• On 5 and 6 July, a seminar was held
in Sarajevo, on the topic of
Registration of Business Entities.
Following the transfer of competence
for registration of business entities
from cantonal to municipal level,
municipal courts were informed
about implementation of current
legislation. However, we are soon to
apply new legislation in this area.
Along with 16 participants, trainers
included the following: judge Predrag
Krsmanovic (CC Tuzla), judge Mesud
Djanic (CC Bihac), judge Braco Stupar
(MC Sarajevo), judge Branka Vidovic
(MC Tuzla) and Ms. Natasa Vucetic
(DFID project coordinator).

FBiH Judicial Training Centre had no
training activities in the month of
august, as it was annual leave time.
This time was used for evaluation of
activities to date, as well as
preparation of activities in the second
half of the year.
September
• On 7 and 8 September, a seminar was
held in Neum on Offences Related to
Domestic Violence and the Law on
Protection from Domestic Violence,
with a total of 27 participants. The
seminar considered the legislative
framework for offences defined as
domestic violence in criminal

• On 3 July a seminar was held in Banja
Luka on Enforcement Procedure
(application of legislation and
practical problems), which outlined
the key problems in enforcement
procedures that judges deal with in
their daily work. The topic of
Enforcement over Immovable
Property triggered numerous
comments and questions from
participants, in light of the situations
arising in enforcement over
immovable property not registered as
such. The seminar was moderated y
judge Rosa Obradovic of the Banja
Luka District Court.
• On the same day, in collaboration with
the Ministry for Families, Youth and
Sports of Republika Srpska, the Centre
organised a seminar on
Implementation of the Law on
Protection from Domestic Violence,
on Mt. Kozara.
In addition to trainers from the Centre,
presenters included Mr. Dusko
Radosevic form the RS Ministry of
Justice, Dr. Ivanka Markovic,
professor at the Banja Luka School of
Law, Mr. Nikola Dorontic from the
Banja Luka Social Work Centre, Mr.
Sasa Savicic from the Gender Centre,
Ms. Dragana Dardic from the Helsinki
Citizens’ Parliament, and judge Milica
Peric from the Bijeljina Basic Court.

Banja Luka, and Ms. Peric, together

victims of violence, psychological
care for victims of violence,
misdemeanour aspects of domestic
violence, and experiences of social
work centres. Speakers included
prosecutor Hajrija Muftic-
Hadziomerovic (FBiH prosecutor),
Ms. Sabiha Husic and Ms. Aida
Ganovic (Medica Zenica), judge Izet
Odobasic (president of the Bihac
KCP) and representatives of the
Social Work Centre of the Sarajevo
Canton.
• On 14 and 15 September, a seminar
was held in Sarajevo on The Role of
Judges in Enforcement Procedure.
The seminar was attended by 43
judges and advisory staff from across
FBiH. Presenters of the Centre
included judge Jasminka Kubat (MC
Zenica), judge Milorad Krkljes and
judge Janja Jovanovic (MC Sarajevo).
Along with practical examples, the
following issues of enforcement were
considered: bases for enforcement
orders, security measures,
enforcement over immovable
property, determination of value of
immovable property, decisions on
sale of property, decisions on transfer
of property (content and meaning),
decision on compensation,
enforcement over movable property
and money claims. The participants
showed considerable interest, so that
along with top evaluation results a
request was made to organise more
with the participants, conducted a case
study related to domestic violence.
The participants found the topic very
interesting and useful and suggested
similar workshops in the near future.
• The Centre is active in following up on
new legislation, and on 7 July it
organised a seminar for judges
working in the petty offence courts, on
the topic of the RS Law on Petty
Offences. Speakers included Drago
Seva, president of the Banja Luka
Petty Offences Court, and Dusko
Miloica, president of the Prijedor
Petty Offences Court, who presented
new provisions in the RS law which
are to be applied as of 1 September
2006. By that date, basic courts in RS
will have appointed judges to deal
specifically with such cases.
Representatives of the BiH High
Judicial and Prosecutorial Council
working on the reform of petty offence
courts, Mr. Branko Buzakovic and Mr.
Admir Suljagic, informed the
participants that a training manual is
being prepared, to cover all the new
laws in the area. Following the
appointment of judges,
representatives of HJPC and UNDP
will, in collaboration with the Centre
and with the aim of providing judges
with new knowledge, organise a
series of seminars in this field, to
cover all the new provisions.

