<str<strong>on</strong>g>ACMO</str<strong>on</strong>g> has a close working relati<strong>on</strong>ship with <strong>the</strong> Canadian C<strong>on</strong>dominium Institute (CCI)<br />

which represents primarily <strong>the</strong> c<strong>on</strong>dominium owners. A key example <strong>of</strong> this collaborati<strong>on</strong><br />

is <strong>the</strong> nati<strong>on</strong>al c<strong>on</strong>ference held each year and cosp<strong>on</strong>sored by <strong>the</strong> two associati<strong>on</strong>s.<br />

Ontario<br />

There is no direct government regulati<strong>on</strong> <strong>of</strong> <strong>the</strong> c<strong>on</strong>dominium management pr<strong>of</strong>essi<strong>on</strong>al<br />

nor <strong>the</strong> c<strong>on</strong>dominium management companies in Ontario. <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> has been in <strong>on</strong>going<br />

discussi<strong>on</strong>s with <strong>the</strong> Ministry <strong>of</strong> C<strong>on</strong>sumer and Commercial Relati<strong>on</strong>s (MCCR) <strong>on</strong> <strong>the</strong><br />

issue <strong>of</strong> pr<strong>of</strong>essi<strong>on</strong>al self-management. MCCR oversees self-management councils in a<br />

number <strong>of</strong> sectors. Typically <strong>the</strong> sectors involved have had serious c<strong>on</strong>sumer complaints,<br />

e.g. travel agencies, car body repairs shops, real estate agents. There has been no such<br />

impetus in <strong>the</strong> c<strong>on</strong>dominium management sector. Never<strong>the</strong>less, <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> is urging selfmanagement<br />

in light <strong>of</strong> <strong>the</strong> increasing complexity in c<strong>on</strong>dominium legislati<strong>on</strong>, <strong>the</strong><br />

significant fiduciary resp<strong>on</strong>sibilities associated with c<strong>on</strong>dominium management and <strong>the</strong><br />

potential for inadequate management <strong>of</strong> <strong>the</strong> physical building structures.<br />

Many <strong>of</strong> <strong>the</strong> <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> services described above are positi<strong>on</strong>ing <strong>the</strong> pr<strong>of</strong>essi<strong>on</strong> for selfmanagement.<br />

As will be described in more detail to follow, many <strong>of</strong> <strong>the</strong> issues raised in<br />

<strong>the</strong> <strong>White</strong> <strong>Paper</strong> are currently being handled by <str<strong>on</strong>g>ACMO</str<strong>on</strong>g>.<br />

<str<strong>on</strong>g>Comments</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> <strong>White</strong> <strong>Paper</strong><br />

The following comments <strong>on</strong> <strong>the</strong> key aspects <strong>of</strong> <strong>the</strong> <strong>White</strong> <strong>Paper</strong> are based up<strong>on</strong> <str<strong>on</strong>g>ACMO</str<strong>on</strong>g>’s<br />

experience in Ontario. While <strong>the</strong>re are obviously some differences between B.C. and<br />

Ontario, <strong>the</strong> fundamentals <strong>of</strong> <strong>the</strong> c<strong>on</strong>dominium communities are very similar.<br />

<strong>Licensing</strong> <strong>of</strong> <strong>the</strong> Firm<br />

In <str<strong>on</strong>g>ACMO</str<strong>on</strong>g>’s view it is important that <strong>the</strong> c<strong>on</strong>dominium management company have <strong>the</strong><br />

proper tools in place to permit pr<strong>of</strong>essi<strong>on</strong>al management by its staff. <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> has handled<br />

this issue in two ways. First, <strong>the</strong> Corporate member must have a RCM supervising all<br />

c<strong>on</strong>dominium management functi<strong>on</strong>s. This ensures that a well trained staff member has<br />

ultimate resp<strong>on</strong>sibility for <strong>the</strong> management functi<strong>on</strong>s at each c<strong>on</strong>dominium corporati<strong>on</strong>.<br />

Sec<strong>on</strong>d, c<strong>on</strong>dominium management firms can go to <strong>the</strong> next level and obtain <strong>the</strong>ir<br />

<str<strong>on</strong>g>ACMO</str<strong>on</strong>g> 2000 certificati<strong>on</strong>. The quality standards required <strong>of</strong> <strong>the</strong>se firms is extensive. 2<br />

However <strong>the</strong> intrusi<strong>on</strong> into <strong>the</strong> financial affairs <strong>of</strong> <strong>the</strong> c<strong>on</strong>dominium management firm is<br />

not as extensive as that proposed in <strong>the</strong> <strong>White</strong> <strong>Paper</strong>. <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> 2000 firms are required to<br />

provide a bank reference and must dem<strong>on</strong>strate that <strong>the</strong>y keep proper financial records <strong>of</strong><br />

<strong>the</strong>ir own business. The are also required to carry insurance including errors and<br />

omissi<strong>on</strong>s.<br />
