<str<strong>on</strong>g>Comments</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> <strong>White</strong> <strong>Paper</strong> <strong>on</strong><br />

<strong>Proposed</strong> <strong>Licensing</strong> <strong>of</strong> Strata Managers<br />

<str<strong>on</strong>g>ACMO</str<strong>on</strong>g><br />

The Associati<strong>on</strong> <strong>of</strong> C<strong>on</strong>dominium Managers <strong>of</strong> Ontario was formed in 1977 to represent<br />

<strong>the</strong> collective interests <strong>of</strong> all c<strong>on</strong>dominium managers in Ontario. <str<strong>on</strong>g>ACMO</str<strong>on</strong>g>’s missi<strong>on</strong> is to<br />

advance <strong>the</strong> quality performance <strong>of</strong> c<strong>on</strong>dominium managers in Ontario. 1<br />

<str<strong>on</strong>g>ACMO</str<strong>on</strong>g> provides formal educati<strong>on</strong> programs which coupled with experience and<br />

successful completi<strong>on</strong> <strong>of</strong> an all inclusive exam culminate in <strong>the</strong> well known Registered<br />

C<strong>on</strong>dominium Manager (RCM) designati<strong>on</strong>. This formal educati<strong>on</strong> is provided through<br />

several colleges in Ontario as well as <strong>on</strong>-line through Mohawk College. Ongoing<br />

educati<strong>on</strong> is provided through lunche<strong>on</strong>s, seminars, technical bulletins, a quarterly<br />

newsletter and <strong>the</strong> CM C<strong>on</strong>dominium Manager magazine. In this increasingly complex<br />

pr<strong>of</strong>essi<strong>on</strong>, this educati<strong>on</strong> provides <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> members with a solid foundati<strong>on</strong> for business<br />

success.<br />

All RCM members (individuals) are governed by a strict Code <strong>of</strong> Pr<strong>of</strong>essi<strong>on</strong>al Ethics<br />

which enhances <strong>the</strong> c<strong>on</strong>duct <strong>of</strong> <strong>the</strong> pr<strong>of</strong>essi<strong>on</strong>. Corporate members (companies which<br />

provide c<strong>on</strong>dominium management services) are governed by a Corporate Code <strong>of</strong> Ethics<br />

in all <strong>the</strong>ir dealings with customers, suppliers and employees.<br />

Last year <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> deployed a new program entitled <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> 2000. This program permits<br />

c<strong>on</strong>dominium management firms to put in place ISO-like quality standards in a very cost<br />

effective manner. The firm’s standards are audited by <strong>the</strong> Business Development Bank <strong>of</strong><br />

Canada, <strong>the</strong> largest ISO auditor in North America. The certificates are awarded by an<br />

independent organizati<strong>on</strong>, <strong>the</strong> C<strong>on</strong>dominium Management Standards Council, which also<br />

handles disputes which arise under <strong>the</strong> program.<br />

<str<strong>on</strong>g>ACMO</str<strong>on</strong>g> also provides networking and marketing opportunities to service and trade<br />

companies through Associate membership. In turn <strong>the</strong> Associates provide <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> with<br />

valuable technical and legislative resources.<br />

property managers in <strong>the</strong> co-op sector. REIC provides educati<strong>on</strong> and a designati<strong>on</strong> for property managers in<br />

<strong>the</strong> commercial sector.

<str<strong>on</strong>g>ACMO</str<strong>on</strong>g> has a close working relati<strong>on</strong>ship with <strong>the</strong> Canadian C<strong>on</strong>dominium Institute (CCI)<br />

which represents primarily <strong>the</strong> c<strong>on</strong>dominium owners. A key example <strong>of</strong> this collaborati<strong>on</strong><br />

is <strong>the</strong> nati<strong>on</strong>al c<strong>on</strong>ference held each year and cosp<strong>on</strong>sored by <strong>the</strong> two associati<strong>on</strong>s.<br />