• On 14 and 15 September, a seminar
was held in Sarajevo, in collaboration
with CoE – CARDS-CARPО project,
on Application of Procedural
Measures for Witness Protection.
The seminar was attended by 38
participants. It considered legal and
institutional framework and
international cooperation, receipt of
reports on offences from the point of
view of identification of cases of
witness intimidation, collection of
information from victims and
witnesses, the use of interviews,
collaboration between police and
prosecutors, specific features of
taking statements and protection of
underage witnesses, trauma and
stress and assistance for victims and
protected witnesses, investigation
procedures without revealing the
identity of witnesses and proposals
for procedural protection measures,
assessment of intimidation and
threat, data protection and protection
and support for protected witnesses
during criminal proceedings,
decisions on protection, interviewing
protected witnesses during the main
hearing. Presenters of the Centre

For that purpose, the Centre
distributed questionnaires to all the
courts and prosecutors’ office, in order
for judges and prosecutors to make
suggestions and give proposals and
thus play an active role in designing
programmes for the coming year,
suited to their needs. The Centre
remains open for all their proposals,
suggestions and comments, and
invites all the parties concerned to
become involved in curriculum
design.
September
• In compliance with its programme, on
11 September the Centre organised a
seminar on Joint Training for Judges
and Civil Servants Responsible for
Implementation of Legislation in
Taxation Procedures and Taxation
Administration. In addition to judges
and court assistants, the seminar was
attended by representatives of the Tax
Administration of Republika Srpska.
The seminar topic ‘Experiences of the
RS Supreme Court in Application of
Taxation Legislation in Administrative
Matters’ was covered by Mr. Janko
Ninic, Judge of the RS Supreme Court,
and ‘Experiences of the RS Taxation
Administration in Application of
Taxation Legislation through the work
of the Appeals Board’ was presented
by Ms. Ljiljana Nadj Stojicic, legal

• On 19 and 20 September, a seminar
was held in Bihac on Offences
Related to Customs and Tax and the
New Taxation System – VAT. The
seminar included 28 participants. It
considered the role, organisation and
competences of the Indirect Taxation
Authority, procedures in the VAT
system, current situation in
implementation of VAT and number
and type of offences related to
customs and VAT, substantive and
procedural aspects of prosecution of
offences in this area, connections
between tax evasion and other forms
of fraud (customs fraud, forgery of
value labels, smuggling, forgery of
documents, illegal production) –
experiences of the Indirect Taxation
Authority in BiH. Presenters included
Mr. Saudin Terzic, Mr. Dinko
Corluka, Mr. Dejan Radic, Mr. Goran
Glamocanin, Ms. Vladana Markovic,
Mr. Enes Smajlovic, Mr. Elvir Sacic
(Indirect Taxation Authority), and
prosecutor Ismet Suskic.
• On 20 September, a seminar was held
in Sarajevo on the Family Law. The
new Family Law in BiH ( in force as
of September 2005) established key
novelties in regulating and
prosecuting cases in the field of
issues and complaints advisor to the
Director of the RS Taxation
Administration. Mr. Zlatko Kulenovic,
Judge of the RS Supreme Court, spoke
on Observance of Rules of Procedure
in Rulings in Administrative Matters.
It was stated by all the participants
that there is a constant need for this
type of joint training, as it contributes
to greater efficiency of taxation
authorities.
• On 15 September, the Centre hosted a
seminar on Current Issues in the
work of District Courts and
Prosecutors’ Offices for the Banja
Luka District’. The seminar was
organised as a two-segment
interactive workshop. The first part
included separate workshops for
judges and prosecutors. Judges
discussed ‘Confirmation of
Indictments and Acceptance of Guilty
Pleas’, introduced by Ms. Svetlana
Maric, judge of the Banja Luka District
Court. Following an introduction by
Mr. Vitomir Soldat, Chief District
Prosecutor for Banja Luka, the
participants discussed the issue of
‘Content of Indictments and
Amendments to Indictments at the
Main Hearing’. The second part was a
plenary, which presented conclusions
from the workshops, followed by a
debate between judges and
prosecutors.
• On 22 and 23 September, a seminar
was held in Banja Luka, in
collaboration with the CoE CARDS

