(A)<br />

Particulars of its organizati<strong>on</strong>s, functi<strong>on</strong>s and duties:-<br />

MANDATE:<br />

The Direc<strong>to</strong>rate of Marketing and Inspecti<strong>on</strong> (DMI) is an attached Office of the<br />

Ministry of Agriculture. It was set up in the year 1935 <strong>to</strong> implement the agricultural<br />

marketing policies and programmes of the Central Government. Since its incepti<strong>on</strong>,<br />

the Direc<strong>to</strong>rate c<strong>on</strong>tinues <strong>to</strong> be resp<strong>on</strong>sible for bringing about an integrated<br />

development of marketing of agricultural and allied produce in the country with a view<br />

<strong>to</strong> safeguard the interests of producer-sellers as well as the c<strong>on</strong>sumers. It maintains a<br />

close liais<strong>on</strong> between the Central and the State Governments in the implementati<strong>on</strong> of<br />

agricultural marketing policies in the country.<br />

The details regarding running of different schemes under the Direc<strong>to</strong>rate are<br />

available through Home Page.<br />

ORGANISATIONAL SET UP:<br />

The Direc<strong>to</strong>rate is headed by the Agricultural Marketing Adviser <strong>to</strong> the Govt. of<br />

India (AMA). The Direc<strong>to</strong>rate has its Head Office at Faridabad (Haryana), Branch Head<br />

Office at Nagpur (Maharashtra) and 11 Regi<strong>on</strong>al Offices at Delhi, Mumbai, Chennai,<br />

Kolkata, Hyderabad, Chandigarh, Jaipur, Lucknow, Bhopal, Kochi and Guwahati and the<br />

Central Agmark Labora<strong>to</strong>ry at Nagpur. Besides, there are 26 Sub-Offices, 11 Regi<strong>on</strong>al<br />

Agmark Labora<strong>to</strong>ries (RALs) spread all over the country as per the details given below:-<br />

(B)<br />

The powers and duties of its Officers and Employees:<br />

The following Powers have been delegated <strong>to</strong> the in-charge of Regi<strong>on</strong>al<br />

Offices, New Delhi, Mumbai, Kolkatta, Chennai, Hyderabad, Chandigarh,<br />

Guwahati, Cochin, Lucknow, Jaipur and Bhopal of the DMI under GGM Rules<br />

1988:-<br />

i) To approve the chemist of Commercial Labora<strong>to</strong>ry, Co-operative/Associati<strong>on</strong><br />

Labora<strong>to</strong>ry and State Grading Labora<strong>to</strong>ry.<br />

ii)<br />

iv)<br />

To enter any premises at any reas<strong>on</strong>able time and inspect in s<strong>to</strong>rage,<br />

processing, packaging and transit, and search for the Agricultural Produce if<br />

he has reas<strong>on</strong>s <strong>to</strong> believe that any provisi<strong>on</strong> of the <strong>Act</strong> or the rules made<br />

thereunder has been, or is being c<strong>on</strong>travened.<br />

To seize any article, if he has reas<strong>on</strong>s <strong>to</strong> believe that any provisi<strong>on</strong> of the <strong>Act</strong><br />

or the rules made thereunder has been c<strong>on</strong>travened.<br />

To serve written order <strong>to</strong> the owner or authorized representative of the<br />

owner of the c<strong>on</strong>cerned premises or establishment, that he/she shall not<br />

remove or part with or otherwise deal with the article except with the<br />

previous permissi<strong>on</strong>, if he finds it not practicable <strong>to</strong> seize any such article.<br />

v) To dispose of such article, if he is of the opini<strong>on</strong> that the article so seized or<br />

detained is subject <strong>to</strong> speedy or natural decay or it is otherwise expedient in<br />

the public interest <strong>to</strong> do so, in the manner as prescribed, in clause (a), (b),<br />

(c), (d) and (e) of this sub-rule.<br />

The following Powers have been delegated <strong>to</strong> the in-charge of Regi<strong>on</strong>al<br />

