />

LIMITATIONS: Competent adults have the legal<br />

right to refuse assessment and/or services regardless<br />

<strong>of</strong> the opinion <strong>of</strong> pr<strong>of</strong>essionals, family, friends,<br />

neighbors and the community at large.<br />

Information<br />

In Winnebago County, there is a program<br />

called the Community Options Program.<br />

This program is administered through the<br />

Winnebago County Department <strong>of</strong> Human<br />

Services. All people that might be at risk <strong>of</strong> not<br />

being able to live independently in their own<br />

home, are eligible to receive a Long Term Care<br />

Assessment/Consultation.<br />

To receive an Assessment/Consultation, call<br />

Winnebago County Human Services Department<br />

Crisis Intervention/Adult Access Team at<br />

Monday through Friday, 8:00 a.m. -4:30 p.m.<br />

After normal business hours, there is a Crisis<br />

Hotline where assistance and information can be<br />

received; that number is 920-233-7707 (<strong>Oshkosh</strong>)<br />

and 920-722-7707 (Fox Cities).<br />

The Long Term Care Assessment/Consultation will be<br />

conducted by pr<strong>of</strong>essionals that will work with loved ones in<br />

determining what needs the person being assessed has and<br />

will <strong>of</strong>fer recommendations that can be followed to meet the<br />

person’s needs. The following listed services may be those<br />

where assistance is needed.<br />

Personal Cares: bathing, dressing, exercise, grooming,<br />

shaving, oral hygiene<br />

Household Chores: cleaning, meal preparation, shopping,<br />

laundry, money management, and socialization<br />

Relief Help — Respite: adult day care (half, whole day,<br />

week), in home staff (temporary or constant provider, or<br />

week at CBRF)<br />

Information — Connections: adult foster care, counseling,<br />

funding, Life Line, nursing home consultation, physical<br />

therapy, transportation, case management, education, housing,<br />

Meals on Wheels, protective services, support groups,<br />

and mobility aids<br />

The Winnebago County Department <strong>of</strong> Human Services<br />

also has a multitude <strong>of</strong> written materials and videos available<br />

for loan on caregiver issues.<br />

If a person has financial resources to pay for needed services,<br />

the developed assessment plan will guide the family<br />

to arrange needed services.<br />

If the person does not have financial resources to pay for<br />

needed services, there may be finances available to assist<br />

these needs; however, there may be a waiting list to receive<br />

financial assistance. It is important to receive the Long Term<br />

Care Assessment/Consultation and get on a waiting list to<br />

eventually receive financial assistance to meet needs.<br />

The Long Term Care Assessment/Consultation can also be<br />

done at a time <strong>of</strong> crisis, by hospital discharge planners, or by<br />

