O R D E R<br />

Sri B.Appalakonda, Opp:Primary School, Nehru Nagar, Gandhi Nagar Street, Yalamanchili-<br />

531 055. Visakhapatnam District has filed a 2 nd appeal dated 03-06-<strong>2009</strong> which was received by this<br />

Commission on 08-06-<strong>2009</strong> for not getting the information sought by him from the PIO / Tahsildar,<br />

Gajuwaka Mandal, Visakhapatnam and Appellate Authority / Revenue Divisional Officer,<br />

Visakhapatnam Division, Visakhapatnam District.<br />

The brief facts of the case as per the appeal and other records received along with it are that the<br />

appellant herein filed an application dated 15-01-<strong>2009</strong> before the PIO stating that the Dy. Director, Job<br />

Development, Visakhapatnam through letter No. A1/697/2007, dated 05-03-2008 requested the<br />

Tahsildar, Gajuwaka Mandal to conduct enquiry about the caste of Smt. Nalli. Krupa Manorama,<br />

Junior Employment Officer in District Employment Exchange in Vizianagaram as per the note file No.<br />

A1/16989/2007 which was received from State Information Officer, Employment & Training Wing,<br />

Hyderabad through letter No.P1/RTI/24388/2007, dated 30-06-2008 and requested to furnish the<br />

following information in Telugu:-<br />

1. Furnish copies of documents and photos.<br />

2. Furnish the written statements obtained from the officials, co-employees and public.<br />

3. Transfer certificate of the school.<br />

4. Copy of Marriage photo.<br />

5. Enquiry Report for issue of Caste Certificate. Copy of Caste Certificate.<br />

6. Furnish the copies of the certificates issued by the Church Authorities of “Johawaeece” of<br />

Gajuwaka, Manna Church of Srinagar, Gajuwaka, United Trust Church, NAD, Visakhapatnam<br />

(where Nalli Krupa Manorama is a member in these Churches).<br />

7. Furnish the copy of the Statement given by the Hindu Religion Associations that she is of<br />

Hindu Caste Lady.<br />

8. Furnish the copies of the photos which reveals the occasions such as food eating, Name<br />

declaration function, Aksharabhyasam, Birthday functions etc.<br />

9. Furnish the details of the elders who have settled the marriage of the lady and the elders who<br />

have stand the witnesses at the time of marriage and the elders of the church authorities and<br />

bishops.<br />

10. Furnish the copy of the marriage card and marriage certificate.<br />

11. Furnish the address where marriage was taken place and date of marriage.<br />

12. Furnish the copy of the reply furnished to the Dy. Director, (Job Development,<br />

Visakhapatnam) in response to this letter No. A1/697/2007, dated 05-03-2008 along with<br />

enquiry report.<br />

Stating that he did not get any reply from the Public Information Officer, the appellant filed an<br />

appeal u/s 19(1) dated 31-03-<strong>2009</strong> before the Appellate Authority/ Revenue Divisional Officer,<br />

Visakhapatnam requesting to arrange to supply the information.<br />

The Revenue Divisional Officer, Visakhapatnam through letter No. 1528/<strong>2009</strong>, dated<br />

27-04-<strong>2009</strong> requested the Tahsildar and appellant to appear before the Revenue Divisional Officer on<br />

04-05-<strong>2009</strong>. The appellant filed a reminder to the Revenue Divisional Officer on 18-05-<strong>2009</strong>.<br />

The appellant stated that as he did not get the information even after 30 days of filing his<br />

appeal, he filed this 2 nd appeal before this Commission requesting to arrange to furnish the information<br />

sought by him.<br />

The 2 nd appeal was taken on file and notices were sent to the parties concerned directing them<br />

to appear before the Commission for hearing on 29-12-2010.<br />

The Tahsildar filed an affidavit dated 08-07-2010 stating that on the request of the Dy.Director<br />

Job Development through letter dated 19-01-<strong>2009</strong> to confirm the genuiness of the Integrated<br />

Certificate which contains community, native and date of birth in respect of Smt N.K. Manorama the<br />

then Tahsildar through letter dated 16-02-<strong>2009</strong> informed the Dy. Director, Job Development that the<br />

original file has not been traced even after through search due to shifting of Mandal Revenue Officer’s<br />

Office twice from private buildings to government building. He further submitted that one Sri B.<br />

Appala Konda filed application requesting to furnish information on 12 items relating to Smt N.K.<br />

Manorama and among those items the Tahsildar has to answer only item No.5. Lastly the Tahsildar<br />

submitted that even after a through search, in the record room, the file relating to the certificate issued<br />

to Smt N.K. Manorama was not available.<br />

The Tahsildar through Endt.No.157/09, dated 06-06-<strong>2009</strong> informed the appellant that through<br />

Lr.No.157/06, dated 16-02-<strong>2009</strong>, the Dy.Director was informed that the file relating to Smt.<br />

N.K.Manorama is not available and that the appellant was also informed that, since the Mandal Office<br />

was shifted frequently since 1985 due to non availability of government buildings, the record<br />

pertaining to Smt N.K. Manorama are not available and hence it is not possible to furnish the<br />

information. The same fact was also informed to the Revenue Divisional Officer.<br />

The Revenue Divisional Officer, through Lr.No.1528/09, dated 22-08-2010 submitted the same<br />

facts and requested to dismiss the appeal.<br />

On 29-12-2010 the case was called. The appellant was absent. The respondents/RDO,<br />

Visakhapatnam and Tahsildar, Gajuwaka Mandal were present and submitted that the appellant has<br />

been informed that the original file has not been traced even after thorough search, due to shifting of<br />

MRO’s office twice from private buildings and to Government building. The respondents are directed<br />

to make a through search once again and furnish the factual information to the appellant with in 60<br />

days from the date of receipt of this order.<br />

With the above direction the appeal is closed.<br />
