CONCLUSION<br />

For the reasons above, this Court should note<br />

probable jurisdiction and either summarily reverse<br />

the decision and remand for an adequate trial under<br />

the appropriate constitutional standards or require<br />

full argument and briefing of the important questions<br />

presented.<br />
