management Licence and IPPC permit issued by SEPA including<br />

measures for the control of vermin.<br />

(viii) outside contractors warned of poor driving i.e. speeding and cutting<br />

corners.<br />

The applicant has, in relation to the coal extraction proposals and<br />

the <strong>landfill</strong> operation, indicated a willingness to subscribe to the<br />

<strong>Council</strong>’s transportation protocol which could be included as part of<br />

any Section 75 Agreement. This protocol would seek to promote,<br />

amongst other things, good driving practice.<br />

4.5 We are not happy that you shall be considering plans for the development<br />

of the <strong>landfill</strong> at <strong>Garlaff</strong>. When we built our house we knew nothing of these plans.<br />

I am sure we would never have built a house here.<br />

Planning permission for the erection of the objector’s house was<br />

granted in 1989 prior to both the current application and the original<br />

application for the <strong>Garlaff</strong> <strong>landfill</strong> site which was lodged in 1990.<br />

4.6 The <strong>Council</strong> has the cheek to class us as Band E in our council tax. We<br />

pay over a £1000 for the privilege of staying here and putting up with the pong.<br />

The smell of gas from the refuse would turn your stomach.<br />

4.7 We certainly cannot enjoy the country life. Why do these sites need to be<br />

put near built up areas?<br />

The <strong>Garlaff</strong> site is considered to be located in a relatively remote<br />

area that is sparsely populated.<br />

4.8 I shall be getting in touch with my MP about paying the amount we pay for<br />

council tax as we should be paid to live here. I also feel our property has dropped<br />

in price dramatically and would have difficulty in selling our house.<br />

The points made by the objector are not material considerations in<br />

the determination of this application.<br />

4.9 MEGA is very concerned about this application appearing at this time<br />

when there is no provision in the <strong>East</strong> <strong>Ayrshire</strong> Finalised Local Plan for new or<br />

extended <strong>landfill</strong> sites. MEGA has made strong representations/ objections to<br />

this plan in respect of waste disposal policies. To treble or quadruple the <strong>Garlaff</strong><br />

site when no provision has been made in either the previous local plans or the<br />

finalised EALP is therefore unacceptable until after the local plan has been<br />

through public inquiry. It is contrary to our Human Rights to deny objectors the<br />

opportunity for full debate on the question of using opencast voids for <strong>landfill</strong>.