family relations. In their
presentations, Professor Suzana Bubic
(Mostar School of Law) and Ms.
Ljiljana Zita (FBiH Ombudsman’s
Office) and Mr. Dzemaludin
Mutapcic, as well as Ms. Bisera
Hadzajlic (Sarajevo Canton Social
Work Centre) looked at novelties,
current challenges in the application
and experiences gained thus far.
Opinions were exchanged on
experiences of courts in different
parts of FBiH, and individual issues
of interest for designing effective
policy were considered. The seminar
was attended by 86 participants from
across FBiH. In addition to judges, the
seminar was attended by
representatives of social work centres,
police forces, Ministry of Justice,
schools of law, Ministry of Labour
and Social Policy. It was noted that
there was a need for a training
module in this area, and more
seminars on the topic.
• On 21 and 22 September, a seminar
was held in Sarajevo on Introduction
to Judicial and Prosecutorial
Organisation, Governmental and
Non-Governmental Institutions, and
the BiH Social Environment that
Judges Work In, with a total of 21
participants. The seminar looked at
the positive role of the BiH HJPC, and
the organisation of judicial and
prosecutorial system in BiH,
organisation and procedures before
the Office of the Disciplinary
Prosecutor, professional development
system, relations between ordinary
CARPO project, titled Training on
Application of Procedural Protection
Measures. The topics included: legal
and institutional framework for
procedural measures of witness
protection, repors on offences in
relation to identification of cases of
witness intimidation and tampering,
and adequate and prompt reporting to
relevant services on the need for
measures of protection and support;
collection of information form victims
and witnesses, utilisation of police
interviews, collaboration between
police and prosecutors, data
protection, assessment of the level of
threat, identification of intimidation,
proposals for measures of procedural
protection, decisions on protection and
support for protected witnesses
during criminal proceedings. Seminar
presenters included judges,
prosecutors and members of SIPA
who had gone through train the
trainers programme in this area,
organised for the region: Mr. Vaso
Marinkovic and Ms. Jasmina Gafic,
FBiH prosecutors, Mr. Muris Brkic,
investigator from the BiH Prosecutor’s
Office, Ms. Gordana Loncar,
prosecutor of the District Prosecutor’s
Office, Banja Luka, Ms. Daniela
Milovanovic, judge of the Banja Luka
District Court, and Mr. Enes Karic and
Ms. Ranka Vasijevic, SIPA officers.
• On 27 September, the Centre hosted a
workshop for judges responsible for
registration of business entities, on
Application of Legislation on

and constitutional judiciary,
professional organisations in the
judiciary, the FBiH Government, with
an overview of principles of
monitoring implementation of laws,
practice and experiences of the State
Border Service, reform of legislation
on demeanours (petty offences) and
current issues in enforcement of court
rulings. Trainers included: Mr. Arben
Murtezic (HJPC Secretariat), Mr.
Andjelko Marijanovic (Disciplinary
Prosecutor), Mr. Radoslav Marjanovic

• On 25 September, a seminar was held
in Sarajevo on Inheritance Procedure
and Legislation on Inheritance. The
seminar was attended by 32
participants from across FBiH. Along
with trainers, judge Sida Jasarspahic
(Court of BiH) and judge Jasminka
Kubat (Municipal Court Zenica), and
using interactive debates based on
hypothetical approaches to practical
examples, numerous issues were
discussed, including procedural and
substantive aspects of the Law on
Inheritance and its application. With
superb evaluation results in terms of
quality of the seminar, a request was
made to continue training activities
with the same interactive approach.
Determination and Transfer of
Rights of Disposal of Property to
Units of Local Self-governance’. In
addition to judges, the seminar was
attended by representatives of the
Securities Commission and the Central
Register of Securities of Republika
Srpska. Workshop participants
discussed provisions of the law and
practical problems in registration
courts related to entries of property
transferred from units of local selfgovernance
to companies. The issue of
full implementation and creation of all
the preconditions for implementation
of the Law on Entry of Business
Entities in the Court Register was
raised again, and an appeal was sent
to the authorities to provide measures
for its full implementation and
observance of the prescribed
deadlines.