home health care agencies.<br />

Care coordination/<br />

care management<br />

Once needs have been determined,<br />

whether as a result <strong>of</strong> the Long Term<br />

Care Assessment or as families become<br />

aware <strong>of</strong> needs, there is a need<br />

to become more knowledgeable <strong>of</strong><br />

specific services. There is a wide array<br />

<strong>of</strong> agencies that can be contacted.<br />

Many families will opt to coordinate<br />

and provide needed care themselves;<br />

others will utilize services available in<br />

the community and others will combine<br />

utilizing available services and<br />

provide some care themselves. This is<br />

a personal decision for the family.<br />

Many people needing assessments<br />

and/or services do not have family<br />

or family living nearby or family who<br />

are willing and/or able to provide<br />

assistance. The individual/family may<br />

also choose to not make contact with<br />

Winnebago County Department <strong>of</strong><br />

Human Services. The following agencies,<br />

for a fee, will provide coordination<br />

and other services privately in<br />

Winnebago County. This type <strong>of</strong> service<br />

is available throughout the country<br />

and may bring piece <strong>of</strong> mind to<br />

donate comprehensive dental care<br />

to people <strong>of</strong> all ages who, because<br />

<strong>of</strong> a serious disability, advanced<br />

age, or medical problems, do<br />

not have enough income to pay<br />

for needed dental care. There is<br />

generally no cost to qualifying<br />

individuals, however, people in<br />

a position to pay for part <strong>of</strong> their<br />

care may be encouraged to do<br />

so, especially when laboratory<br />

work is involved. Call the Program<br />

Coordinator for an application.<br />

If the application is approved,<br />

the referral coordinator will<br />

share the information about the<br />

person tentatively accepted with<br />

a volunteer dentist, then you will<br />

be notified <strong>of</strong> the dentist’s name<br />

TEPP is to help people with<br />

disabilities buy equipment<br />

they need in order to use basic<br />

telephone services. The TEPP is<br />

one <strong>of</strong> several different programs<br />

paid for by the Wisconsin<br />

Universal Service Fund established<br />

by the Public Service Commission.<br />

Money collected from Wisconsin<br />

telephone service providers goes<br />

into the USF.<br />

TEPP rules so require that an<br />

applicant:<br />

• Be a Wisconsin resident<br />

• Be a person who is deaf, hard<br />

<strong>of</strong> hearing, speech impaired, or<br />

mobility or motion impaired.<br />

Relay System<br />

The Wisconsin Relay system<br />

provides the vital link for effective<br />

telephone communication<br />

between people who use a TTY<br />

and those who use a standard<br />

telephone. A TTY (also called a<br />

TDD, TT, or text telephone) is a<br />

device that allows people who can<br />

not hear and/or speak to type and<br />

read their telephone conversation.<br />

Calls are relayed by highly trained<br />

operators called Communication<br />

Assistants (CA’s) who acts as<br />

the “invisible link” between two<br />

callers. During a relay call, a CA<br />

will voice everything typed by<br />

the TTY user and type everything<br />

said by the telephone user. In<br />

this way, the relay allows people<br />

who are Deaf, Hard <strong>of</strong> Hearing,<br />

or Speech Disabled to have an<br />

interactive telephone conversation<br />

provides education, support and resources to family<br />

caregivers in Winnebago County. The coalition meets<br />

the fourth Tuesday <strong>of</strong> every month at 1:30 p.m. at the<br />

<strong>Oshkosh</strong> Seniors Center, 200 North Campbell Road in<br />

<strong>Oshkosh</strong>.<br />

What is Respite care?<br />

Respite care is temporary relief from duties for caregivers.<br />

It may be for a few hours or for a few days and<br />

can be provided in-home, at an adult day care, or in a<br />

residential setting such as an assisted living or nursing<br />

home.

One <strong>of</strong> the most difficult decisions a<br />

person may have to make is to move<br />

from his or her home to a new living<br />

environment. Some fully embrace<br />

moving to a new situation where they no longer<br />

have to worry about making and paying for<br />

home repairs, mowing the lawn, shoveling snow<br />

and going up and down stairs. For others, the<br />

thought <strong>of</strong> change is difficult and frightening<br />

and gets put <strong>of</strong>f.<br />

Changes may eventually need to be made<br />

with the involvement <strong>of</strong> family or a community<br />

agency.<br />

Remember, when looking for housing, find<br />

information on the facilities you are interested<br />

in. Make a list <strong>of</strong> questions that pertain to your<br />

needs. Visit the facility, and ask your questions<br />

so that you have all <strong>of</strong> the information you need<br />

to know if this is a good choice for you.<br />

The first part <strong>of</strong> the Directory gives definitions<br />

<strong>of</strong> the different types <strong>of</strong> housing.<br />

What is a Residential<br />

Care Apartment<br />

Complex?<br />

Residential Care Apartment Complexes<br />

(RCACs) are a form <strong>of</strong> housing<br />

available to seniors in Wisconsin<br />

designed to provide another choice<br />

for long-term care. All facilities are<br />

required to provide apartments with<br />

a kitchen, living area, bedroom and<br />

bathroom. In addition, RCACs must<br />

be equipped to provide up to 28<br />

hours per week <strong>of</strong> services designed<br />

to meet individual tenants’ needs.<br />

These types <strong>of</strong> services may<br />

include (but are not limited to) help<br />

with bathing, dressing and grooming,<br />

nursing services such as medication<br />

set-up and monitoring, and help<br />

with laundry and housekeeping.<br />

This provision allows consumers<br />

to purchase the service they want,<br />

with the flexibility to increase services<br />

as their care needs increase in<br />

the future.<br />

How do RCACs differ<br />

from Nursing Homes and<br />

Assisted Living?<br />

States are responsible for regulating<br />

long-term care facilities. While<br />

the commonly accepted or generic<br />

term for facilities other than nursing<br />

homes is “assisted living,” different<br />

states have chosen a variety <strong>of</strong><br />

names. In Wisconsin there are really<br />

three different kinds <strong>of</strong> assisted living<br />

facilities.<br />

These are (1) RCACs; (2) Community<br />

Based Residential Facilities<br />

(CBRFs); and (3) Adult Family<br />

Homes. Different regulations apply<br />

to each.<br />

A CBRF is generally a facility<br />

where individuals have either a<br />

separate or shared bedroom, but<br />

definitely share common living<br />

spaces such as the living room,<br />

dining room and kitchen. They may<br />

share bathrooms as well.<br />

CBRFs are very well-regulated and<br />

monitored by the State <strong>of</strong> Wisconsin.<br />

For example, CBRFs are required<br />

to do background checks on their<br />

employees before hiring them.<br />

Their staff must undergo certain<br />

types <strong>of</strong> training for specific numbers<br />

<strong>of</strong> hours on topics such as first<br />

aid, fire safety, medication administration,<br />

caring for the elderly and<br />

other areas.<br />

The state inspects all CBRFs when<br />

they first apply for a license and then<br />

at least once every subsequent year.<br />

The state also sends out someone to<br />

investigate if anyone files a complaint<br />

about care or services in the<br />

CBRF.
