PETITION FOR WRIT OF MANDAMUS
TO THE HONORABLE JUSTICES OF THE SUPREME COURT OF TEXAS:
Alejandra Salazar, Relator, submits this her Petition for Writ of Mandamus,
complaining of an order signed by the Honorable David A. Berchelmann, Jr., presiding
Judge of the 37 th District Court of Bexar County, Texas. Real party in interest is Russell
Amsberry.
STATEMENT OF THE CASE
The underlying proceeding. In the underlying divorce proceeding, Alejandra
Salazar, Respondent, was represented by Russell Amsberry (hereinafter, Mr. Amsberry).
Alejandra Salazar (hereinafter Alejandra) retained the services of the Law Offices of
Russell Amsberry on February 16, 2011. (Appendix A). She agreed to provide a
$40,000.00 retainer and pay for services at a rate of $300.00 per hour. (Appendix A). On
August 10, 2011, after learning of a large settlement offer, Mr. Amsberry had his client
sign a contingency fee contract modifying the prior retainer agreement. (Appendix B).