• On 25 September, a seminar was held
in Sarajevo on Land Registry Issues
and Lien over Movable Property. 39
judges and court assistants attended
the seminar, which considered issues
of land registry reform, lien over
movable property, and other issues of
importance for judges working in this
area. Presenters included judge Goran
Salihovic (President of the Sarajevo
Cantonal Court), lawyers, experts in
economics and IT from GTZ/ CIDА/
АDА, Ms. Samira Leskovac and Ms.
Jasmina Kurbasic. Mr. Milan Bajic
and Ms. Azra Crnkic considered
different aspects of reform and
experiences in this area.
Joint Activities of the Centres in the Period
from July to September
• 13-14 July, in collaboration with CIDA/CoE and the JTC RS, a seminar was held
in Gracanica, on Train the Trainers – Justification of Judgements. The seminar
included 13 participants. Topics included justification of judgements and rulings,
requests based on the law – constitutional, international and general aspects,
determination and assessment of facts and their presentation, justification of
judgements with different outcomes and the burden of proof. Presenters
included Professor Eduard Kuntisek from the University of Rijeka, Croatia and
Dr. Horst Proetel, retired judge of the Higher Regional Court of Thueringer
Oberlandesgericht-Jena.
• On 4–8 July in Tuzla, 11-15 July in Teslic, 18-22 July in Bihac, and 25–29 July in
Sarajevo, as part of joint activities in collaboration with JTC RS and HJPC, the
Centre organised a series of seminars on Improving Management Capacities at
First and Second Instance Courts. The outcome of the seminars, which included
all the presidents of municipal and cantonal courts, is a set of training materials
which will be available through a special link at the Centre’s web site. The
materials will deal with topics of interest for the courts, such as case

management, human resources management, and change management.
• In the period 7-8 July, JTC FBiH and JTC RS, in collaboration with the IRZ
foundation, organised a series of seminars on Mt. Kozara, dealing with the topic
of Law in the Market Economy. The seminar was attended by judges from both
Entities.
• Seminars were held on 6-9 September in Neum, and on 12-14 September on Mt.
Jahorina, on Managing Difficult Proceedings – Case Presentation Skills,
organised by the American Bar Association / Central and Eastern European Law
Initiative – АBА CEELI, the US Ministry of Justice, UNDP, JTC FBiH and JTC
RS, on collaboration with the National Institute for Trial Attorneys (NITA),
leading organisation in this field in the US. Topics included preparation for
trials, witness statements, direct and cross-examination. Presenters included Mr.
Јаmes Gailey, Mr. Charles Brown, Mr. Steven Kessler, and Mr. Peter Schenck.
• A seminar was held on Mt. Vlasic, 18-20 September, organised by UNDP in
collaboration with JTC FBiH and JTC RS, on the topic of War Crimes, attended
by 21 participants from FBiH. The seminar considered the role of courts in BIH
in light of the legal tradition in cases of war crimes, and sentencing practices in
such cases. The seminar was organised as a series of workshops, and at the end
of each day the groups presented their results. Presenters included Mr. Zoran
Pajic, Mr. William Schabas, judge Azra Miletic and judge Shireen Avis Fisher
(Court of BiH), and rapporteurs for the groups included Mr. Hilmo Vucetic, Mr.
Salem Miso, Ms. Zorica Gogala and Mr. Dragomir Vukoje. Introductory address
was made by Ms. Medzzida Kreso, President of the Court of BiH.
• On 22 September, JTC FBiH and JTC RS organised a train the trainers seminar in
collaboration with CIDA/CoE, at Mt. Jahorina, on How to Identify A Mediation
Case. The seminar included 14 participants. Trainers included Mr. Adnan Novo
(BiH Mediators’ Association) and judge Yvonne Telenga (judge and mediator
from Holland). The seminar covered issues related to mediation in BiH – current
legislative framework and experience thus far, as well as issues related to
identification of cases suitable for mediation, as well as different elements of
mediation.
• Within the Regional CARDS 2003 Project, a Module 2 seminar was held in Berlin,
and a Module 3 seminar on Recognition and Enforcement of Rulings in Civil
Matters, was held in Milocer, Montenegro. The seminars were attended by
judges from both Entities.
• The Centres continued their collaboration with the expert mission of the Council
of Europe, on building capacities of the judicial training centres, financed by
CIDA, and implemented by the Council of Europe. As part of the expert mission,

oth centres were visited by Dr. Kathleen Houchin, who prepared a report and a
set of recommendations aimed at institutional development. The report was
forwarded to the centres on 15 June, based on examination of documents related
to the centres as well as interviews with all the staff. Dr. Houchin’s overall
impression was that centres were productive and that the reference texts they
produce and the training methodology they utilise reflect the centres’
professionalism, although both centres continue to work under considerable
pressure. As part of the expert mission, from 27 to 29 September the centres were
visited by Mr. Pasquale Profiti, prosecutor from Italy and a CoE expert. The aim
of the mission was to develop training needs assessment methodologies.