Offices New Delhi, Mumbai, Kolkatta, Chennai, Hyderabad, Chandigarh,<br />

Guwahati, Cochin, Lucknow, Jaipur & Bhopal and Sub-offices, Bangalore,<br />

Dehradun, Patna, Bhubaneswar, Ahmedabad, Ranchi, Jammu, Shimla,<br />

Raipur, Shill<strong>on</strong>g of the DMI under GGM Rules 1988:-<br />

(i)<br />

To grant Certificate of Authorizati<strong>on</strong> for grading and marking of an article in<br />

accordance with the provisi<strong>on</strong>s of the Rule made under the <strong>Act</strong>;<br />

(ii) a) To have access <strong>to</strong> the premises named in the certificate of authorizati<strong>on</strong><br />

for ascertaining that marking is correctly performed.<br />

b) To examine the record of the package marked with each<br />

grade designati<strong>on</strong> maintained by the authorized packers.<br />

c) To open and inspect any package bearing a grade designati<strong>on</strong> mark or <strong>to</strong><br />

take samples of any graded produce provided that all samples shall be<br />

paid for.


d) To cancel or remove a grade designati<strong>on</strong> mark from any produce, should<br />

such produce be found <strong>to</strong> be not c<strong>on</strong>forming <strong>to</strong> the definiti<strong>on</strong> of quality<br />

prescribed for the grade designati<strong>on</strong> assigned.<br />

e) To ask the authorized packer in writing <strong>to</strong> hand over the certificate of<br />

authorizati<strong>on</strong> at any time and give proper receipt therefor.<br />

To renew the Certificate of Authorizati<strong>on</strong> in accordance with the provisi<strong>on</strong>s of the<br />

Rule made under the <strong>Act</strong>;<br />

To record changes in the name, style or address of the authorized packer and<br />

change of authorized premises in the Certificate of Authorizati<strong>on</strong>.<br />

To suspend or cancel any Certificate of Authorizati<strong>on</strong>, if he is satisfied:-<br />

(a) that the authorized packer has not applied, the grade designati<strong>on</strong> marks<br />

correctly; or<br />

(b) that the authorized packer has c<strong>on</strong>travened any of the provisi<strong>on</strong>s of the <strong>Act</strong>;<br />

or<br />

(c) that the authorized packer has violated any Rule or has failed <strong>to</strong><br />

comply with any of the instructi<strong>on</strong>s issued under the provisi<strong>on</strong>s of the <strong>Act</strong>,<br />

subject <strong>to</strong> the c<strong>on</strong>diti<strong>on</strong>s as stipulated under Sub-rule (2) and (3) of Rule 7.<br />

To approve the Labora<strong>to</strong>ry set up by the packer, for grading and marking of an<br />

article under provisi<strong>on</strong>s of the <strong>Act</strong>.<br />

(vii) To withdraw the approval of the labora<strong>to</strong>ry, if there is sufficient reas<strong>on</strong>s <strong>to</strong><br />

believe that the Grading and Marking is not d<strong>on</strong>e correctly and or that the rules<br />

and instructi<strong>on</strong>s issued thereof are not followed provided that a 14 days notice,<br />

in writing shall be given <strong>to</strong> the owner of the labora<strong>to</strong>ry, and an opportunity given<br />

for showing cause why the approval should not be withdrawn.<br />

(viii) To approve the chemist appointed by the packer for manning the grading<br />

labora<strong>to</strong>ry.<br />

To withdraw the approval accorded <strong>to</strong> the chemist for grading and marking of<br />

an article under provisi<strong>on</strong>s of the Agricultural Produce (Grading and Marking)<br />

<strong>Act</strong>, 1937, if the chemist has failed <strong>to</strong> comply with the prescribed instructi<strong>on</strong>s or<br />

procedures for grading and marking or violated any of c<strong>on</strong>diti<strong>on</strong> of approval<br />

provided that an opportunity shall be given <strong>to</strong> the approved chemist for showing<br />

causes as <strong>to</strong> why the approval should not be withdrawn;<br />

To grant permissi<strong>on</strong> for use of “Agmark replica” in lieu of Agmark labels <strong>to</strong> the<br />

authorized packers;<br />

To grant permissi<strong>on</strong> <strong>to</strong> the Printing Press or manufacturing units for printing<br />

and/or manufacturing of the c<strong>on</strong>tainer bearing the “Agmark replica” ;<br />

