The law has changed the balance <strong>in</strong> favor of consumers, remov<strong>in</strong>g from them<br />
the burden of proof. It is now <strong>in</strong>cumbent upon the manufacturer to produce<br />
evidence that his goods are <strong>in</strong> compliance with standards, rather than upon<br />
the customer responsible to prove that goods are defective or dangerous. This<br />
is a feature can be <strong>in</strong>voked when deemed appropriate by a judge, l<strong>in</strong>e with l<br />
requirements established <strong>in</strong> law.<br />
Other new features implemented by the law are: (i) the adoption of the doctr<strong>in</strong>e<br />
commonly known as “disregard of the corporate entity” (with a broader scope<br />
than found <strong>in</strong> US and European models); (ii) a new treatment of civil liability<br />
<strong>in</strong> cases of product failure, <strong>in</strong> which the producer or manufacturer liable is<br />
held responsible even without malice or specific <strong>in</strong>tention to cause damage (a<br />
different pr<strong>in</strong>ciple is <strong>in</strong>voked <strong>in</strong> the case of services provided by such professions<br />
as dentists, eng<strong>in</strong>eers etc.); (iii) particularly strict advertis<strong>in</strong>g rules. In all cases,<br />
the basic constitutional pr<strong>in</strong>ciple of “due process of law” is ma<strong>in</strong>ta<strong>in</strong>ed.<br />
As a consequence of these protective regulations, manufacturers and service<br />
providers must now be much more careful with their products or output. <strong>Legal</strong><br />
counsel is recommended and often required, from the pre-manufactur<strong>in</strong>g phase<br />
to actual on-shelf exhibition.<br />
27.4. En<strong>for</strong>cement<br />
From the standpo<strong>in</strong>t po<strong>in</strong>t of view of a <strong>for</strong>eign lawyer, Interpret<strong>in</strong>g <strong>Brazil</strong>ian<br />
Consumer Law is a most demand<strong>in</strong>g process. The key to understand<strong>in</strong>g and<br />
master<strong>in</strong>g this law is accept<strong>in</strong>g that it br<strong>in</strong>gs together <strong>in</strong> a s<strong>in</strong>gle package, civil,<br />
adm<strong>in</strong>istrative, and crim<strong>in</strong>al sanctions.<br />
Indeed, many behaviors are now regarded as crim<strong>in</strong>al, yet the code reaffirms the<br />
constitutional right of a defendant to due process of the law. Even the draft<strong>in</strong>g<br />
of contracts is now a much more <strong>in</strong>tricate task, <strong>in</strong> view of heavy penalties <strong>for</strong><br />
abusive clauses. Advertis<strong>in</strong>g has also been targeted by policy-makers, rais<strong>in</strong>g<br />
great need <strong>for</strong> caution <strong>in</strong> pre-contractual commitments implied by press or<br />
media releases.<br />
27.5. Trends<br />
The <strong>Brazil</strong>ian consumer protection code is compatible with the world’s most<br />
modern legislations. <strong>Brazil</strong>ian courts have been cautious <strong>in</strong> apply<strong>in</strong>g the law,<br />
and have so sought to ensure that it atta<strong>in</strong>s its ma<strong>in</strong> objective, i.e., protect<strong>in</strong>g<br />
consumers whilst at the same time enhanc<strong>in</strong>g healthy competition between<br />