Ontario<br />

There is no direct government regulati<strong>on</strong> <strong>of</strong> <strong>the</strong> c<strong>on</strong>dominium management pr<strong>of</strong>essi<strong>on</strong>al<br />

nor <strong>the</strong> c<strong>on</strong>dominium management companies in Ontario. <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> has been in <strong>on</strong>going<br />

discussi<strong>on</strong>s with <strong>the</strong> Ministry <strong>of</strong> C<strong>on</strong>sumer and Commercial Relati<strong>on</strong>s (MCCR) <strong>on</strong> <strong>the</strong><br />

issue <strong>of</strong> pr<strong>of</strong>essi<strong>on</strong>al self-management. MCCR oversees self-management councils in a<br />

number <strong>of</strong> sectors. Typically <strong>the</strong> sectors involved have had serious c<strong>on</strong>sumer complaints,<br />

e.g. travel agencies, car body repairs shops, real estate agents. There has been no such<br />

impetus in <strong>the</strong> c<strong>on</strong>dominium management sector. Never<strong>the</strong>less, <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> is urging selfmanagement<br />

in light <strong>of</strong> <strong>the</strong> increasing complexity in c<strong>on</strong>dominium legislati<strong>on</strong>, <strong>the</strong><br />

significant fiduciary resp<strong>on</strong>sibilities associated with c<strong>on</strong>dominium management and <strong>the</strong><br />

potential for inadequate management <strong>of</strong> <strong>the</strong> physical building structures.<br />

Many <strong>of</strong> <strong>the</strong> <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> services described above are positi<strong>on</strong>ing <strong>the</strong> pr<strong>of</strong>essi<strong>on</strong> for selfmanagement.<br />

As will be described in more detail to follow, many <strong>of</strong> <strong>the</strong> issues raised in<br />

<strong>the</strong> <strong>White</strong> <strong>Paper</strong> are currently being handled by <str<strong>on</strong>g>ACMO</str<strong>on</strong>g>.<br />

<str<strong>on</strong>g>Comments</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> <strong>White</strong> <strong>Paper</strong><br />

The following comments <strong>on</strong> <strong>the</strong> key aspects <strong>of</strong> <strong>the</strong> <strong>White</strong> <strong>Paper</strong> are based up<strong>on</strong> <str<strong>on</strong>g>ACMO</str<strong>on</strong>g>’s<br />

experience in Ontario. While <strong>the</strong>re are obviously some differences between B.C. and<br />

Ontario, <strong>the</strong> fundamentals <strong>of</strong> <strong>the</strong> c<strong>on</strong>dominium communities are very similar.<br />

<strong>Licensing</strong> <strong>of</strong> <strong>the</strong> Firm<br />

In <str<strong>on</strong>g>ACMO</str<strong>on</strong>g>’s view it is important that <strong>the</strong> c<strong>on</strong>dominium management company have <strong>the</strong><br />

proper tools in place to permit pr<strong>of</strong>essi<strong>on</strong>al management by its staff. <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> has handled<br />

this issue in two ways. First, <strong>the</strong> Corporate member must have a RCM supervising all<br />

c<strong>on</strong>dominium management functi<strong>on</strong>s. This ensures that a well trained staff member has<br />

ultimate resp<strong>on</strong>sibility for <strong>the</strong> management functi<strong>on</strong>s at each c<strong>on</strong>dominium corporati<strong>on</strong>.<br />

Sec<strong>on</strong>d, c<strong>on</strong>dominium management firms can go to <strong>the</strong> next level and obtain <strong>the</strong>ir<br />

<str<strong>on</strong>g>ACMO</str<strong>on</strong>g> 2000 certificati<strong>on</strong>. The quality standards required <strong>of</strong> <strong>the</strong>se firms is extensive. 2<br />

However <strong>the</strong> intrusi<strong>on</strong> into <strong>the</strong> financial affairs <strong>of</strong> <strong>the</strong> c<strong>on</strong>dominium management firm is<br />

not as extensive as that proposed in <strong>the</strong> <strong>White</strong> <strong>Paper</strong>. <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> 2000 firms are required to<br />

provide a bank reference and must dem<strong>on</strong>strate that <strong>the</strong>y keep proper financial records <strong>of</strong><br />

<strong>the</strong>ir own business. The are also required to carry insurance including errors and<br />

omissi<strong>on</strong>s.<br />

<str<strong>on</strong>g>ACMO</str<strong>on</strong>g> is not aware <strong>of</strong> why <strong>the</strong> <strong>White</strong> <strong>Paper</strong> proposes significant financial informati<strong>on</strong><br />

from <strong>the</strong> c<strong>on</strong>dominium management companies. Our understanding <strong>of</strong> <strong>the</strong> Barrett Report<br />

is that <strong>the</strong> skills <strong>of</strong> managers, especially in <strong>the</strong> area <strong>of</strong> physical building management was<br />