To withhold or withdraw the issue or use of grade designati<strong>on</strong> marks i.e. Agmark<br />

labels or Agmark replica bearing c<strong>on</strong>tainers without any notice for such a period<br />

as he may c<strong>on</strong>sider expedient in the interest of better marketing if such


authorized officer is satisfied or has reas<strong>on</strong>s <strong>to</strong> believe that the authorized packer<br />

is not applying or is not likely <strong>to</strong> apply, grade designati<strong>on</strong> marks correctly;<br />

(xiii) To call for informati<strong>on</strong>, report or return in respect of any of the scheduled<br />

articles from the authorized packers;<br />

(xiv) To issue certificate of Agmark grading in prescribed form, for export c<strong>on</strong>signment<br />

of a scheduled article graded and marked under the provisi<strong>on</strong> of the <strong>Act</strong>;<br />

(xv)<br />

To endorse Certificate of Agmark Grading in favour of the exporter who is not an<br />

authorized packer.<br />

(xvi) To direct the c<strong>on</strong>cern authorized packer and or the seller of graded product, as<br />

may be decided for free-of-cost replacement of the product <strong>to</strong> the complainant<br />

with in 30 days of the issue of such directi<strong>on</strong>.<br />

The following Powers have been delegated <strong>to</strong> the In-charge of the Suboffices,<br />

Amritsar, Rajkot, Madurai, Panaji, Pune, Sangli, Nasik Road, Hubli,<br />

Guntur, Kanpur, Varanasi, Vishakhapatnam, Abohar, Surat, Nagpur,<br />

Thiruvanathapuram of the DMI under GGM Rules 1988:-<br />

(i)<br />

To grant the Certificate of Authorizati<strong>on</strong> for grading and marking of an article<br />

in accordance with the provisi<strong>on</strong>s of the Rule made under the <strong>Act</strong>;<br />

(ii) a) To have access <strong>to</strong> the premises named in the certificate of<br />

authorizati<strong>on</strong> for ascertaining that marking is correctly<br />

b) To examine the record of the packages marked with each grade<br />

designati<strong>on</strong> maintained by the authorized packers.<br />

Marketing Department / Uni<strong>on</strong> Terri<strong>to</strong>ry as under:-<br />

To receive the applicati<strong>on</strong> for grant of Certificate of Authorizati<strong>on</strong> for domestic<br />

grading;<br />

(ii) To arrange for verificati<strong>on</strong> of b<strong>on</strong>a fides of the applicant and inspecti<strong>on</strong><br />

of the premises Labora<strong>to</strong>ry, processing units and <strong>to</strong><br />

recommend grant of C.A. for domestic grading;<br />

To obtain informati<strong>on</strong>, report, return in respect of any of the Scheduled articles;<br />

To inspect the authorized grading premises and <strong>to</strong> ascertain that grading and<br />

marking of de-centralized commodities is correctly performed;<br />

(viii) To examine the record maintained by the authorized packers of de-centralized<br />

grading;<br />

To open and inspect any package bearing grade designati<strong>on</strong> mark and <strong>to</strong> take<br />

samples of any graded produce provided all samples shall be paid for;<br />

covered under decentralized grading if found not c<strong>on</strong>forming <strong>to</strong> the prescribed<br />

grade specificati<strong>on</strong>s .

(C)<br />

The procedure followed in the decisi<strong>on</strong> making process, including<br />

channels of supervisi<strong>on</strong> and accountability:<br />

Head Office


Matters relating <strong>to</strong> Administrati<strong>on</strong> Wing are examined in Secti<strong>on</strong>s by<br />

UDC/Assistants. These are put up <strong>to</strong> Direc<strong>to</strong>r(Admn.) through Under Secretary/Secti<strong>on</strong><br />

Officers. The cases of Administrati<strong>on</strong> Divisi<strong>on</strong> are disposed off by Direc<strong>to</strong>r(Admn.) and<br />

Agricultural Marketing Adviser <strong>to</strong> the Government of India(AMA)as per powers<br />

delegated under DFPRs/FRs/SRs/C<strong>on</strong>duct Rules/CCS(CCA)Rules etc. Head of Deptt.<br />

has re-delegated some of his powers <strong>to</strong> Direc<strong>to</strong>r(Admn.) and the incharges of BHO, CAL<br />

and field offices for smooth functi<strong>on</strong>ing of the Direc<strong>to</strong>rate. AMA is the Head of<br />

