18 The Southport School International Handbook i. Failure to maintain satisfactory course progress (visa condition 8202). ii. Failure to maintain satisfactory attendance (visa condition 8202). iii. Any behaviour identified as resulting in enrolment cancellation in The Southport School’s Behaviour Policy/Code of Conduct. 8. School Default Any default by the School must be compliant with the provisions of the ESOS Act 2000 and the ESOS regulations 2001 (as amended). a) If for any reason the School is unable to offer a course, a full refund of fees paid will be made within 14 days of the agreed starting day. b) If for any reason the School is unable to continue offering a course after student commencement, a full refund of tuition fees paid, including for the portion of the course already taught, will be made within 14 days of the day the course ceased to be delivered. 9. This agreement, and the availability of complaints and appeals processes, does not remove the right of the student to take action under Australia’s consumer protection laws. 10. Definitions a) Course money – includes tuition fees, any amount received by the School for Overseas Student Health Cover (OSHC) and any other amount the student has to pay in order to undertake the course. b) Course – refers to the CRICOS Registered Course. eg: Primary Prep – Year 7 Boys (000724G); Secondary Junior Years 8, 9 and 10 Boys (004962F); and Senior Secondary Years 11 – 12 Boys (004963E).
The Southport School International Handbook 19 Students Living Arrangements and Welfare Policy For purposes of safety and duty of care, The Southport School’s enrolment policy requires that visa students in Years 1 to 6 should have one of their parents residing on the Gold Coast to supervise and be responsible for them. Visa students in Years 7 to 12 who do not have a parent residing on the Gold Coast will live in the School’s Boarding House to ensure students are safe and properly cared for, and to provide suitable conditions for study. The exceptions are when legally binding arrangements exist, the School may agree to allow an alternative arrangement whereby the student resides with a direct family member over the age of 21 years. Years 7 to 10 are accommodated in share dormitory style areas. Single rooms are allocated to boys in the senior Years 11 and 12. In vacation periods when the Boarding House is closed, boarders are required to return to their parents, reside with a direct family member over the age of 21 years; or for parents to make written application to the Dean of Students for an alternative, supervised arrangement which is considered acceptable by the School in respect of the school’s responsibility for the student’s welfare whilst in Australia. It is not possible for boarders to remain in the Boarding House during vacation periods. The School’s catering service endeavours to provide a familiar diet for boys from other countries whilst also catering for specific dietary requirements. All The Southport School staff, including all full and part-time staff employed in the Boarding House, are required to hold Suitability for Child-Related Employment cards, issued by the Queensland Government (commonly known as Blue Cards) and have met the criteria required of the Commission for Children & Young People’s Act, 2000. Given due consideration to the School’s Duty of Care for its International Students, it is School Policy that International Students do not engage in part-time or casual employment whilst they are enrolled as students at The Southport School. This policy is in place to ensure that the student’s welfare is not compromised by agents outside of the School and that the student is able to focus his energies on his academic studies and other extra-curricular school-based commitments. The focus of an International Student’s education at TSS is directed towards his membership of a Christian learning community providing a balance and holistic education in a safe, supportive and encouraging environment. This focus along with the School’s Duty of Care could be compromised if International Boarders were permitted to spend significant time off campus involved in activities other than those for which they have enrolled at the School. School Holiday Arrangements - The boarding house is closed during school holidays. Students must either return home to their parents/legal guardians OR an option is available to stay in a ‘home stay’ environment with students placed by Imagine Education Australia, by arrangement with TSS. Additional fees apply. TSS has an arrangement with Imagine Education (also a CRICOS Provider) to provide homestay for students from Year 7 and above to be placed into homestay during school holidays. TSS is satisfied Imagine Education’s policies and procedures for recruiting, recommending, assessing, approving accommodation and welfare arrangements including monitoring, review and termination, are sufficient to satisfy legislative requirements and duty of care. Procedures are in place for checking suitability of accommodation and welfare including ongoing monitoring, agreements if other providers are involved regarding the responsibility for students. TSS acknowledges responsibility for the welfare of these students, even whilst placed in homestay as per the CAAW letter signed by TSS. TSS will monitor student/parent/guardian satisfaction with homestay arrangements by a Homestay Questionnaire completed by students and families. Any concerns will be immediately addressed with Imagine Education and improvements implemented if necessary.