Other activities
• On 3 and 4 July, the Director took
part at a regional conference of JTC
directors, held in Belgrade. She
presented the work of JTC FBiH. The
conference covered issues of interinstitutional
collaboration in the
region, judicial training development
perspectives and the importance of
judicial training on the path towards
European integration. The Centre
proposed a set of joint training
programmes on issues of common
interest for judges and prosecutors in
the region, a common approach to
trainers participating in joint
programmes, exchange of reference
texts, etc. A regional working
meeting can be expected in the
autumn 2006. Conference conclusions
included recommendations for better
cooperation at the regional level. We
would like to take this opportunity to
invite judges and prosecutors to

Other activities
• Director and assistant directors held a
series of meetings with local and
foreign organisations, discussing the
Centre’s activities, its tasks and aims.
• As of 1 January 2007, in collaboration
with UNDP, the Centre is planning to
launch a project titled Legislative
One-stop Shop. Primarily aimed at
the legal profession in BiH, judges
and prosecutors, a common electronic
platform was established, containing
all the laws and regulations of
Republika Srpska, Federation BiH,
and Brcko District BH. In this way,
BiH constitutions, changes and
amendments, all the laws, regulations
and their changes and amendments,
as well as decisions of the High
Representative for BiH, can be found
at a single location. It should be noted
that the data base will be updated
regularly, with all the changes and
amendments to existing laws and

submit their proposals for joint
training programmes in the region,
via the Centre’s web site

• Through its training activities, the
Centre continued its collaboration
with governmental and NGO
institutions. We underscore our
collaboration with the FBiH Ministry
of Interior, reflected in their officers
actively participating in the Centre’s
training events.
• The Director held a series of
meetings with local and
international representatives. The
meeting with representatives of the
European Commission covered
implementation of the ТARMIS
project, and several meetings with
UNDP covered activities related to
joint organisation of seminars on
issues related to war crimes, as well
as continuation of the Centre’s
successful collaboration with UNDP
on the ‘e-legislation’ project.
Among other activities, we want to
note the Director’s meetings with
representatives of the HJPC BiH,
representatives of АBА/CEELI, and
a meeting with representatives of
CIDA (Canadian International
Development Agency), all for the
purpose of planning training and
other activities of the Centre in the
forthcoming period.

• On 3. August, a meeting was held at
the Centre, with representatives of
EUPM, in relation to continuation of
the project aimed at improving

training events. It was agreed that
joint training activities would be
included in the Centre’s annual work
plan for 2007, and details would be
specified in collaboration with the RS
Ministry of Interior and prosecutors’
offices in RS.
• On 7 September, the Director met
with representatives of ICTP, on
future collaboration and judges and
prosecutors’ training needs in IT.
• On 29 September, a meeting was held

Collected Judgements on War
Crimes, soon to be promoted at the
Court of BiH.
• Immediately after the Law on
Changes and Amendments of the
Law on Suppression of Organised
Crime and Worst Forms of Fraud
came into force, following adoption
at the RS National Assembly, HJPC
BiH announced a public competition
for the vacant position of in the
special prosecutor’s office. It was first
decided on the number of special
prosecutors. The appointment
decision was made on 14 September
2006, and on 29 September, a solemn
oath was given by the following
judges, before the President of HJPC
BiH, judge Branko Peric:

On its part, the Centre has already
initiated a training event for special
prosecutors, as part of the project
implemented by the Centre in
collaboration with ABA/CEELI, on
advocacy skills. As part of the training
organised by ICTP for SIPA, on WIN

XP, the Centre managed to include a
number of special judges and
prosecutors, as well as prosecutors of
the District Prosecutors’ Office Banja
Luka.