Department and appointing authority in respect of Group ‘B’ officers and appellate<br />

authority in respect of Group ‘C’ employees. Matters relating <strong>to</strong> technical wings are<br />

handled by M.O./S.M.O. and put up <strong>to</strong> AAMA/Dy.AMA. The decisi<strong>on</strong> is taken by<br />

Jt.AMA/Addl.AMA/AMA.<br />

BHO, Nagpur<br />

. All matters relating Group ‘C’ employees are dealt in BHO, Nagpur. At present BHO,<br />

Nagpur is headed by Dy. AMA. Direc<strong>to</strong>r (A), DMI, Faridabad is the appointing and<br />

disciplinary authority in respect of Group C employees. Cases are examined in Secti<strong>on</strong>s<br />

headed by Secti<strong>on</strong> Officer/Marketing Officer/Senior Marketing Officer and put up <strong>to</strong><br />

Dy.AMA through S.O. and AAMA. Cases requiring the approval of Direc<strong>to</strong>r (A)/ Joint<br />

AMA,/Additi<strong>on</strong>al AMA and AMA are put up <strong>to</strong> them by Dy. AMA, Nagpur.<br />

Field Offices<br />

Cases are examined by M.O./S.M.O. and put up <strong>to</strong> S.M.O./AAMA/Dy.AMA. Cases not<br />

covered under the power delegated <strong>to</strong> them are sent <strong>to</strong> Dy. AMA,<br />

Channels of supervisi<strong>on</strong> and its accountability:<br />

At present this Direc<strong>to</strong>rate is having 11 Regi<strong>on</strong>al offices and 26 sub-offices<br />

spread through out the country. Powers have been delegated <strong>to</strong> the in-charges of<br />

Nati<strong>on</strong>al Workshop <strong>on</strong> Enhancing Competitiveness of Indian Agriculture<br />

was held in April,<strong>2005</strong> in New Delhi.<br />

All the Regi<strong>on</strong>al/ Sub-offices of the Direc<strong>to</strong>rate organize C<strong>on</strong>sumers’ Day<br />

<strong>on</strong> 15 th March every year through out the country for awareness of the<br />

in all the States for popularizati<strong>on</strong> of Agmark and other Plan schemes and<br />

for awareness of the public. This Dte. also participate Internati<strong>on</strong>al Trade<br />

Fair and AAHAR at Pragati Maidan, New Delhi, every year for<br />

popularizati<strong>on</strong> of Agmark and other activities of the Dte.

C<strong>on</strong>ference of Agricultural Ministers of all the States was held in Bangalore<br />

in November,2004 for development of Agricultural Marketing<br />

Infrastructure and Agricultural Marketing Reforms.<br />

For popularizati<strong>on</strong> of Agmark Scheme, field publicity is being d<strong>on</strong>e<br />

periodically through Regi<strong>on</strong>al/ Sub-offices at Agricultural Produce<br />

Marketing Committee level for the benefits of the farmers.<br />

Under Rural Godown Scheme publicity and awareness programme for<br />

farmers are held through out the country by DMI in collaborati<strong>on</strong> with<br />

NIAM. Workshop/ Seminars were also held for this purpose.<br />

2. In case the informati<strong>on</strong> asked from the CPIO under the <strong>Act</strong> is available <strong>on</strong>ly at<br />

Sub-Office/RAL level, the request would be transferred <strong>to</strong> the In-Charge of Sub-<br />

Office/RAL level, the request would be transferred <strong>to</strong> the In-Charge of such Sub-<br />

Office/R.A.L(Assistant CPIO) for reply direct <strong>to</strong> the applicant.<br />

3. The ACPIOs shall provide the informati<strong>on</strong> directly <strong>to</strong> the applicants in respect of<br />

informati<strong>on</strong> held by them in respect of Sub-Offices/R.A.Ls assuming themselves as CPIO<br />

for the particular field office.<br />

Though, every efforts have been made <strong>to</strong> publish the above informati<strong>on</strong><br />

correct as far as possible. However, in case, any error is notice by the<br />

viewer, the same may be intimated <strong>to</strong> the Under Secretary, Direc<strong>to</strong>rate of<br />