<strong>the</strong> key c<strong>on</strong>cern. Unless financial failures <strong>of</strong> c<strong>on</strong>dominium management firms is a known<br />

issue, <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> would recommend a less intrusive financial supervisi<strong>on</strong> <strong>of</strong> <strong>the</strong><br />

c<strong>on</strong>dominium management companies.<br />

<str<strong>on</strong>g>ACMO</str<strong>on</strong>g> requires both its Corporate and <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> 2000 member companies to adhere to a<br />

strict code <strong>of</strong> ethics. The code covers c<strong>on</strong>duct with c<strong>on</strong>dominium corporati<strong>on</strong>s, suppliers<br />

and employees. <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> has an ethics resoluti<strong>on</strong> process based <strong>on</strong> <strong>the</strong> arbitrati<strong>on</strong> and<br />

dispute legislati<strong>on</strong> in place in Ontario. Fur<strong>the</strong>rmore in <strong>the</strong> case <strong>of</strong> <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> 2000<br />

companies complaints <strong>of</strong> not following <strong>the</strong> quality standards are dealt with by <strong>the</strong><br />

independent C<strong>on</strong>dominium Management Standards Council. Clearly an arbitrati<strong>on</strong> and<br />

mediati<strong>on</strong> resoluti<strong>on</strong> process is an important comp<strong>on</strong>ent <strong>of</strong> any self management <strong>of</strong><br />

regulatory program.<br />

<strong>Licensing</strong> <strong>of</strong> <strong>the</strong> Individual<br />

The <strong>White</strong> <strong>Paper</strong> describes <strong>the</strong> purpose for licensing as ensuring <strong>the</strong> appropriate skills<br />

and knowledge and to provide for accountability. <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> agrees completely that today’s<br />

c<strong>on</strong>dominium manager requires significant training in all areas <strong>of</strong> c<strong>on</strong>dominium<br />

management. As will be described more fully below, this training needs to be specific to<br />

c<strong>on</strong>dominium management and must be extensive. The training must be accompanied by<br />

an all inclusive exam prior to any designati<strong>on</strong>/licensing. It is also important that <strong>on</strong>going<br />

educati<strong>on</strong> be available to <strong>the</strong> c<strong>on</strong>dominium manager.<br />

It is clear that <strong>the</strong> Barrett Report determined that educati<strong>on</strong> is a key requirement in <strong>the</strong><br />

sector. In <str<strong>on</strong>g>ACMO</str<strong>on</strong>g>’s view <strong>the</strong> foundati<strong>on</strong> for educati<strong>on</strong> must be in place prior to any<br />

licensing. O<strong>the</strong>rwise <strong>the</strong> public will be given a false and inappropriate comfort that <strong>the</strong><br />

licensing regime will look after <strong>the</strong> public interest.<br />

The accountability <strong>of</strong> c<strong>on</strong>dominium managers is also important but must be assigned in<br />

light <strong>of</strong> <strong>the</strong> relati<strong>on</strong>ship to <strong>the</strong> manager’s employer. With regards to day to day c<strong>on</strong>duct<br />

<str<strong>on</strong>g>ACMO</str<strong>on</strong>g> covers <strong>the</strong> accountability through its Pr<strong>of</strong>essi<strong>on</strong>al Code <strong>of</strong> Ethics. This code<br />

recognizes that some c<strong>on</strong>duct is bey<strong>on</strong>d <strong>the</strong> c<strong>on</strong>trol <strong>of</strong> <strong>the</strong> individual managers. For<br />

example, <strong>the</strong> terms <strong>of</strong> <strong>the</strong> c<strong>on</strong>tract between <strong>the</strong> c<strong>on</strong>dominium corporati<strong>on</strong> and <strong>the</strong><br />

c<strong>on</strong>dominium management company is not within <strong>the</strong> c<strong>on</strong>trol <strong>of</strong> <strong>the</strong> manager.<br />

Accordingly a separate code <strong>of</strong> ethics for companies has been established. The individual<br />

manager should also have <strong>the</strong>ir insurance liability covered by <strong>the</strong>ir employer.<br />

Educati<strong>on</strong><br />

The <strong>White</strong> <strong>Paper</strong> identifies <strong>the</strong> key areas that require educati<strong>on</strong> programs. In <str<strong>on</strong>g>ACMO</str<strong>on</strong>g>’s<br />

view, <strong>the</strong>se areas have been properly described. <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> would encourage a review <strong>of</strong> <strong>the</strong><br />

course curriculum <strong>of</strong> its four courses as set out in our web site. These are c<strong>on</strong>sidered<br />

entry level courses for c<strong>on</strong>dominium managers. In <str<strong>on</strong>g>ACMO</str<strong>on</strong>g>’s view anything less than this

level <strong>of</strong> training would not serve <strong>the</strong> B.C. c<strong>on</strong>dominium community. As <strong>the</strong> review <strong>of</strong> <strong>the</strong><br />

courses readily makes apparent, specific training <strong>on</strong> c<strong>on</strong>dominiums is required. General<br />

property management courses or supplemental courses to o<strong>the</strong>r training is not sufficient.<br />

<str<strong>on</strong>g>ACMO</str<strong>on</strong>g> does provide for educati<strong>on</strong>al exempti<strong>on</strong>s to <strong>the</strong> course, e.g. a commerce graduate<br />

would not be required to take <strong>the</strong> financial course. There is also an experience exempti<strong>on</strong><br />

if a manager can dem<strong>on</strong>strate that <strong>the</strong>y have a minimum <strong>of</strong> five years directly managing<br />

c<strong>on</strong>dominiums. However, it is important to note that <strong>the</strong>re are no exempti<strong>on</strong>s to writing<br />

<strong>the</strong> RCM exam. This exam is all inclusive <strong>of</strong> <strong>the</strong> course material and has a 75 per cent<br />

pass grade. There is a moderate failure rate and those managers are encouraged to take<br />

<strong>the</strong> course(s) in <strong>the</strong>ir weak area(s).<br />

Regulatory Opti<strong>on</strong>s<br />

After reviewing <strong>the</strong> two regulatory opti<strong>on</strong>s, <str<strong>on</strong>g>ACMO</str<strong>on</strong>g>’s str<strong>on</strong>g recommendati<strong>on</strong> is to use<br />

<strong>the</strong> Homeowner Protecti<strong>on</strong> Office (HPO). There are several reas<strong>on</strong>s for this opini<strong>on</strong>.<br />

First, <strong>the</strong> Barrett Report was correct to identify <strong>the</strong> potential for c<strong>on</strong>flict between <strong>the</strong><br />

goals <strong>of</strong> <strong>the</strong> real estate sector and those <strong>of</strong> <strong>the</strong> c<strong>on</strong>dominium management and owners.<br />

The real estate agent may do initial work for <strong>the</strong> developer <strong>of</strong> <strong>the</strong> c<strong>on</strong>dominium and may<br />

not be forthcoming <strong>on</strong> all aspects <strong>of</strong> <strong>the</strong> building. Once <strong>the</strong> unit is sold, <strong>the</strong> agent has no<br />

interest in <strong>the</strong> <strong>on</strong>going maintenance <strong>of</strong> <strong>the</strong> facility or in <strong>the</strong> future governance issues. It is<br />

also <strong>the</strong> experience in Ontario that any real estate agents involved in management are<br />

typically involved in commercial or rental. As noted above, <strong>the</strong> c<strong>on</strong>dominium sector<br />

requires dedicated and specifically trained c<strong>on</strong>dominium managers. Finally, <strong>the</strong> HPO<br />

clearly has <strong>the</strong> homeowner’s interest foremost in its mandate.<br />

Sec<strong>on</strong>d, <strong>the</strong> HPO proposal correctly notes that educati<strong>on</strong> must be phased in and until that<br />

occurs any individual licensing should be reserved. In c<strong>on</strong>trast, <strong>the</strong> REC model would<br />

have individuals licensed notwithstanding that <strong>the</strong> managers have no additi<strong>on</strong>al skills or<br />

knowledge. This is clearly not in <strong>the</strong> public interest.<br />

Third, The HPO has experience in licensing in <strong>the</strong> c<strong>on</strong>structi<strong>on</strong> area, an area <strong>of</strong> greatest<br />

c<strong>on</strong>cern in <strong>the</strong> B.C. c<strong>on</strong>dominium community.<br />

Fourth, licensing under HPO would ensure that <strong>the</strong> distinct and unique aspects <strong>of</strong><br />

c<strong>on</strong>dominium management is maintained and not commingled into real estate which is an<br />

entirely different business.<br />

Fifth while assigning <strong>the</strong> resp<strong>on</strong>sibility to HPO may delay licensing, given <strong>the</strong> important<br />

pubic interest issues, <str<strong>on</strong>g>ACMO</str<strong>on</strong>g> submits it is more important to do <strong>the</strong> regulati<strong>on</strong> properly<br />

than quickly. Key aspects <strong>of</strong> <strong>the</strong> firm level regulati<strong>on</strong> could begin with individual<br />

licensing tied to <strong>the</strong> development <strong>of</strong> educati<strong>on</strong> programs.
